Background

On December 03, 2020 a Notice to Explain was received by Ramel B. Gutierrez (respondent-
employee) informing him for an administrative hearing to be conducted on 8:30 A.M. December
07, 2020.

The Disciplinary Committee

Below are the names of the Disciplinary Committee (DC) who are conducted the administrative
hearing:

The Meeting

On December 07, 2020, 9:30 A.M. at 118 Tandang Sora Ave., Brgy. Tandang Sora, Quezon City,
an administrative hearing on the offenses charged against respondent-employee was
conducted.

The DC explained the grounds for dismissal to the respondent-employee, and the latter
understood the said grounds.

Respondent-employee presented evidence on his behalf, and the DC accepted the evidence.

The DC decided to continually impose preventive suspension on the respondent-employee

given that his continued employment poses imminent danger to the welfare and safety of the
Roqson Insdutrial Sales, Inc. The intention of the DC is to maintain the status quo in the
workplace until the issues have been finally resolved.

It is also discussed in this hearing that the DC shall render a Decision within fifteen (15) days
from the date of this hearing. Notice of the said Decision may be made through registered mail
at the last known address of the respondent-employee in the Company’s records, or by personal
service. Should the respondent-employee refuse to receive the Decision, the contents of the
same shall be read ad explained to him.

Finally, it was explained to the respondent-employee that the Decision of the DC may be
elevated to the President for review and approval before the implementation. The President has
the discretion on whether or not to commute the penalty of termination to a lower penalty.
