MEMORANDUM CIRCULAR

SUBJECT: AMENDMENT TO MEMORANDUM CIRCULAR NO. 2011- 008
The Board on October 14, 1998 through Memorandum Circular No. 98-027 has
required all dump/cargo trucks and other private vehicles rented out for a fee to apply
for or secure franchises from this Board or its regional offices in order to legitimize
their operation. Subsequently, on September 22, 2011, Memorandum Circular No.
2011-008 was issued exempting from the coverage of MC 98-027 certain Car Rental
services and/or private vehicles rented out subject to the conditions therein stated.
In order to obviate the confusion as to the type of car rental services and/or
private vehicles which are exempt from securing franchise, the Board limits the
application of MC 2011-008 only to those private vehicles catering long term lease and
exclude private vehicles classified as tourist transport services (which clientele vary
from time to time), shuttle service, trucks for hire and school service which are
explicitly required to secure franchise from the Board.
Now, therefore, the Board hereby amends and modify the conditions under MC
No. 2011-008 to now read:
1. Private vehicles must be covered by a long- term lease contract of not less
than three (3) years between the lessee and the car rental company/owner; and
2. The vehicle must be exclusively used and driven by the lessee or his/her
authorized representative.
All other issuances which are inconsistent herewith are hereby modified
accordingly or superseded/revoked.
‘This Memorandum Circular shall take effect fifteen (15) days following the
filing of three (3) copies thereof, with the UP Law Center, pursuant to Presidential
Memorandum Circular No. 11, dated October 9, 1992
