WRIT PETITION No.10252 of 2020

ORDER:

Heard the learned counsel for the petitioners and the

learned Government Pleader for Revenue. With their consent,

the Writ Petition is disposed of at the stage of admission.

The main grievance of the petitioners in this writ

petition is that the second respondent – District Collector,

Nirmal, is not considering their application and not disposing

of the same in accordance with the provisions of the

Maintenance and Welfare of Parents and Senior Citizen Act,

2007.

The learned Government Pleader for Revenue, on

instructions, has stated that the fourth respondent – Revenue

Divisional Officer, Nirmal, has already considered the

application of the petitioners and passed an order on

27.07.2020 directing the respondents to restore the

possession of the petitioners over the house bearing No.

1-4-160/B situated at Adarshnagar, Siddapur Village, Nirmal

District, and has also directed the tenants, who are presently

residing in the said house, to pay the rents to the petitioners

only.

In view of the above made submissions, the grievance of

the petitioners stand redressed.

However, the learned counsel for the petitioners states

that necessary police protection may be given to the

petitioners for implementation of the order dated 27.07.2020

said to have been passed by the Revenue Divisional Officer,

Nirmal.

In view of the same, the fifth respondent – Station

House Officer, Nirmal Rural Police Station, is directed to

provide necessary police protection to the petitioners and see

that the order dated 27.07.2020, passed by the Revenue

Divisional Officer, is complied with and the possession of the

petitioners over the subject house is restored back

immediately, if not already restored.

Subject to the above directions, the writ petition is

disposed of.

The miscellaneous petitions pending, if any, shall stand

closed. There shall be no order as to costs.
