Apa yang dimaksudkan dengan Keselamatan dan Kesihatan Pekerjaan?

Penyediaan persekitaran kerja yang kondusif dan langkah-langkah berjaga-jaga yang berpatutan
unutk mencegah orang yang bekerja daripada tercedera atau mendapat kesan kesihatan akibat
aktiviti kerja yang dijalankan.
Bagaimana cara mengurus keselamatan dan kesihatan di tempat kerja?
Mengurus keselamatan dan kesihatan di tempat kerja agak berbeza dengan mengurus aspek
perniagaan lain. Pengurusan Keselamatan dan Kesihatan Pekerjaan (KKP) memerlukan komitmen
pemunya perniagaan atau majikan untuk melakukan 3 langkah di bawah :
i. Pernyataan Dasar KKP
ii. Perancangan termasuk pelaksanaan HIRARC, latihan, arahan dan audit
iii. Tindakan pembaikan

Apa jenis penyataan dasar yang diperlukan bagi aspek keselamatan dan kesihatan?
Penyataan dasar keselamatan dan kesihatan adalah satu penyataan secara bertulis yang
menyatakan dengan ringkas komitmen berikut :

 Majikan untuk menyediakan keselamatan, kesihatan dan kebajikan kepada pekerja semasa
bekerja melalui peraturan dan prosedur yang ditetapkan.
 Pihak pekerja untuk mematuhi prosedur kerja dan peraturan untuk memastikan keselamatan
diri sendiri.

Ia perlu diletakkan di tempat yang boleh dilihat oleh para pekerja.

Bagaimanakah majikan boleh mengurus aspek keselamatan dan kesihatan tempat kerja
dengan mudah?
Majikan boleh mulakan dengan melakukan aktiviti mengenalpasti hazad/bahaya bagi semua proses
kerja. Selepas itu, majikan perlu melakukan penaksiran bagi setiap risiko yang dikenalpasti
danmengambil tindakan yang sepatutnya untuk mengawal risiko berkenaan. Proses ini dinamakan
HIRARC.

Adakah saya mempunyai kaitan dengan keselamatan dan kesihatan pekerjaan?


Ya. Semua "orang yang sedang bekerja" di dalam sektor Pengilangan; Perlombongan dan
Penguarian; Pembinaan; Pertanian; Perhutanan dan Perikanan; Utiliti; Pengangkutan; Penyimpanan
dan Komunikasi; Perdagangan Borong dan Runcit; Hotel dan Restoran; Kewangan, Insurans, Harta
Tanah dan Perkhidmatan Perniagaan, Perkhidmatan Awam dan Berkanun diliputi oleh Akta
Keselamatan dan Kesihatan Pekerjaan 1994 (Akta 514).
Siapa yang bertanggungjawab untuk memastikan keselamatan dan kesihatan di tempat kerja?
Majikan, pekerja, orang yang bekerja sendiri, perekabentuk, pengilang, pengimport, pembekal loji /
bahan bertanggungjawab mempunyai kewajipan masing-masing untuk memastikan keselamatan dan
kesihatan di tempat kerja terjamin.

Apakah kewajipan majikan ke atas pekerjanya?


Majikan dikehendaki melindungi keselamatan, kesihatan dan kebajikan orang-orang yang bekerja
melalui langkah-langkah berikut:

 Menyediakan dan menyenggara loji dan sistem kerja selamat;


 Menyusun langkah-langkah bagi menjamin keselamatan dan kesihatan dalam penggunaan,
pengendalian, penanganan, penyimpanan dan pengangkutan loji dan bahan;
 Menyediakan maklumat, arahan, latihan dan penyeliaan bagi pekerja baru dan pekerja lama;
 Menyediakan dan menyenggara persekitaran pekerjaan yang selamat tanpa risiko kepada
kesihatan; dan,
 Menyediakan kemudahan bagi kebajikan mereka yang sedang bekerja.

Apa pula kewajipan majikan dan orang yang bekerja sendiri ke atas orang-orang lain yang
berada di tempat kerja selain para pekerja mereka?

 Memastikan orang-orang lain yang berada di kawasan kera tidak terdedah kepada risiko
keselamatan dan kesihatan akibat pengusahaan seperti bahaya jentera / loji. 
  Memberi maklumat berkaitan cara menjalankan pengusahaannya untuk pengetahuan orang-
orang lain selain pekerja yang mungkin terdedah kepada risiko ketika pekerja sedang
bekerja.

Bagaimana tanggungjawab pekerja di tempat kerja?


Setiap pekerja mempunyai kewajipan untuk:

 Memberi perhatian yang munasabah bagi mengelakkan kecederaan kepada diri mereka atau
orang lain semasa menjalankan aktiviti kerja mereka,
 Bekerjasama dengan majikan dan orang lain untuk memenuhi peruntukan undang-undang.

Apakah hak pekerja terhadap majikan dalam aspek keselamatan di tempat kerja?
Pekerja dilindungi daripada didiskriminasi, dicederakan atau diubah kedudukan oleh majikan
sekiranya:

 Membuat sesuatu aduan mengenai keadaan atau perlakuan tidak selamat di tempat kerja,
 Menjadi ahli jawatankuasa keselamatan dan kesihatan,
 Menjalankan tugas sebagai ahli jawatankuasa keselamatan dan kesihatan.

Bilakah masa yang sesuai untuk majikan menubuhkan Jawatankuasa Keselamatan dan
Kesihatan di Tempat Kerja?
 Majikan perlu menubuhkan Jawatankuasa Keselamatan dan Kesihatan di Tempat Kerja
apabila mempunyai 40 orang atau lebih pekerja atau diarahkan oleh Ketua Pengarah JKKP.
Apakah fungsi Jawatankuasa tersebut?
Jawatankuasa Keselamatan dan Kesihatan berfungsi untuk:

 Mengkaji semula langkah-langkah keselamatan dan kesihatan di tempat kerja,


 Menyiasat aduan atau apa-apa perkara yang berkaitan yang dibangkitkan,
 Sentiasa berunding dengan majikan mengenai isu berkaitan keselamatan dan kesihatan di
tempat kerja.

Perlukah majikan melantik Pegawai Keselamatan dan Kesihatan?


 Ya. Majikan yang termasuk di bawah kelas atau jenis industri yang diwartakan di bawah Akta
Keselamatan dan Kesihatan Pekerjaan 1994 mestilah menggaji seorang yang kompeten
untuk bertindak sebagai Pegawai Keselamatan dan Kesihatan.

Apa peranan Pegawai Keselamatan dan Kesihatan?


 Pegawai ini berperanan untuk memastikan pematuhan Akta dan menggalakkan persekitaran
kerja yang selamat dan sihat di tempat kerja.

Apa hukuman yang boleh dikenakan ke atas majikan sekiranya gagal memastikan
keselamatan, kesihatan dan kebajikan pekerja di tempat kerja?
 Majikan yang gagal memastikan keselamatan, kesihatan dan kebajikan pekerjanya adalah
melakukan suatu kesalahan, apabila disabitkan boleh didenda tidak melebihi RM50,000.00
atau penjara tidak melebihi dua tahun atau kedua-duanya sekali.

Bagaimana cara memberitahu tentang kemalangan atau penyakit di tempat kerja?


Majikan mestilah memberitahu pejabat JKKP terdekat mengenai apa-apa kemalangan, kejadian
berbahaya, keracunan pekerjaan atau penyakit pekerjaan yang telah terjadi atau mungkin akan terjadi
di tempat kerja melalui telefon, faks, borang JKKP 6 atau JKKP 7.
