Conditions Of Sale
1) The price quoted shall be valid for 24 hours
2) Notwithstanding the above, and for the avoidance of doubt it is hereby confirmed by both parties that the quoted price is an indicative price for the customer’s budgeting purposes,
and not the final price for the product
3) The customer hereby confirms, by its acceptance of this quotation, that the final price of the products shall be the price payable as at the date of delivery by Engen Zimbabwe in
accordance with the regulated price, as confirmed by the government of Zimbabwe, in effect for all required products, on the date of delivery of the products by Engen Zimbabwe to the
customer

4) The Customer hereby undertakes to make such additional payment, being a top up payment, to Engen Zimbabwe, in order to maintain the ordered quantity of products, in event of
a regulated price increase as at time of delivery, failing which payment, the customer hereby authorizes Engen Zimbabwe to adjust the ordered quantity such that the value of the
supplied/delivered product remains equivalent to the original order value following adjustment for the new prices as at the delivery date

5) The Customer further authorizes Engen Zimbabwe to issue a credit note, in favour of the customer, in the event that the regulated price is adjusted downwards such that the
product price as at date of delivery, is lower than the product price as at date of order confirmation and payment by the Customer

6) Due delivery of the liquid petroleum products by Engen Zimbabwe shall be duly effected at the moment the product passes from Engen's delivery truck into the storage tanks or at
point of collection.

7) The Customer confirms its understanding that it may be called upon to make extra payments to cover increases in statutory payments as promulgated.

8) Supply is subject to Engen Zimbabwe’s Force Majeure conditions including industrial action and sanctions as contained in the Main Agreement, or as espoused in the common law
of Zimbabwe.

9) Engen Petroleum Zimbabwe will not be held liable for any Government directive or new rule of law within the industry, which event shall be considered a Force Majeure event.
