STATE OF NORTH CAROLINA BEFORE THE NORTH CAROLINA COUNTY OF GASTON, ALCOHOLIC BEVERAGE CONTROL COMMISSION In the matter of ‘Remedies Restaurant Drinks and Nightlife, LLC ORDER OF T/A Remedies SUMMARY SUSPENSION 1225 Union Road Pursuant to G.S. §150B-3(c) Gastonia, NC 28054 00248840AJ-999 ‘The above-captioned permittee operates as a restaurant and currently holds on-premises ABC permits for the retail sale of malt beverages, unfortified wine and mixed beverages. Based upon swom allegations submitted to the North Carolina Alcoholic Beverage Control Commission by law enforcement officers of the Gastonia Police Department (“GPD”) and Special Agents of Alcohol Law Enforcement (“ALE”), attached to this Order, the ABC Commission, by and through its lawful designee, AD “Zander” Guy, Jr., Chairman, finds the following unlawful acts have been alleged: 1. GPD Sgt. JR Ewers (“Ewers”), based on a review of statistical information and trends regarding calls for service, criminal activity, and violent acts, requested that GPD officers monitor Permittee’s business, [Sce Affidavit of Ewers] 2. On almost a weekly basis, GPD officers need to be near Permittee’s business around 2:00 AM due to fights breaking out. [See Affidavit of GPD Officer JP Yager (“Yager”)] 3. Law enforcement has conducted covert surveillance and undercover operations regarding narcotics sales, one of which involving Permittee’s émployee. Officers have made multiple arrests for assaults, disorderly conduct, controlled substance violations, and have used OC Spray and other Use of Force methods to restrain intoxicated persons. [See Affidavits of GPD Officer SJ Barksdale (“Barksdale”), Yager, and ALE Special Agent N. Basgall (Basgall”)] 4, Drugs, guns and other weapons are often in plain view in patrons’ vehicles when officers walk through the parking lot of Permittee’s business. [See Affidavit of Yager] 5. Due to large crowds and violent activities at Permittee’s business, off-duty marked GPD officers have been assaulted and are not safe working at Permittee’s business if there are only two officers present. (See Affidavits of GPD Chief of Police Travis Brittain (“Brittain”), Officer SC Canipe (“Canipe”), Officer SD Hoyle (“Hoyle”) and Sgt. E, Seagle (“Seagle”)] 6. Some GPD officers opted to no longer work off-duty assignments at Permittee’s business due to the risk of violence. [See Affidavits of Brittain, Canipe, Ewers and Scagle] 7. Patrol units often respond to Permittee’s business to assist the off-duty officers with fights and assaults leaving citizens in other parts of Gastonia without police protection. [See Affidavits of Brittain, Canipe and Ewers] 10. i 12, 13, 4, 15, 16. 17, 18. 19, 20, On October 10, 2020, a fight occurred resulting in someone being knocked out near the pool tables. A large fight then broke out requiring off-duty GPD officers to request assistance due to the size of the crowd and the size of the fight. [See Affidavit of Hoyle] On November 12, 2020, shortly after 11:00 PM, law enforcement responded to a “shots fired” call at Permittec's business. [See Affidavits of Barksdale, Canipe, and ALE Special Agent in Charge Omar Qureshi (“Qureshi”)] Upon arrival after 11:15 PM, Basgall observed many police and emergeney vehicles in the parking lot of Permittee’s business. There were approximately 30-35 vehicles parked at the business with 40-50 patrons standing outside, [See Affidavit of Basgall] Permittee’s business was functioning as a nightclub and not a restaurant, with large crowds of patrons walking around not seated at tables, not wearing masks, and not social distancing. Performers were singing on stage and patrons were dancing. [See Affidavit of Basgall] At approximately 10:58 PM, Permittce’s employee Keith Santana (“Santana”) had punched a male in the face ‘hile on the outside patio leading to a large fight involving many patrons. The fight continued onto the sidewalk that leads to the entrance of restaurant, [See Affidavit of Basgall] Patrons began running away from Permittee’s business through the parking lot, some jumping the fence between the patio and parking lot and some getting into cars that left at high speeds. Approximately 20-30 patrons continued to fight with the two GPD off-duty police officers attempting to break up the fight. [See Affidavit of Basgall] A patron then fired a gun multiple times into the crowd, specifically aiming at the back of one of the GPD officers. The crowd ran in all directions from the gunman, some limping and one attempting to get up after falling several times. (See Affidavit of Basgall] Both GPD officers were shot while attempting to break up the fight. One officer was shot in the back; his Kevlar vest likely saving his life. Both officers were shot in the legs. [See Affidavits of Barksdale, Qureshi and Basgall] Multiple subjects were struck by gunfire. Santana was stabbed in his right forearm and had several bloody serapes and scratches. [See Affidavits of Barksdale, Canipe, Qureshi and Basgall] Officers observed several large pools of blood and blood spatter across several vehicles. There were many spent bullet cases spread across the parking lot of Permittee’s business. [See Affidavits of Brittain and Basgall] ‘The exterior patio of Permittee’s business contained broken glass (bottles and possible ashtrays) and blood splatter, including on a pillar. [See Affidavit of Basgall] Due to the violence on November 12, 2020, all off-duty marked law enforcement duties have been revoked for Permittee’s business due to the imminent threat of injury or death, [See Affidavit of Brittain] Unsafe criminal activity at the business and large groups of unruly and violent patrons create a hazardous environment for the public and for police officers answering calls. Conditions are sufficiently hazardous at Permittee’s business that law enforcement are at substantial risk when responding to calls at permittee’s business without adequate backup. [See Affidavit of Brittain} 22. The operation of the business is a drain on GPD resources due to the volume of calls for service for violent acts and subsequent investigations. [See Affidavits of Barksdale, Brittain, Canipe and Ewers] 23, Permittee, Alisa Edwards, has told Basgall that she doesn’t understand why she is responsible for what happens, that employees and patrons do what they want at her business, and she finds it difficult to control her business and patrons. [See Affidavit of Basgall] 24. The disregard for safety, especially during the COVID-19 pandemic, by continuing sales and service of alcohol, despite the ongoing violence resulting in serious injury to patrons and law enforcement, creates a hazardous environment, Based upon the above, the ABC Commission, by and through its undersigned designee, finds that the protection of the public health, safety and welfare requires emergency action. § 150B-3. Special provisions on licensing. (©) If the agency finds that the public health, safety, or welfare requires emergency action and incorporates this finding in its order, summary suspension of a license or occupational license may be ordered effective on the date specified in the order or on service of the certified copy of the order at the last known address of the licensee, whichever is later, and effective during the proceedings. The proceedings shall be promptly commenced and determined. THEREFORE, IT IS HEREBY ORDERED pursuant to G.S. §150B-3(c) that the ABC permits issued to the above-captioned permittee are summarily suspended effective immediately upon service of this Order. ‘This the 14" day of November 2020. Tknow that all off-duty marked law enforcement duties have now been revoked at this location because the imminent threat of injury or death has become an issue. tis often that the parking lot of the restaurant and then use connecting roads and patron's vehicles fill the restaurant and then use connecting roads and adjacent parking lots near the business to park their vhicles impeding traffic and requiring the towing of some said vehicles, iow that my Department resources are often tied up in conducting investigations associated with the business thus conflicting with other calls for service in the city. know that patrol units often are tasked with assisting the off-duty officers at the location to attempt to mitigate or prevent fights and assaults that occur when the business begins to close thus not allowing those units to perform their regular duties. 9. Iknow that the location is frequented by known gang members, 10. know of various criminal law violations that occur on and in the business when the police are not contacted, 11. Tknow, through my professional experience that violent incidents occur there on a frequent basis, 12. Tlnow through my professional experience that officers do not respond to this location unless you have sufficient backup, because of the violence of the patrons from the business, 13. The continued operation of the business will result in injury to citizens and law enforcement personnel, 14, The continued operation of this business places a strain on the Officers of the Gastonia Police Department as well as other law enforcement agencies in the County. —~ Set. Iti a knowm fact that officers need to be clone iy the restaurant around 0200 hrs. when the doors close in case another fight breaks oot 3:1 have personally arrested numerous people at this restaurant for assaults, disorderly conduct, drug violations etc. and have been in several Use of Force incidents whos officers have deployed OC Spray or other physical means of restuining itoateaced suspects. ‘4. I work as a member of the Gastonia Police Department Street Crime Unit 2. Thave been a Police Officer withthe department for 6 years and 3 months. 3 Thave responded to multiple calls for service in relation to this business, 4. This location is well known throughout the department of having a multitude of problems, ranging from intoxicated drivers to shootings, §. Thave responded to and personally been involved in investigations involving assaults. § The nightclub has a reputation for being a hang-out of local gang members, and has even attracted members of known drug trafficking organizations, 7, On previous occasions, I have conducted covert surveillance of narcotics sales from this Jocation, utilizing confidential informants. 8: On October 13, 2019, I was working at this location as part of an off-duty security capacity. 9 During this evening, a fight occurred between multiple patrons. Business security pushed the offenders of the fight out towards the parking lot, @ security member, the wie Seeulted me by striking me inthe face. This subject was subsequently’ charged with assault on a law enforcement officer. 11. On November 12", 2020, I responded to a shooting involving two officers from the Gastonia Police Department. 12, During this incident, I assisted in removing two subjects from vehicle, which was later found to have a handgun inside of it. 13,1 assisted in providing medical sid to both officers, both of which received injuries to their legs from gunfire, One officer was also struck in his back, and his life saved due to ‘wearing a Kevlar vest. 14, During this incident, multiple other subjects were struck by gunfire, and one member of the business’ security was stabbed. 15, This location is a nuisance to the community, 16, Ibelieve this location is a danger and detriment to the community, It drains the resources of the Gastonia Police Department Patrol Division. 17.1 would like to see this business be shut down, so as to mitigate danger to the general public and to officers who respond to calls at this location. On November, 12 at approximately 11:15 pm I was notified of an ongoing investigation at Remedies located at 1225 Union Road, Gastonia, NC. Once arriving on scene T observed many police and emergency vehicles parked all around the business with their blue/red lights on, I observed approximately 30-35 patron vehicles still parked at the location and approximately 40 ~ 50 patrons standing outside. It was determined that patrons at the business were involved in an afftay in the patio section of the restaurant in which the fight continued into the parking lot where patron(s) discharged a firearm striking two Gastonia Police Officers and four other patrons. T observed the scene of the shooting and saw several large pools of blood and blood splatter spread across several vehicles. I saw many spent bullet cases spread across the parking lot and a single spent round laying amongst them, The rounds tip was smashed in on itself indicating that it impacted with a perpendicular object. ‘While conducting an inspection of the business I observed the exterior patio and saw broken beer bottles and what appeared to be broken glass ashtrays. Amongst the debris 1 observed blood splatter all over the patio and on one of the pillars. ‘Upon reviewing the camera footage that was recorded that evening I observed: a. Lange crowds of patrons inside and at the outside patio, most of which appeared to not be wearing face mask, congregating in large groups. b. Many of these patrons were not seated at tables but, were standing, regularly ‘walking around and/or dancing about the restaurant. c. The bar area was nearly surrounded by patrons sitting shoulder to shoulder. 4. There were performers singing on the stage with groups of patrons coming and ‘going about the business not practicing social distancing. €. At the approximate labeled time of 22:58 in the camera view of the outside patio, Tobserved Keith Santana, who later at the scene advised me he was an employee and is known to Gastonia Police Officers as an employee, is observed punching a black male in the face which results in a much larger fight with many patrons. £ Lobserved the fight continue onto the sidewalk that leads to the entrance of the restaurant, I saw flashlights being activated indicating the presence of the off-duty police officers. I observed the group continue to the left side of the business (right side of the camera.) &. Lobserved in the camera view showing the left side of the business, patrons running across and through the restaurants parking lot, patrons jumping the fence that separates the patio from the parking lot, and some patrons getting into cars that are driven away at high speeds, b. I saw the large crowd contimue to conduct the affray into the parking lot. There appeared to be 20-30 patrons involved with two police officers attempting to break up the fight. Patrons can be seen pushing, swinging punches, and falling down. i. I observed in the top right camera view an individual extend their right arm towards the crowd, specifically at the back of one of the police officers, then ‘many muzzle flashes emit from his extended hand. i, Lobserved the crowd suddenly begin to disperse with a patrons running away from the gunman in all directions, some limping to cars and one on the ground attempting to get up then falling down again. ke Tobserved the gunman walk calmly away towards the front of the business while patrons of the business continued to franticly flee the premises. 8. In a previous investigation of the business I acted as the Agent in Charge of an undercover operation were an employee of the business facilitated the sell and delivery of controlled substances to undercover officers in which the undercover officers also observed other drug, alcohol and other eriminal activity and violations. 9. ‘Twas briefed about the location upon being assigned to Gaston County and was requested to specifically monitor this establishment given crime trends and possible ABC violations, 10.1 have personally seen patron’s vehicles fill the parking lot and grass areas of the restaurant and fine connecting roads and use other parking lots 10 park their vehicles impeding traffic. 11.1 know that my Agencies resources are often tied up in conducting investigations associated with the business thus conflicting with other investigations in my assigned areas. 12. Ihave criminally charged many patrons and a few employees of the business for drug and alcohol offenses. 13. During previous conversations/interviews with the owner and permittee, Alisa Edwards, she has stated/uttered several times and in different ways that she does not understand why she or the business could be at fault for things happening without her knowledge, that employees and/or patrons will act and do what they want at her business, and she finds it difficult at times to control the business and her patrons. 14, This location is a danger and detriment to the community. Tam a sworn Officer with the Gastonia Police Department since March 1994, having 25 years experience. 2, On November, 12 at approximately 11:15 pm I was called in to assist in the supervision of an ongoing investigation at Remedies located at 1225 Union Road, Gastonia, NC. 3. It was determined that patrons at the business were involved in an affray In the Patio section of the restaurant in which the fight continued into the parking lot where patron(s) discharged a firearm striking two Gastonia Police Officers and four other patrons. Spent handgun casings and a fired bullet were observed in the parking lot and a handgun was recovered from behind the business. - While at the scene I observed many separate puddles of blood and blood splatter from that of the injured Police Officers and patrons. I stop working off duty at Remedies dnc to the lack of Officers. 6-1 Know that Remedies is frequented by subjects that sale narcotics and cary firearms. ane t thee subjects are documented gang members and use Remedies = local hangout. 7 On 11-12-2020 1 responded to Remedies in reference to shooting. 8 Two Officers working off duty were struck by gunfire afer a fight escalated into gunfire, °- One Officer as struck in the knee and in the back. His Kevlar likely saved his life, Another Officer was struck in the foot. 10.1 assisted in stopping a vehicle that was leaving the scene and was involved in the incident. Two of the six subjects in this vehicle had been struck by gunfire. There was stil a very large crowd on scene when I arrived after I assisted on the traffic stop. 11. This location is a nuisance to the community. 12. T believe this location is a danger and detriment to the community. I have worked off duty at Remedies approximately half a dozen times since I have been employed at Gastonia Police Department, 4. On every occasion that I have worked off duty at Remedies there has been a lange crowd at the business and always some type of fight.. 5. On 10/10/2020, I recall a fight that broke out where someone was knocked out neat the Pool tables inside and then a large fight broke out. On this night we requested assistance due to the size of the crowd and the size of the fight, 6. Every time I worked off duty at Remedies I have felt like two officers was just not enough for the size of the crowd. I have quite frankly felt like it was unsafe for officers to work remedies, 7. Tam in the Street Crime Unit and also part of our Gang unit 8: On every occasion I have observed people enter Remedies that | know carry firearms or sale narcotics. Every time I work this location I also make a mnental note to watch out for these subjects when the club closes down. 9.1 also recall a situation with Officer Lutz where a female fred a round into the ground right in front of him. 10. On 11/7/2020, 1 was working off duty at this location and recall a subject by the name of Dee White arrived at the club and stay for a couple hours. Mr. White is a krown gang ‘member and is always on Facebook flashing some type of fiream. On this night Me White exited the bar and another subject wanted to fight him. Mr. White avoided the fight and stated he was going to get a gun and come back. Mr. White left but never came back, 11, Remedies is not only unsafe for officers to work but for enyone to visit this ‘establishment. Alcohol Law Enforcement Branch (ALE), District VI- Harrisburg, which includes Gaston County. 2. Ihave been employed with ALE for 21 years. 3. As part of my duties as an ALE special agent, I conduct enforcement of all criminal law violations occurring at ABC licensed establishments, and inspections of ABC licensed establishments to determine compliance with N.C. ABC Commission Rules and Regulations. 4. Lam familiar with REMEDIES and have worked enforcement at the business on multiple occasions. 5S. On Thursday, November, 12", 2020, at approximately 11:11pm, I responded to « call for shots fired and officers down at REMEDIES, an ABC licensed restaurant, When {arrived at REMEDIES, 1225 Union Road in Gastonia, I observed a large Jaw enforcement response, large crowd, crime scene tape, and shell casing on the ground. 7. spoke with Gastonia Detective Sergeant Doug Carpenter and advised him we were there to assist and conduct an ABC investigation. Detective Carpenter advised me that 2 officers were shot and in good condition, several more people ‘were showing up at area hospitals with injuries or gunshots, and one person was in custody. Detective Carpenter also told me a pistol was located behind REMEDIES. 8. Lassisted SA Basgall with an inspection of the premises. I located a white male standing near the entrance doors wearing bloody clothing and he appeared to be injured. The male identified himself as Keith Santana. He was obviously impaired, had slurred speech, unsteady on his feet, and had a strong odor of an alcoholic beverage on his breath. 9. Santana said he works at REMEDIES but he was off tonight, Santana had a stab ‘wound on his right forearm and several other bloody scrapes and scratches. He refuused EMS treatment. His yellow shirt was a REMEDIES employee shirt tumed inside out. Santana told me he was drinking on the patio and overheard some people say they wanted to jump the bouncers. Santana then told me he was attacked and all he could do was hold up his arms because they were trying to stab ‘him. Santana said he thought he had to work tonight even though he usually doesn’t work on Thursdays. 10. I documented 4 photographs of Santana’s clothing and injuries. I noticed broken glass bottles and blood stains on the patio area where Santana said he was attacked. I documented 4 photographs of the patio area, 11. Ithen spoke with Gastonia Sergeant Seagle who told me he has responded to several violent incidents at REMEDIES and has had to investigate several Use of Force incidents involving his officers at REMEDIES. Sgt. Seagle said this is not a safe place for his officers to work. 12. Ihave been to this location several times in the past to assist other ALE agents and the Gastonia Police Department. I am familiar with other incidents of violence at REMEDIES and after ‘seeing this incident involving 6 people shot, including 2 law enforcement officers, REMEDIES is a danger and detriment to the community. This location is unsuitable to hold ABC permits and I request the NC ABC Commission consider an immediate summary suspension action on the ABC permits at REMEDIES restaurant.
