HOW TO DISTRIBUTE Takaful BENEFITS?

Takaful Benefits
1. We participate in Takaful to mitigate financial risk.
2. Thus, Takaful benefits are very valuable.
3. There are 3 ways to distribute Takaful benefits:
i. Without nomination
ii. With nomination
iii. With assignment

4. Person covered is encouraged to nominate at least one person.


5. This is to evade the possibilities of the Takaful benefits:
i. have too much procedures to make claim
ii. cannot be claimed 100% by the proper claimant
Bear in iii. being regarded as unclaimed money after certain years.

for the financing made amounting RM 20,000.
III. Suitable takyif fiqhi for this absolute assignment?
IV. Rules in paying debt should be observed.
V. The concern: Takaful benefits assigned > outstanding amount
VI. Although bank will only take an amount outstanding and return the balance,
the surface transaction (no. 1 to no. 2) will attract riba.

1. Effect of Certificate Surrender on Assignment

Can assignor surrender the certificate?

• Assignor can surrender if he/she only assign Takaful benefits.

If can, who possess the surrender amount?

• Assignor
• because from legal POV, assignment has been terminated
automatically
• Even though assignment is irrevocable, it is still bound to the
status of Takaful certificate.

ASSIGNOR named above, hereby absolutely,
irrevocably and unconditionally assign to the
ASSIGNEE all my rights, title and interest under the
above Certificate No. and all benefits and advantages
to be derived therefrom for the percentage of
%_____ of the Basic Sum Covered. I hereby confirm
and declare that I have not assign the Takaful
benefits in the Certificate to any person and the
ASSIGNEE hereafter shall be bound by the terms and
conditions contained in the said Certificate No.

absolutely and irrevocably unto the ASSIGNEE
named below all my rights, title and interest (if any)
under the abovenamed CERTIFICATE, and all benefits
and advantages to be derived up to the outstanding
amount of the abovenamed financing. I declare that
the ASSIGNEE shall be bound by to the terms and
conditions contained in the said CERTIFICATE and
that I have not previously assigned the CERTIFICATE.
