The Committee recommended that the flag of the Indian National Congress be adopted as the National Flag of India in its present form. The resolution was approved unanimously by the Constituent Assembly on 22 July 1947. The National Flag of India is based on the Swaraj flag of Indian National Congress designed by Pingali Venkayya. The Indian National Flag is a tri-coloured panel made up of three rectangular panels or sub-panels of equal widths. The colour of the top panel is India saffron (Kesari) and that of the bottom panel is India green. The middle panel is white, bearing at its centre the design of Ashoka Chakra in navy blue colour with 24 equally spaced spokes. This wheel is a replica of the wheel of Ashoka's Lion Capital at Sarnath. The Ashoka Chakra should Page 2 of 6 preferably be screen printed or otherwise printed or stenciled or suitably embroidered and should be completely visible on both sides of the Flag in the centre of the white panel. The ratio of the length to the height (width) of the Flag shall be 3:2. The National Flag of India should be made of hand spun and hand woven wool/cotton/silk khadi bunting. The manufacturing process and specifications for the flag are laid out by the Bureau of Indian Standards. The Flag Code prescribes a total of 9 different standard sizes of the National Flag. Use and authority to display the National Flag is regulated by the Flag Code of India (2002) issued by the Department of Home Affairs, Government of India. Hon'ble the Supreme Court, in a noted decision of Union of India v. Naveen Jindal, has held that “right to fly the National Flag freely with respect and dignity is a fundamental right of a citizen within the meaning of Article 19(1)(a) of the Constitution of India being an expression and manifestation of his allegiance and feelings and sentiments of price for the nation.” By the mandate of the Apex Court, every citizen of India now has a right to fly the National Flag. However, this right is not unrestricted but regulated by the related enactments and the provisions of the Flag Code. The Prevention of Insults to National Honour Act, 1971 (as amended by the Amendment Act, 2003) provides for measures to prevent the insulting acts with regard to the Indian National Flag, whereas, the Emblems and Names (Prohibition of Improper Use) Act, 1950 prohibits the use of National Flag for the purpose of trade, business, calling or profession, or in the title of any patent, or in any trademark or design, violation of the same is punishable. In any public place or within public view, burns, mutilates, defaces, defiles, disfigures, destroys, tramples upon or otherwise shows disrespect to or brings into contempt the Indian National Flag or any part thereof, is punishable under the Prevention of Insults to National Honour Act, 1971.
