Dear Sir, As you are aware, the Ministry of Industries and Commerce , Government of india, is very’ keen for development of the Special Economic Zones in the country. The SEZ Policy has also been announced by the Government of India. The. Ministry of Commerce and Industries, vide their D.O, letier No; F.2(1)/4/2001-EPZ dated 17-10- 2001 hag asked the State Government to announce the’ liberalized policy on various issues including the generation and distribution of power and environment related” clearances to boost the investor's confidence in the SEZ Poticy. : 1 understand that it is under consideration to delegate: the powers for ‘granting tlic environmental clearances to the Development Commissioner of the SEZ or the Committee Constituted under the Chairmanship of the Development Commissioner With the representatives fidin th Minisiy of Environment and Forests, State Potiution Control Board and the State Government, for the projects coming up within the designated*Boundary of the SEZ. As per the existing provisions of the CRZNotification and the procedure devised for its effective implementation, the powers for according the clearance under the CRZ Nouiieation, 1991 for any project having the project cost exceeding Rs. 5.0 crores are vested with the Ministry of Environment and Forests and the projects (exept the tourism) with costs less than Rs. 5.0 crores are being cleared by the State Governments. Morsover, the Ministry of Environment and Forests enjoys wigh’ the powers for anung the enviromental clearaices for the*projects falling in the schedule 1 of the Er ett aay 180)Environment Impact Assessment Notification, 1994 (as amended in 1997), However, some powers for according the environmental clearance to some types*Power projects (as per the 1997 amendment) are also vested with the State Governments, | Iv is therefore necessary that the Ministy of Environment and Forests, GOl, issues an | order for delegation of these powers either to the Development Comunissioner of the (SEZ or the committee constituted under his chairmanship Moreover, under the provisions of the Forests Conservation Act, powers for according approval for the proposals involving diversion of the forestland upto 5.0 li. for non- forest uses are vested with the Ministry of Environment and Forests's regional office at Bhopal and rest with the MoEF, New Delhi. ‘4 Such powers may also be delegated to the Development Commissioners of the SEZ or the Committee Constituted under his Chainmanship and necessary administrative mechanism be devised at the earliest z With regards, Yours sincerely, Reet P. <.
