The background of this petition of is that 2 other connected matters had been filed by the
parties involved. Due to the interse disputes between the members, investigation into the
allegations of fraud was initiated at the instance of one party. The SFIO, upon investigation, has
instituted prosecution.
In the interregnum the parties sorted out their problems and prayed for withdrawal of the
cases filed by them

eeThe Union of India, through the office of SFIO submits that having investigated the matter,they
have found allegations of public money being siphoned off by the respondent company and its
directors as cohnect. They, therefore, resist withdrawal of the present petition
We are unable to appreciate the arguments advanced by the learned counsel appearing for the
SFIO,that this Bench should continue to be seized of this petition. A fraud has been detected by
the department for which prosecution has also been initiated. There is nothing left for this
Bench to adjudicate in this matter. In view of the same this case is being disposed off with
liberty to the department to continue with their prosecution in accordance to Law.
All interim orders stand vacated.
