“PRIVILEGE AS A DEFENCE TO A

DEFAMATION SUIT”
(ABSTRACT)

The topic deal with defamation, privilege,

privilege taken as a defence in defamation suit. And also how the
defence of privilege is available in case of defamation. This research
gives the definition of defamation, types of defamation, what is
privilege and types of defamation and it widely speaks about Concept
of privilege as a defence. This research paper clearly gives the
various principles obtain from various case laws which are both from
Indian case laws and English case laws which relates to the
defamation suit and the cases that discuss about the privilege as a
defence to a defamation suits. And through this research we can know
how the privilege acts as the defence in the defamation suits. And we
also discuss some articles in Indian constitution also.
The aim of researcher, in doing research work is
to give a brief outline “privilege as a defence to a defamation suit”
and then study various aspects of the defamation in claiming and
judicial interpretation of the facts with the help of some relevant
cases.
