WILL

Facts –
Smt. Rohini Mehra, aged 40 years W/o Shri Anubhav Mehra, both R/O of House no. 53 Kamla
Street, Kanpur, owns a house in Noida in her name which was purchased by her self earned
income. She is not having good health now a days and hence she wants to create a will in
favour of her only Minor daughter named Ms. Shobhita Mehra aged about 10 years. Smt.
Rohini has executed the will and have appointed Shri Anubhav Mehra as trustee of the property
which is given in ownership by way of Will to Ms. Shobhita in case Smt. Rohini dies before she
turns 18 years of age.
Description of the property –
A residential house in sector 15 Noida bearing house no. 55. Total area of the house 1500 Sq.
Ft. having two floors constructed.
Assignment – Draft a Will giving the property in Noida in favour of Ms. Shobhita Mehra. Also
include a clause in the will in which her father is to be appointed as trustee of the property
which is to be given to her by way of will till she turns 18 years of age.
 FORMAT OF WILL

I, ________________, wife of Shri ____________, aged about 65 years, R/o ____________,

hereby make this last Will and Testament which contains my desire for the enjoyment of
properties till I die possessed off.
WHEREAS this Will cancels all my previous Wills/Codicils1 made upto this day.
AND WHEREAS this Testament shall take effect only on my demise and till such time I shall
continue to enjoy the properties that I own.
AND WHEREAS I am having one son named ______________ and three daughters namely
Smt.___________, Smt. __________, and Smt.______________.
AND WHEREAS all my daughters are married and well off and I have done all I could do for them
according to my status, resources and circumstances and therefore I do not wish to bequeath
anything in their favour by way of this will.
AND WHEREAS besides other assets I am owning a double story hosue built on plot
admeasuring 200 Sq. Yds. Bearing No. _____________.
I, therefore, hereby bequeath absolutely and forever the whole of my estate whether movable
or immovable, wherever and howsoever the same may situate to my Son, and no other relation
of mine shall be entitled to claim any right, title or interest therein. However, if God forbid my
son predeceases me, the above said estate, which I have bequeathed in his favour, shall devlve
exclusively upon my grandson Master _____________ (Son of Mr. __________)
