However, you may not bring in any commercial outlines, hombooks or any other material. 2. Write your examination number on the examination question and tum in your ‘examination question with your answers on them upon completion or expiry of time. 3. Question 1, 20 minutes The city of Richmond passed a law that makes it illegal for anyone who has a pet to work as a taxi driver. James has worked as a bus driver in Richmond for over eleven years. James recently bought a cat. He mentioned it to a co-worker. A week later, he received a letter in the mail that he was fired from the job as a bus driver. James wants to challenge the dismissal. Kindly advise him whether he can prevail Question 2. 40 minutes ‘A recently adopted city ordinance provides the following: Section 1. No household may be occupied by more than two persons under the age of ten. Section 2. The city shall pay a maximum of $150 a month for each child living in the home with a maximum of $300 per household. Asa result of this law, the Marshall family which has four children of whom three are under the age of ten is being evicted from the apartment in which they lived for over nine years. Second, the Marshall’s receive a monthly grant of $300. With their four children, this is not sufficient to meet their basic needs. If the father Mike and two children were to move to a separate apartment, they would be eligible to receive a grant of $300.00 in addition to the $300.00 the mother Mary Marshall would receive by staying with the other two children. The family would now be able to receive a maximum of $600.00 per month. ‘Advise the Marshall’s using the cases we have discussed in class on whether they can challenge the constitutionality of the city ordinance.
