PETITION

COMES NOW, Petitioner _______, represented herein by his

mother, _______, through the undersigned counsel, unto this Honorable
Court, most respectfully states that:

1. Petitioner _______ (“_______”) is a minor child, Filipino citizen, and a

resident of _______. Petitioner is represented herein by his biological
mother, _______, who is of legal age, married, Filipino, and a resident
of _______.

1.1.Petitioner may be served with orders, notices and processes

through the undersigned counsel, with address at _______.

2. Respondent Local Civil Registrar of the City of San Fernando,

Pampanga is hereby impleaded in its official capacity as the officer of
the government charged with the registration of acts, events and
judicial decrees concerning the civil status of persons in the City of

San Fernando, Pampanga, and who holds office at A. Consunji St.,

Sto. Rosario, City of San Fernando, Pampanga.

3. Respondent National Statistician and Civil Registrar-General of the

Philippine Statistics Authority is hereby impleaded in its official
capacity as the central statistical authority on primary data collection
in the Philippines, and who holds office at CVEA Bldg., East Avenue,
Diliman, Quezon City 1101.

4. Petitioner was born on _______in the City of San Fernando,

Pampanga to spouses _______ (“_______”), a Filipino citizen, and
______________ (“_______”), a Swiss citizen. A copy of Petitioner’s
Certificate of Live Birth, registered with the Local Civil Registry of
the City of San Fernando, Pampanga under Registry No. _______, is
attached herewith as ANNEX “A.”

5. _______recently discovered that under Entry No. 15 in the Certificate

of Live Birth of her son, herein Petitioner _______, due to oversight,
the citizenship of _______was erroneously and mistakenly entered
therein as “Filipino” when it should have been “Swiss,” the latter
being _______true and correct citizenship. The said citizenship, under
Entry No. 15 of the Certificate of Live Birth, is bracketed and marked
herewith as ANNEX “A-1.”

6. To prove that Petitioner’s father, _______, true and correct citizenship

is Swiss, the following documentary evidence are issued wherein the
correct citizenship is indicated, to wit:

6.1.Alien Certificate of Registration Identification Card issued by

the Bureau of Immigration on _______, a copy of which is attached
herewith as ANNEX “B;”

6.2.Certificate of Marriage between _______and _______issued by the

Office of the Civil Registrar General, a copy of which is attached
herewith as ANNEX “C;”

6.3.Certification issued by the Office of the City Civil Registrar of the

City of Angeles on _______, certifying that _______, a Swiss
citizen, has legal capacity to marry; as well as the Certificate of
Capacity to Marry attached to the said Certification, issued by the
Embassy of Switzerland in Manila. Copies of the Certification and
its attached Certificate of Capacity to Marry, are attached
herewith as ANNEXES “D” and “D-1,” respectively.

7. To straighten the record of birth of the Petitioner and in order to

avoid confusion and misidentification, it is necessary that the

reported entry of the citizenship of Petitioner’s father be correctly

reported as Swiss and not Filipino.

8. The filing of this petition should and would not, in any way, affect or
prejudice the interest of the State or other natural or juridical persons;

PRAYER

WHEREFORE, Petitioner respectfully prays that after due notice,

publication and hearing, judgment be rendered ordering the Local Civil
Registrar of the City of San Fernando, Pampanga to correct Entry No. 15.
recorded in the certificate of live birth of the petitioner by amending or
correcting the citizenship of his father from “Filipino” to “Swiss.”

the factual allegations herein have evidentiary support or, if specifically so
identified, will likewise have evidentiary support after a reasonable
opportunity for discovery; and

3. I hereby certify that I have not theretofore commenced any action

or filed any claim involving the same issues in any court, tribunal or quasi-
judicial agency and, to the best of my knowledge, no such other action or
claim is pending therein. If I should thereafter learn that the same or similar
action or claim has been filed or is pending, I hereby undertake to report the
fact within five (5) days therefrom to this Honorable Court where the original
pleading and sworn certification has been filed.
