Facts:
Yellow Ball Freight Lines, Inc. filed a civil suit against Rice and Corn Administration for a breach
of contract. While the civil suit is in the sala of respondent judge for the collection of a money
claim arising from an alleged breach of contract, a motion to dismiss was filed by the defendant.
The judge, however, denied the motion filed.

The Solicitor General filed a motion of certiorari and prohibition due to failure to apply doctrine of
the non-suability of a State, including its offices and agencies, from suit without its consent.

Issue:
Whether or not the Rice and Corn Administration, being an agency of the State, can be sued by
a private entity, due to breach of contract and whether or not the motion of certiorari and
prohibition filed by the Solicitor General is valid.

Held:
The Rice and Corn Administration, being an agency of the State, cannot be sued by a private
entity without its consent. The consent, to be effective, must come from the State acting through
a duly enacted statute.

The petitioner for certiorari is granted and the resolution denying the motion to dismiss filed by
the Rice and Corn Administration nullified and set aside and the petitioner for prohibition is
likewise granted restraining respondent Judge from acting on civil case pending in his sala
except for the purpose of ordering its dismissal for lack of jurisdiction. The temporary restraining
order issued by this Court is made permanent terminating this case. Costs against Yellow Ball
Freight Lines, Inc.

The loss of governmental efficiency and the obstacle to the performance of its multifarious
functions are far greater if such a fundamental principle were abandoned and the availability of
judicial remedy were not thus restricted

Yellow Ball Freight Lines, Inc could still proceed to seek collection of money claims by pursuing
the statutory remedy of having the Auditor General pass upon them subject to appeal to judicial
tribunals for final adjudication.
