The obsession of President Joko Widodo (Jokowi) to solve the obesity of regulations has moved

ahead. The government as represented by coordinating minister of economy, Airlangga Hartarto,


Finance Minister Sri Mulyani Indrawati, Manpower Minister Ida Fauziyah, Law and Human Rights
Minister Yasonna Laoly and Agrarian and Spatial Minister Sofyan Djalil has submitted the bundle
consisting (i) presidential letter, (ii) the bill on job creation, and (iii) its academic document to the
House of Representatives (DPR) on wednesday, February 12, 2012.

According to the Article 50 para. (3) Law Number 12 Year 2011 (“Legislation Formation”) regarding
legislation formation, the House of Representatives must start debating the bill at the latest 60 days
as of the presidential letter has been accepted. Furthermore, the Article 141 The House of
Representatives Regulation Number 1 Year 2014 regarding Code of Conduct (“ Code of Conduct”)
rules that the Representatives and the minister representing the president must previously agree on
the schedule of the discussion meeting and the drafting period and submitting the agenda of issues
(daftar inventarisasi masalah). The agenda of issues will be used as the guidance in driving the
discussion of the bill between the government and the House of Representatives.

According to Article 131 para. (2) Code of Conduct, the bill will pass through 2 stages of discussion.
The first stage of discussion will be held in the commission meeting while the second will be held in
the plenary meeting. In the first stage of meeting, the government will explain the bill to the
commission and respond to the submitted the agenda of issues and any raised queries from the
Representatives. In the opposite, Representatives are entitled to respond the explanation of the
government. The first stage will be held 3 times otherwise has been prolonged by the resolution of
the plenary House of Representatives as has been requested by the commission leaders. The result
from the first stage can be in the form of redactional completion directly given to the drafting team
(tim perumus) while if the substance has not been agreed yet, the draft will be debated further in
the working committee meeting (rapat kerja komisi). The public can be invited for the public hearing
meeting during the process of first stage. The first stage will be finished with (i) report of working
committee, (ii) reading the bill, (iii) signing the bill, and (iv) decision-making for further process in the
second stage. In the event the bill fails to be agreed in the working team, the decision-masking will
be set in the plenary meeting. Meanwhile, In the second stage, the bill will be debated in the plenary
session to get agreed or rejected either by mutual consensus or voting in the event mutual
consensus fails to reach. In the event the bill is agreed mutually by the Government and the House
of Representatives, the bill must be submitted to the president to be ratified at the latest 7 days as
of the mutual consensus.
