“AN ORDINANCE PENALIZING THE DISHONESTY OR UNTRUTHFUL

DECLARATION OF ANY PATIENT IN TIME OF PUBLIC HEALTH EMERGENCY
OR PANDEMIC”

WHEREAS, the 1987 Constitution provides that the state shall protect and
promote the right to health of the people and instill health consciousness
among them;

WHEREAS, the Local Government Code of 1991 provides under the General
Welfare Clause that every Local Government Unit shall exercise the powers
expressly granted, those necessarily implied therefrom, as well as powers
necessary, appropriate or incidental for its efficient and effective
governance, and those which are essential to the promotion of general
welfare;

WHEREAS, the President of the Republic issued Proclamation No 922

declaring the entire country under the state of Public Health Emergency,
recognizing that COVID – 19 constitute threat to the National Security and
to prompt-whole-of –government approach in addressing the outbreak;

WHEREAS, the rapid increase of COVID -19 cases in the country was
observed and due to this developing situation DOH has declared Code Red,
Sub Level 2 and President Rodrigo Roa Duterte issued Proclamation
declaring the entire country under State of Calamity;

WHEREAS, it is imperative to protect the health of our constituents that

measures are in place to properly monitor and assess transmission of
subject disease and its containment that all health declarations and records
must be truthful;

WHEREFORE, in view of the foregoing, on motion of HONORABLE ANGELA

JOY ALFARO TUPAS, duly seconded, it was - Be it enacted by the
Sangguniang Bayan in session assembled:

SECTION 1. TITLE. - This Ordinance shall be known as " AN ORDINANCE

PENALIZING THE DISHONESTY OR UNTRUTHFUL DECLARATION OF ANY
PATIENT IN TIME OF PUBLIC HEALTH EMERGENCY OR PANDEMIC " or the
PATIENT DISHONESTY ORDINANCE.
SECTION 2. PURPOSE - This Ordinance has for its purpose of ensuring that
all medical records required to monitor and contain the spread of COVID 19
are truthful and reliable.

SECTION 4. SUBJECT

Any person who shall be required by any Rural Health Unit, Barangay
Health Emergency Response Team, Barangay Health Workers, medical
clinic, hospital facility, whether public or private, to fill out or accomplish
information sheet, data form declaration or any similar document, shall
state the truth and disclose all relevant information as required in the said
form or document or as may be asked by aforementioned authorities or
their agents.

Likewise covered herein are persons who, in behalf of the patient

accomplishes the form or make declarations when asks or required by the
aforementioned authorities or their agents.

SECTION 5. PENAL CLAUSE – Any such patients or persons who acts in

their behalf who is found to have knowingly and deliberately lie, committed
dishonesty and or withheld relevant information during a state of public
health emergency as declared by the national government or a pandemic
as declared by the World Health Organization or Department of Health
shall be punished by an imprisonment of one year and a fine ranging from
the amount of one thousand pesos (P1,000.00) to Two Twosand Five
Hundred Pesos (P2,500.00).

SECTION 6. SEPARABILITY CLAUSE - If any portion of this Ordinance is

declared unconstitutional or invalid, the other provisions hereof which are
not affected, shall continue in full force and effect.

Section 7. REPEALING CLAUSE– Any Ordinance, resolution or regulation

inconsistent with the spirit of this ordinance are hereby repealed or
amended, as the case may be.

Section 8. EFFECTIVITY CLAUSE– This ordinance shall take effect

immediately.
