CONTRACT AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into this _____________________ day of

_______________ 2020 at Dipolog City, Zamboanga del Norte, by and between.

ROTARY CLUB OF DIPOLOG, a civic organization based in Dipolog City duly

organized and existing under and by virtue of the laws of the Republic of the
Philippines, represented by its Past District Gvernor, Lindon See Diet, with office
address at __________________________, hereinafter collectively called the
“ROTARY”;

- and -

CITY GOVERNMENT OF DIPOLOG, a local government unit duly organized

and existing under and by virtue of the laws of the republic of the Philippines with postal
address at Rizal Ave., City Hall, Dipolog City, represented herein by Hon. Darel
Dexter T. Uy, in his capacity as City Mayor, hereinafter referred to as the CITY;

WITNESSETH

WHEREAS, the ROTARY is an international community that brings together leaders

who step up to take on the world’s toughest challenges, locally and globally. The
eradication of polio is one of its longest standing and most significant efforts for more or
less 35 years now. Along with their partners, ROTARY have helped immunize more than
2.5 billion children against polio in 122 countries;

WHEREAS, as a founding partner of the Global Polio Eradication Initiative, the

ROTARY reduced polio cases by 99.9 percent since its first project to vaccinate children
in the Philippines in 1979;

WHEREAS, in view of the ROTARY’s commitment to help the CITY in its efforts
towards eradication of polio cases within its jurisdiction, the former hereby proposes to
strengthen the awareness of the public against polio by painting the phrase “ENDING
POLIO” along the wall of the parking area at the Dipolog City Boulevard;

WHEREAS, the year 2020 is the ROTARY’s 70th year anniversary in service with the
theme “Proudly Celebrating 70 years of Service to the Community” and one of its project
is to strengthen the awareness of the public against polio;

WHEREAS, in recognition of the ROTARY’s efforts in eradicating polio case all over
the world, the CITY agrees to the proposal of the ROTARY and the CITY deems that the
project is in line with its advocacy in promoting the health and welfare of all
Dipolognons, hence, beneficial to the community.

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

I. In this Agreement, words and expressions shall have the same meanings as are
respectively assigned to them primarily in the Conditions of Contract hereinafter
referred to.

A. OBLIGATIONS OF THE ROTARY:

1. Implement and coordinate project with cooperating partner LGU, the CITY.

 2. The ROTARY hereby undertakes to procure the necessary material needed for
the implementation of the project.

3. The propose mural to be painted shall contain the hereunder sample logo.

However, the ROTARY understands that the above mural may be added with
phrases or logos/official seals of the CITY with prior approval from the former to
manifests the parties’ partnership.

Further, for this purpose the ROTARY shall submit to the CITY the desired
dimensions of the mural to be painted for the latter’s approval.

4. Provide necessary tasks and reports to inform its club of the progress of the
project.

5. Visit the project and physically evaluate the progress of the project.

6. Provide additional support to the CITY, if necessary.

B. OBLIGATIONS OF THE CITY:

1. The CITY hereby undertakes to secure the necessary Sangguniang Panlungsod

resolution which grants the City Mayor to enter into and sign this Agreement.

2. The CITY hereby agrees that a mural be painted along the wall of the parking
area at the Dipolog City Boulevard and ensures the maintenance and sustainability of
the same for a period of two.

3. The CITY shall undertake the implementation and installation of the exercise
equipment within the playground at the Dipolog City Boulevard.

4. Report to the ROTARY the upkeep and maintenance of the exercise

equipment.

II. MODIFICATIONS

Modifications within the scope of this document shall be made by mutual consent
of the parties, by the issuance of a written modification, signed and dated by all parties
prior to any changes being performed.

III. EFFECTIVITY

 This Agreement shall take effect immediately upon the date of its signing.

IV. SIGNATURES

By signing below, the aforementioned parties agree to the terms of this

memorandum of understanding.

province of Zamboanga del Norte, personally appeared LINDON SEE DIET, the the
“ROTARY” and DAREL DEXTER T. UY, the “CITY”, on the date and place first above
given and caused the preparation of the foregoing integrally complete instrument,
identified to me through competent evidence bearing their photographs and signatures,
Mr. Diet presented his ______________________, Hon. Uy presented his
________________________, represented to me that their signatures appearing
on the instrument were voluntarily affixed by them for the purposes stated therein.
Furthermore, they declared that they executed the foregoing document of their free act
and voluntary deed.
