Re: Flora Mendoza Acquisition of Shares

The view of the heirs for a long time is to sell the property. I proposed to Mr. and
Mrs. Gaudencio Venturina that the title be deposited in a bank and the cost will be
borne by Mrs. Lourdes Fernandez, who has been paying the realty taxes ever since, but
this was not done.
In 1998, the custody over the title was entrusted by Mr. and Mrs. Gaudencio
Venturina and Flora Mendoza Venturina to Mrs. Lourdes Fernandez, who took the
responsibility of paying the realty taxes. Mrs. Fernandez had the title annotated in her
favor to ensure the property will not be sold by any one group without her knowledge.
Since the heirs were trying to sell the property, and there were serious offers.
Mrs. Fernandez was convinced to have the annotation removed because there was a
serious buyer. She agreed and lost the custody of the title because the family, through
Mrs. Pat Mendoza, did not return the title anymore to Mrs. Fernandez.
In 2017, Mrs. Pat Mendoza came to Mrs. Fernandez’ house because she was
being forced by the family to give the title to one group in the family. Also, the taxes
have accumulated. Mrs. Fernandez paid the title’s taxes again and kept the title.
For fear that the property will be sold without her knowledge, Mrs. Fernandez is
proposing to Mrs. Pat Mendoza to prepare an agreement of undertaking. And then the
title will be deposited in the bank so no one family will hold the title and when needed,
Mrs. Pat and Mrs. Fernandez will just get it.
Since the family accepts that, Mrs. Fernandez has an interest over Ten Thousand
(10,000) square meters in the said property. Mrs. Fernandez proposes that her share
be separated at her expense.
Mrs. Fernandez hereby proposes that the parties concerned meet and resolve
the matter amicably since she is willing to surrender custody over the said title.
