Customer understands and agrees that in any dispute arising out of the issuance of
replacement bills, it shall have the burden of proof to show that it complied with APL’s
instructions. The Customer shall indemnify APL fully from all and any liability which may arise as
a result of the Customer’s failure to destroy the previous original bills of lading.

I am authorized to make this certification on behalf of Customer and declare the foregoing to be
true and correct.

I confirm that all previous original bills of lading will have been destroyed prior to receipt of the
replacement set.
