LLB EQUITY AND TRUSTS

Tutorial 18: Equitable Remedies

LLB (Hons)

1. Why do we need Equitable Remedies? Are they always available?

2. William is delighted that his daughter, Angela, plans to qualify as a lawyer

rather than enter the family waste management business. To celebrate Angela
passing her law exams, William wants to present her with two surprise gifts on
her graduation day. He has contracted with Ludwig, a successful music
memorabilia dealer, for the purchase of a guitar used by her favourite musician,
John Lynon. He has also commissioned Virgil Blake, a well known poet, to
compose three poems celebrating Angela’s success.

Three weeks before Angela is due to graduate, William is contacted by Ludwig

who informs him that he no longer wants to sell the guitar to William. Virgil
informs William that he is suffering from writers’ block and is unable to complete
any of the three poems commissioned.

Advise William as to any possible remedies in Equity against Ludwig and

Virgil.
