DISPOSITIVE PORTION:
It being understood that the penalty imposed upon the appellant is from six months and one
day, to two years, eleven months and eleven days of prision correctional, as maximum, and
eliminating the additional penalty imposed by the court, the appealed judgment is affirmed in
all other respects, with costs. So ordered.

SUMMARY:
 The accused, entered and penetrated the house of the victim through a window, an
opening not intended for entrance or egress, by breaking the wire nettings, and once
inside, took the personal properties of the victim.
 The accused is thrice a recidivist under the provisions of RPC, previously convicted of
theft.
 Facts charged constitute the crime of robbery.
 Recidivism was present in the commission of the crime and is compensated by the plea
of guilty.

FACTS:
 The defendant, Haloot entered and penetrated the house of the victim through a
window, an opening not intended for entrance or egress, by breaking the wire nettings,
and once inside, took some valuable personal belongings of the victim.
 The defendant is thrice a recidivist under the provisions of the Revised Penal Code,
previously convicted of theft.
 The facts charged constitute the crime of robbery. Committed without arms, the value
of property taken not exceeding Php 250.
 The aggravating circumstance of recidivism was present in the commission of the crime
and is compensated by the plea of guilty.
