CONSTITUTION AND BY-LAWS

DONCAMAR BPATS ASSOCIATION

CALAPAGAN, LUPON, DAVAO ORIENTAL

KNOW ALL MEN BY THESE PRESENTS:

That we, the undersigned all of legal age, Filipino citizens and a resident of Barangay
Don Mariano Marcos, Calapagan and Marayag. This day we voluntarily agree to form a non-
profit Association, known as BPATS ASSOCIATION, and we abide under all existing laws of
the Republic of the Philippines.

THAT WE HEREBY CERTIFY;

Article I : THE NAME AND PRINCIPAL ADDRESS OF ASSOCIATION

The association is known to be DONCAMAR BPATS ASSOCIATION located

at Baranagay Calapagan, Lupon, Davao Oriental.

Article II : VISION, MISSION and GOALS

SECTION 1 – Vision

We envisioned a progressive and independent association.

SECTION 2 – Mission

Conduct skills training and livelihood program that will equip every member of the
association.

SECTION 3 – Goals/Objectives

 To increase extra source of income of the members of the BPATS association;

 To provide sustainable income for BPATS association thru livelihood programs;

 To protect the rights and interest of every member of the association;

 To promote understanding, unity, cooperation with the purpose of improving the

economic, financial, social and spiritual well-being of every member; and

 To extend help to the members in times of emergencies or even accidents.

Article III : MEMBERSHIP
Membership to the association is open to all DONCAMAR residents who has no

derogatory records from their own respective barangays and currently appointed by the Punong

Barangay as Barangay Tanod.

1. Pledge to perform all the duties and responsibilities as a member of the association;

2. Complete the briefing orientation by the President to be able to attain the pre-

membership;

3. Willing to pay the membership fee of P50.00 upon application; and

4. Shall pay monthly due amounting to P10.00.

Article IV : RIGHTS, DUTIES AND PRIVILEGES OF MEMBERS

1. Cooperate and participate all the affairs and activities of the association such as: meeting,

Bayanihan, party and etc.;

2. Inspect and examine the book of account, the book of minutes in every meeting and other

records;

3. Raise questions, give reactions and comments or give recommendation;

4. Avail himself of any services of the association without discrimination;

5. Every member has the right to vote and be elected as an officer of the association;

6. To care and watch the things that is owned by the association;

7. Attend in all the regular and special meetings called by the officers of the association;

8. Observe and obey the rules and regulations mandated in the Constitution and By-laws of

the association, as well as Board of the Directors resolution;

9. Members of the association should assist in all affairs and activities in 3 Barangays (Don

Mariano Marcos, Calapagan, Marayag “DonCaMar”) at least 5 persons of BPATS

member of non-host Barangay, if needed;

10. Influence by liquor while on duty is strictly prohibited;

11. Always wear proper uniform with I.D. while on duty;

12. Successive 3 absences in a meeting shall automatically be terminated from the

association;
 13. All drivers of each Barangay shall be automatic member of the association, and the

Barangay Peace and Order Chairman; and

14. Promote and protect the purpose and objectives of the association, in order to attain the

mission vision and goals and uplift the life of general welfare of all community and

members.

Article V : QUALIFICATION OF OFFICERS AND THEIR RESPECTIVE

FUNCTIONS

SECTION 1 – Qualification of Officers

a) Must be a resident of any of the 3 Barangays Don Mariano Marcos, Calapagan,

Marayag “DonCaMar”; and

b) No derogatory records or pending case found in 3 barangays and Municipal.

SECTION 2 – Officers and their Respective Functions

a) Board of Directors – the law policy making body and shall be general supervisor

and shall control in all the affairs of the association. The Board of Directors shall meet

monthly together with the resident as their presiding officer;

b) President – the presiding officer in all the meetings of the association and on the

meeting of the Board of Directors. He can sign contract and other documents authorized by

the Board of Directors;

c) Vice-President – he can perform the functions of the President in case of his

absence with the supervision of the Board of Directors;

d) Secretary – keep all the records and complete list of all the members of the

association. Take down notes in all the matters discussed in the Board of Directors’ meetings

and in the general assembly or every time there is a meeting of the association. Shall keep the

attendance of every meeting and shall serve Notice of Meeting and perform other functions

as directed by Board of Directors;

e) Treasurer – a custodian in all the money matters of the association shall keep all

the financial records and association shall keep all the financial records and discharge
 disbursement function approved by the authorized officers. Give updates of every meeting

and financial status of the association;

f) Auditor – shall conduct period examination of the books of accounts 3 to 5 times

before the schedule of the association meeting;

g) Business Manager – shall manage all the business affairs and transaction of the

association; and

h) Sergeant at Arms – shall be responsible for the room set up and shall help to

facilitate the meeting however their primary responsibility is to maintain order within an

organization at all times;

SECTION 3 – Election of Officers and Term of Office

1. The President and all other officers of the association shall conduct an Election after

receiving the appointment from the Punong Barangay;

2. The President and all officers have a three (3) year term of service;

3. Every 3 years there will be an election of the new set of officers;

4. Continuous re-election of previous officers are allowed; and

5. In case the majority of the members are not satisfied with the performance of the officers

and BOD, the members are allowed to request for the re-organization of the erring

officers;

Article VI : MEETING AND ASSEMBLIES

OFFICERS and MEMBERS MEETING

1. Membership meeting every last Friday of the month held at Barangay Calapagan lupon,

Davao Oriental;

2. Regular meeting of the Board of Director shall be held every third Saturday of the month;

and

3. Special meeting of the officers and the Board of Directors may be called by the president

when necessary or on his absence the Vie-President( Internal and External) and the Board

of Directors can call for a meeting;

Article VII : FUNDS DISBURSEMENT

1. Any withdrawal shall be approved by the BOD;

2. Amounting from P1,000.00 to P5,000.00 – the signatory shall be the President, Treasurer

and 1 BOD; and

3. Amounting from P5,000.00 and above – authority from the majority of the membrs is

necessary;

Article VIII : BENEFITS OF EACH MEMBER OF THE ASSOCIATION

a) Every member are entitled for equal benefits from the association;

b) Every member are entitled for medical assistance; and

c) Previous member of the association who have reached the age of 60 and above and who

are not active member of barangay Tanod still be considered as member of the BPATS

Association provided upon reaching the age of 65 shall be automatically terminated.

Article IX : PENALTY

a) Successive 3 absences in a meeting shall be automatically terminated from the

association;

b) A penalty of P100.00 for every officer not attending regular meeting;

c) Any member actually caught drinking while on duty shall be penalize:

First Offense - P50.00

Second Offense - P100.00

Third Offense - P150.00

Fourth Offense - Termination from Association

d) Members not attending the Assembly meeting shall pay P50.00 as penalty.
Article X : SOURCE OF FUNDS AND DISBURSEMENT FEE

a) From the membership fee, monthly dues and penalties paid by the members;

b) A separated book of account shall maintain periods examination by the concerned

officers especially the Auditor ; and

c) Assistance from the Government and Non-Government Organization.

Article XI : AMENDMENTS AND MODIFICATION

The Constitution and By-Laws may be amended and modified in part or in whole

by the members of the Board of Directors upon concurrence and approval of the majority of the

General Assembly through adoption and ratification procedure.

Article XII : EFFECTIVITY

The Constitution and By-Laws shall take effect immediately upon its ratification

and adoption by the General Assembly called for the purpose.

Hereunder are the persons responsible in drafting the said Constitution and By-

Laws of the DONCAMAR BPATS ASSOCIATION who by one way or another contributed

their ideas and opinions in crafting their dreams and aspiration.

Election of Officers

The table opens for nomination by PSSG. Anthony. Mr. Lucito Bagay was recognized to

nominate Mr. Ronie Gante for President another nomination by Mr. Jesser Sudario nominating

Mr. Jose Boya. An additional nomination was receive from Mr. Rex Docusin nominating Mr.

Danilo Lubiano. The nomination was closed by Mr. Randy Florida. After the votation Mr. Gante

garnered the score of 29 votes, Mr. Boya for 10 votes and Mr. Lubiano for 14 votes, 7 of the

attendees abstained and from there on the elected President Mr. Ronie Gante presided the

meeting for the continuation of the remaining position of the association. The below-listed

attendees/Brgy. Tanods are the newly elected officers of the association. To wit:

After the election, the new set of officers decided to draft and formulate the Constitution

and By-Laws of the Association and be submitted to the concern government agencies such as

DOLE, SEC and etc.

The meeting adjourned at 3:40 P.M. who has been moved by Mr. Ryan Povadora and

seconded by majority of the members present.
