Notification for Buyers and Sellers on GeM role in e-
Bidding/Reverse Auction 21.02.2019
• As per GeM GTC, the Buyer has the right to decide the technical
and commercial acceptability of the individual Bid based on
eligibility criteria and compliances as stipulated in the Bid
document.

• Buyer(s) has to evaluate Bid(s) and accordingly technically accept


or reject the Bid(s) on merits.

• There is no role of GeM in Bid evaluation process.


• GeM shall not entertain any representation(s) received from
Bidder(s) on the process of Bid evaluation adopted by the
Buyer(s).

• Buyers are also advised not to seek any opinion on such


representations from GeM.

• Complete Bid document including the GTC, STC & ATC and all the
Bids submitted by the Bidders/Sellers are available with the
Buyer and on the GeM portal.

• Buyer(s) should themselves examine the representation(s) and


take appropriate action(s) as per GFR, GeM GTC, STC and Bid
specific ATCs.

• If any clarification is required with respect to any process of


GeM, which is not already clarified in GeM GTC, STC, ATC and
other guidelines available on GeM portal including FAQs, Buyer
should make specific reference on issue involved and
clarification expected from GeM.

• GeM can not be made a party to examination of Bidder/Seller’s


representations against Buyer's decisions as GeM is neither
audit nor vigilance for Buyer(s).
Delayed payment issues of MSEs to be raised on
MSME-SAMADHAAN

• GeM in collaboration with Ministry of MSME,


shall proactively raise issue of delayed
payments relating to MSEs ( with Udhyog
Aadhaar) on Samadhan Portal
(samadhaan.msme.gov.in) for resolution
under the Micro, Small and Medium
Enterprise Development (MSMED) Act, 2006
Important Notification for all Buyers and Sellers
• Kind attention of Buyers and Sellers is drawn to para 3 ( ix) of GeM
General Terms and conditions. It is reiterated that all transactions
including order placement must be completed online on GeM.
• Any Order placed off line relating to GeM transactions shall be
deemed violative of GFR compliance and shall lead to audit
concerns.
• Further, in some cases, Sellers and Buyers have come together for
offline order placement so as to avoid paying transaction charges.
This shall be treated as an act of causing loss to a Government
entity and all such contracts shall be treated as null and void and
shall invite action accordingly.
• Sellers are advised not to accept any order offline and notify the
same immediately on Incident Management Module of GeM, to
avoid any further action as per GeM Terms & conditions
Usage of Incident Management module instead of
Emails to GeM authorities

• Buyers/Sellers may please note that GeM has a full-


fledged online module available for any incidents to be
reported on issues faced between Buyers and Sellers.

• This module must be used by Buyers and Sellers to


highlight and/or report any incident related to Pre-
Contract and/or Post- Contract phase of procurement
done on GeM (including issues between Seller
organisations regarding products/services listed on GeM)
for timely response/resolution.

• Buyers and Sellers are hereby notified that the Incident
management policy has been revised.

CDN Service on GeM Portal

• This is to notify that Government e-Marketplace has recently


introduced CDN (Content Delivery Network) Service . The intended
bidders shall require to enroll at GeM portal to upload their
offerings for the aforesaid Service. All Buyers who want to procure
CDN Service may now visit the GeM Portal for online buying.

• A content delivery network or content distribution network (CDN) is


a geographically distributed network of proxy servers and their data
centers. The goal is to provide high availability and high
performance by distributing the service spatially relative to end-
users.
GeM implements mobile number based authentication
mechanism for eSign
• Complying to the recent judgment of honorable
Supreme Court of India restricting the use of
Aadhaar, its usage on GeM for the purpose of eSign
has been discontinued and replaced with Mobile
Number and OTP (One Time Password) based
authentication. The OTP based authentication
service is adequate for the purposes of contractual
obligation as per IT Act
Service specific Project Experience filters for eligibility now
available in Bid.

• The Buyers can now use Turnover as well as Service specific


Project Experience as an eligibility criteria for their Bids.

• All the Service Providers were requested to provide relevant


Project Experience in the last 3 years of top 3 value wise
Projects while offering the Services on GeM portal. Failing
which Service Provider's Project Experience will be considered
as NIL. (Notification was issued on 9th August, 2018)
Service specific Project Experience filters for eligibility now
available in Bid.

• Eligibility criteria are as follows :-

• Turnover
Average Turnover should be at least 30% of the estimated cost.

• Project Experience
The bidder must have successfully executed/completed similar services, over the
last three years:

1) Three similar completed services costing not less than the amount equal to 40%
(Forty per cent) of the estimated cost; or

2) Two similar completed services costing not less than the amount equal to 50%
(Fifty per cent) of the estimated cost; or

3) One similar completed service costing not less than the amount equal to 80%
(Eighty per cent) of the estimated cost.
