1. PPRROOJJEECCTT CCLLEEAARRAANNCCEESS
A. ENVIRONMENT CLEARANCES FROM MOEF
As per MoEF’s EIA Notification 2006 and subsequent amendments, the proposed project falls as category-A. Environmental
Clearance is to obtained from Ministry of Environment and Forests (MoE&F), New Delhi. NHAI had submitted application for
prior environmental clearance to MoEF, New Delhi vide letter no 11013/1/2k/GM(Env)/84 dated 25.08.2010. Further, LASA
has presented the project before Expert Appraisal Committee (EAC) on 21st October 2010 and MoE&F had issued Terms of
Reference (TOR) for preparation of Draft EIA report and conducting Public Hearing in the project districts.

Draft EIA report had been prepared and submitted to NHAI, PIU-Bhopal. Subsequently, PIU-Bhopal had forwarded
necessary documents (Draft EIA, RAP, Summary of Project Report, Summary of EIA in English and Hindi) to Regional
Office (R O) of Madhya Pradesh Pollution Control Board (MPPCB) vide letter no 690 dated 30 Nov 2010 for conducting
Public Hearing.

RO, MPPCB had conducted Public Hearing in four project districts namely Sehore District on 6th May 2011, Raisen District
07 May 2011, Hoshangabad district on 09th May 2011 and Betul district on 19th May 2011. Consultant presented the project
before the general public and provided technical clarification during public hearing. The proceedings of the public hearing is
to be forwarded by the MPPCB to the MoE&F New Delhi. The proceedings of the Public Hearings are enclosed as
Annexure-6.1 of Volume IV (EIA Report) for Raisen, Sehore and Hoshangabad districts.

The application for Environmental Clearance has been submitted to Ministry of Environment and Forests vide letter no
11013/1/2k/GM(Env)/96 dated 13.07.2021. The project was considered by the Expert Appraisal Committee on 17th August
2012 at 115th meeting. The project was presented before the expert appraisal committee and EAC has recommended the
project for Environment Clearance. The minutes are available at www.moef.nic.in.

B. FOREST CLEARANCE AND WILDLIFE CLEARANCE


Project road passes through 4 forest divisions namely Obedullaganj, Sehore, Hoshangabad and North Betul.

B.1. Wildlife Clearance (Obedullaganj Forest Division)

Project road passes through Ratapani Sanctuary in Obedullaganj Forest Division (T) for 12.44 km. Application for in-
principal approval of the Supreme Court had been submitted to Obedullaganj Forest Division vide letter no 445 on 17th Sept
2011 and the file has been processed by the Forest Department and Madhya Pradesh State Government has forwarded the
file to National Wild Life Board in April 2011 for their approval and onward submission to the Supreme Court.

The application was considered 23rd meeting of the National Board of Wildlife, MoEF, New Delhi on 14th Oct 2011. The
Committee decided that Ms. Prerna Bindra along with one NTCA member would conduct a site inspection, and submit a
joint report to the Standing Committee of NBWL for consideration in its next meeting.

Ms Prerna Bindra along with her team visited the site on 29th Nov 2011, subsequently NHAI has submitted revised data to
DFO Obedullaganj and subsequently PCCF (WL), has forwarded the revised data along with his comments to Dy Inspector
General, MoEF New Delhi vide letter no 1291 dated 07.02.2012. Presently, the application is at National Board for Wildlife,
MoEF, New Delhi for their consideration.

B.2. Forest Clearance

B.2.1. Sehore Forest Division

PIU-Bhopal had submitted draft application for diversion of forest land to Sehore Forest Divsioin in Oct 2010. Subsequently,
enumeration of affected trees in forest land was completed and area proposed to be diverted due to the project in this

Division was confirmed. Final Application for Diversion of Forest Land was submitted by NHAI vide letter no 1161 dated
14.04.2011 to Regional Nodal Officer, Bhopal Circle, Forest Department, MP. The application was returned by Regional
Nodal Officer with comments on lack of District Collector’s Certificate regarding distribution of forest rights in the affected
forest land as per provision of Forest Right Act 2006 and No Objection Certificate (NOC) from the Gram Shava of the
affected village through which project road passes in forest area.

NHAI resubmitted the application and DFO, Sehore Forest Division has forwarded complete file in five set to CCF,
Bhopal vide letter no 1738 dated 26.06.2012, for 21.5865 ha including 1.999 ha revenue forests, along with Compensatory
Afforestation Plan. File has been registered at the office of CCF, Bhopal vide registration no BHOPAL/SHR/RD/2012-03
dated 28.06.2012.

B.2.2. Hoshangabad Forest Division

PIU-Bhopal had submitted draft application for diversion of forest land to Hoshangabad Forest Division in Sept 2010.
Subsequently, enumeration of affected trees in forest land was completed and area proposed to be affected due to the
project in this Division was completed in March 2011. PIU-Betul has requested Dist Collector, Hoshangabd for issuing
necessary Certificate regarding distribution of forest rights in the affected forest land as per provision of Forest Right Act
2006. No Objection Certificate (NOC) is also to be obtained from the Gram Shavas of the affected village through which
project road passes in forest area.

District Collector, Hoshangabad has forwarded to Tribal Welfare Department, District Collectorate, Hoshanabad for
necessary action. NOC formats were provided to the concerned Gram Shavas. Those Gram Shavas were followed up for a
number of times and collection of NOCs from the Gram Shava is in progress. Gram Shavas have reluctance in issuing
NOCs as per proforma. As soon as District Collector’s Certificate and NOC of the concerned Gram Shavas are obtained, we
shall be able to submit the application for diversion forest land in Hoshangabd Division.

CCF, Hoshangabad has registerd file vide registration no 07/HBad/MIS/2012-02, for 58.7625 ha forest including 21.033
ha revenue forest, dated 20/04/2012 and forwarded to CCF, Bhopal, Bhopal Circle, who is nodal officer for the project, vide
letter no 2744 dated 23.04.2012.

B.2.3. North Betul Forest Division

PIU-Bhopal had submitted draft application for diversion of forest land to North Betul Forest Divsioin in Sept 2010.
Subsequently, enumeration of affected trees in forest land was completed and area proposed to be diverted due to the
project in this Division was completed in March 2011. PIU-Betul has requested Dist Collector, Betul for issuing necessary
Certificate regarding distribution of forest rights in the affected forest land as per provision of Forest Right Act 2006 vide
letter no 051 dated 01.10.2010. No Objection Certificate (NOC) is also to be obtained from the Gram Shavas of the affected
village through which project road passes in forest area.

District Collector, Betul has written to DFO, North Betul, Sub-Divisional Magistrate (Revenu), Shahpur and Tribal Welfare
Department for necessary action. SDM, Shahpur has requested to DFO, North Betul for necessary action. But, no action
has been taken yet.

NOC regarding Forest Right Act 2006 from Neempani village could not be obtained yet, though several attempt were made
by Consultant and NHAI, PIU-Betul. Collector’s Certificate regarding distribution of forest rights for the forest dwellers under
Forest Right Act 2006 could not be obtained yet because NOC of the Gram Shava is a prerequisite for issuing such
certificate. However, NOC has been obtained all other applicable village.

CCF, Betul has registered the application vide registration 21/NBT/Road/2011 dated 22.10.2011 for 73.1922 ha forests
including 17.516 ha revenue forests. CCF Betul has forwarded the complete file to CCF-Bhopal vide letter no
DM/164/12/1184 dated 01.06.2012.

B.3. WL clearance for Forest Areas within 10 km radius of WL Sanctuary.

B.3.1. 10 km radius of the Ratapani Sanctuary

NHAI, PIU-Bhopal has submitted application to CCF-Bhopal for obtaining approval from National Board for Wildlife, MoEF,
New Delhi vide letter no 2517 dated 30.04.2012. CCF Bhopal has forwarded the application to DFO Sehore vide letter no
4505 dated 08/05/2012. DFO Sehore has forwarded the application to DFO, Obedullaganj vide letter no 8420 dated
29.09.2012. DFO Obedullaganj has returned the application with comments vide letter no 2894 dated 26.09.2012.

B.3.2. 10 km radius of the Bori Sanctuary

NHAI, PIU-Betul has submitted application to Field Director, Satpura Tiger Reserve for obtaining approval from National
Board for Wildlife, MoEF, New Delhi vide letter no 954 dated 28.08.2012. Field Director, STR has completed his process
and forwarded the application to PCCF(WL) vide letter no 4637 dated 18/09/2012 for further action at his end.

C. LAND ACQUISITION
Total number of village is 59 through which project road passes. Out of total, 3A Gazette Notification has been completed
for all the villages by PIU-Betul & PIU-Bhopal. Only 3D of 51 ha is remaining to be notified for which 3A Gazette notification
complete and filed work is in progress. Total requirement of land for the project is 732 ha. Out of 732 ha, NHAI has
possession of about 181 ha. Total revenue land (Govt. and private) required for the project is about 460 including 40.5 ha
revenue land.

E. ROB/RUB
There are 3 ROBs and a Box culvert under existing RUB in the proposed alignment. All the General arrangement drawings
were submitted in the railway division. ROB at Itarsi bypass is approved by Railway. Regarding other 2 ROB and 1 Box
culvert under RUB, the site visit has already been done with the railways and revised GA drawings are resubmitted to the
railways.

F. IRRIGATION STRUCTURE
The GA drawings of affected irrigation structures are already submitted to respective irrigation division. Subsequent to that
site visit carried out. Based on site visit and comments revised drawings resubmitted for approval and they are approved by
the respective authority.
