COUNTER-AFFIDAVIT

I, RODEL S. PRUDENCIANO, of legal age, single, Filipino citizen

and residing at Centro, Amulung, Cagayan after first having been duly
sworn to in accordance with law depose and say:

1. I am one of the respondents charged with homicide before the

Office of the Provincial Prosecutor of Cagayan in a case docketed
as NPS II-02-INQ-15E-00048;

2. The charge for homicide stems from the unfortunate event that
happened in the evening of May 8, 2015 at Centro, Amulung,
Cagayan;

3. I would remain respectful to the complainant and members of

their family to whom I sympathize due to the death of their loved
one. However, I would say with good conscience that I have
nothing to do with the untimely demise of ROGELIO BILAG, SR.;

4. The incident may be narrated as follows:

a. I was on my way to look for my son when I chanced upon my

mother LETICIA PRUDENCIANO and my sister ROSHELL
ANN PRUDENCIANO being molested by Rogelio Bilag, Sr. in
front of the house of ADRIANO DUMBRIQUE at Centro,
Amulung, Cagayan about 7:30 o’clock in the evening of May
8, 2015;

b. At that time and place, I witnessed how Rogelio Bilag, Sr.

shout at my mother and sister while being pacified by Adriano
Dumbrique. Rogelio Bilag, Sr. was apparently looking for
trouble and appeared tipsy;

c. All of a sudden, Rogelio Bilag, Sr. threw a bottle of

“Emperador Light” at my sister Roshell; he also threw a plate
containing “pulutan” with fork at my mother Leticia. I was
compelled to intervene to pacify Rogelio Bilag, Sr. and to
protect my beleaguered mother and sister who were then
shouting for help;

d. Instead of stopping, Rogelio Bilag, Sr. turned his aggression

at me that is why I picked a stick and whipped it twice at the
back of the body of Rogelio Bilag, Sr. as a matter of defensive
reaction. For his part, Adriano Dumbrique also joined in
pacifying and in the process he boxed Rogelio Bilag, Sr. at his
forehead. Rogelio Bilag, Sr. persisted to continue with his
aggression by trying to carry a chair but it was unfortunate
 he was outbalanced so he fell on the ground with his head
hitting the concrete pavement;

e. At about 8:30 o’clock in the evening of May 8, 2015, police

officers from the police station of Amulung fetched Rogelio
Bilag, Sr. at the house of Adriano Dumbrique. It was by
reason of the commotion that I went out of our house together
with my mother and my sister and proceeded at once at the
house of Adriano Dumbrique where I have learned that
Rogelio Bilag, Sr. also got into trouble with some other
persons whom he provoked and challenged;

f. Rogelio Bilag, Sr. was carried into the PNP patrol car. Adriano
Dumbrique was also tagged along in going to the Rural Health
Unit of Amulung with Adriano Dumbrique assisting in the
carrying of the body of Rogelio Bilag, Sr.;

g. Rogelio Bilag, Sr. was thereafter brought to the Cagayan

Valley Medical Center (CVMC) at Carig, Tuguegarao City,
Cagayan at about 11:00 o’clock in the evening of May 8, 2015
who was pronounced dead upon his arrival thereat;

5. I therefore request and plead that my responsibility must be

weighed and gathered from the foregoing narration of facts to be
able to determine whether I have a hand and liability arising
from the death of Rogelio Bilag, Sr.; and

6. I have executed this affidavit freely, voluntarily and intelligently

to offer an answer to the charge levelled against me in
compliance with the order of Assistant Provincial Prosecutor
Alona A. Luyun of the Office of the Provincial Prosecutor of
Cagayan.

IN WITNESS WHEREOF, I have hereunto set forth my hand this
