4. The issues raised in all these petitions are similar. We find that in
some of these petitions (being W.P.(C.) Nos. 7010/2020, 7011/2020,
7012/2020 & 7018/2020), notices have not been issued. Accordingly, we
direct issuance of notice to the respondents in the said petitions. Learned
counsels appearing for their respective respondent accept notice.

5. Issue notice to the unserved respondents in the aforesaid petitions


through e-mail returnable on the next date. Counter-affidavits be filed
before the next date.

6. Since the issues involved in these petitions are legal, we direct that all

these petitions be listed for hearing on 10.11.2020. We make it clear that
hearing in these petitions shall proceed whether, or not, counsels complete
the pleadings, since the issues raised are legal.

7. We permit the petitioners to jointly file a single written-submission –


not exceeding five pages, of the submissions that they would like to advance
at the hearing of these petitions. Learned counsels representing all the
petitioners shall coordinate amongst themselves to prepare the said written-
submission. Similarly, all the respondents may also file a common written-
submission after consultation and cooperation amongst themselves.

8. Mr. Neeraj K. Kaul, Senior. Advocate – who appears for the


respondent/ SBI in W.P.(C.) No.5712/2020, has brought to our attention
Section 96 of the Insolvency and Bankruptcy Code, 2016 (IBC), which
provides for an interim moratorium when an application is filed under
Section 94, or Section 95 of IBC. Clause (a) of Section 96(1) provides that
an interim moratorium shall commence on the date of the application, in
relation to all debts and shall cease to have effect on the date of admission of
such application. Clause (b) thereof provides that during the interim
moratorium period, any legal action or proceedings pending in respect of
any debt shall be deemed to have been stayed and the creditors of the debtor
shall not initiate any legal action or proceedings in respect of any debt.
Section 96 (1) of IBC reads as follows:

“96. (1) When an application is filed under section 94 or


section 95—
(a) an interim-moratorium shall commence on the date of the
application in relation to all the debts and shall cease to have
effect on the date of admission of such application; and

(b) during the interim-moratorium period—
(i) any legal action or proceeding pending in respect of
any debt shall be deemed to have been stayed; and
(ii) the creditors of the debtor shall not initiate any legal
action or proceedings in respect of any debt.”
9. It goes without saying that the said provision shall continue to have
effect in all cases wherever an application under Section 94 or 95 has been
filed.

10. Since we are ceased of the legal issues involved in these petitions, and
we have passed interim orders in at least two of them – being W.P.(C.)
Nos.4849/2020 & 5712/2020, we hope and expect the Tribunal and the IRP
to abide by the said orders and act in terms thereof, in all these cases.

11. Interim orders to continue.

12. We further direct that all the petitioners shall stand restrained, in
respect of their assets in terms of the restraint order passed in W.P.(C.)
No.5712/2020. We direct the parties to exchange the pleadings/ documents
placed on record within three days of the request made by the opposing
counsel.
