Subject: Information Bulletin for NEET-MDS 2021 - Regarding

Pursuant to the directions from the Ministry of Health and Family Welfare, Govt.
of India, attention of all concerned is invited to the following:

1. The National Board of Examinations issued the Information Bulletin for NEET
(MDS) –2021 on 26th October, 2020. Under Clause 10.11, it is mentioned that
the OBC reservation at 27% shall be applicable only in Central Government
Institutions/Central Universities (for Non-creamy layer and as per Central list of
OBC).

2. The Hon’ble High Court of Madras vide Order dated 27.07.2020 in WP No. 8324
of 2020 directed that a Committee comprising the representatives of Directorate
General of Health Services, Government of Tamil Nadu, Medical Council of
India and Dental Council of India be constituted for providing the terms of
implementation of reservation in AIQ for next academic session.

3. The Committee constituted in pursuance of the directions of the Hon’ble High


Court of Madras has submitted its report to the Central Government. After
considering the report, the Central Government has decided to place the same
before the Hon’ble Supreme Court (wherein a Writ Petition No. 596/2015 titled
Saloni Kumari & Anr. Vs. DGHS regarding 27% reservation in favour of
candidates belonging to OBCs in All India Quota Seats is pending) for decision.

4. Therefore, it is brought to the notice of all concerned that reservation to OBC


candidates in State surrendered seats under All India Quota from the academic
session 2021-22 will be subject to outcome of the case pending before the
Hon’ble Supreme Court in Writ Petition No. 596 of 2015 / any decision taken by
the Central Government in this regard.
