WHEREAS, the Employer invited tenders for the “Improvement of Wooling Nagla Farm Road (Additional) under Orong Gewog”, hereinafter called “the Works” and has accepted a Tender by the Contractor for the execution and completion of these works and the remedying of any defects therein at the sum of Nu. 7, 44, 832.080 (Ngultrum Seven Hundred Forty Four Thousand Eight Hundred Thirty Two Point Zero Eight) only, hereinafter called “the Contraet price.”. NOW THIS AGREEMENT WITHNESSETH as follows: 1. In this Agreement, words and expressions shall have the same meanings as are respectively assigned to them in the General Conditions of Contract hereinafter referred to. In consideration of the payments to be made by the Employer to the Contractor as hereinafter ‘mentioned, the Contractor hereby covenants with the Employer to execute and complete the Works and remedy any defects therein in conformity in all respects with the provisions of the Contract. 4. If the contract is terminated because of a fundamental breach of contract by the contractor, the contractor is to stop the work immediately, make the site safe and secure and handover the site to the employer. The measurement of the work done shall be carried out by independent bodies in presence of contractor and employer. The contractor shall be liable for payment of penalties to the employer as indicated in the GCC and SCC of the contract documents. The remaining work shall be taken up immediately by the employer and complete the work.
