Dear Sir,

Reference above and other communications we wish to humbly submit as under.

1. It has been communicated to the Contractor by GM(P), NHIDCL to deposit money as per the
NHIDCL-HO approved estimate to Public Health Engineering Department and Power & Electricity
Department for shifting of the respective utilities for the instant project which will be reimbursed by
NHIDCL to the Contractor on production of invoice.

2. However after carrying out a meeting with the representatives of the Authority’s Engineer and the
Contractor on 17.03.2020, it was conveyed by the Superintending Engineer (P&E), Lunglei Power
Circle, vide his letter, bearing memo no. L.12011/1/16-SE(LPC)/T/61 dated 17.03.2020 (copy
enclosed), that an estimate will be prepared based on joint inspection and upon approval of
Superintending Engineer (P&E), Lunglei Power Circle, the payment is to be made by NHIDCL to
Executive Engineer, Power Maintenance Division-II, Lunglei to commence shifting work of utilities.
However the Contractor is yet to receive the final estimate.

3. On one hand the Contractor is being persistently asked to deposit money to the utility owning
department, whereas on the other hand the utility owning department is requesting NHIDCL to
deposit requisite money, which is creating dispute. Moreover we have not been provided with the
information of payee details, mode of payment, payment terms and conditions to proceed further.
4. Sir, we are obliged to obey the Contract Agreement, where Clause 9.2 clearly states that “The
Contractor shall, in accordance with Applicable Laws and with assistance of the Authority, cause
shifting of any utility”. Here the Contractor has been allowed to act as a facilitator only and under the
applicable laws the Contractor is not permitted to enter into a legal financial transaction with any
other agency under this Contract Agreement unless a separate agreement/order relevant to matter is
executed/issued with/to the Contractor.

5. In spite of repeated follow up and requests the issue of utility shifting is not getting resolved and the
project work might get delayed unwarrantedly for the reasons not attributed to the Contractor.

6. In view of above we request your kind intervention and support so that the shifting work of utility
gets started and the project corridor is made free of obstructing utilities without further delay.
