WHEREAS, Republic Act No. 10632 entitled “AN ACT TO
POSTPONE THE SANGGUNIANG KABATAAN ELECTIONS ON OCTOBER
28, 2013, AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 9340,
AND FOR OTHER PURPOSES’, postponed the conduct of the October 28,
2013 SK Elections to a date to be determined by the COMELEC between
October 28, 2014 and February 23, 2015;
WHEREAS, on October 08, 2013, the Commission issued.
Resolution No. 9791 entitled “IN THE MATTER OF THE INITIAL
IMPLEMENTATION OF REPUBLIC ACT NO 10632 POSTPONING THE
OCTOBER 28, 2013 SANGGUNIANG KABATAAN (SK) ELECTIONS";
WHEREAS, under Resolution No. 9905 (IN THE MATTER OF
PROVIDING THE CALENDAR OF ACTIVITIES AND PERIODS OF
CERTAIN PROHIBITED ACTS AND ADOPTING PERTINENT
RESOLUTIONS PROMULGATED FOR THE 28 OCTOBER 2013
BARANGAY ELECTIONS FOR PURPOSES OF THE 21 FEBRUARY 2015
SPECIAL SANGGUNIANG KABATAAN (SK) ELECTIONS), promulgated
October 21, 2014, set the conduct of the SK Elections on February 21,
2015;
WHEREAS, because of the impending passage into law of HOUSE
BILL NO. 5006 entitled “AN ACT TO POSTPONE THE SK ELECTIONS
ON FEBRUARY 21, 2015", which was adopted by the Senate of the
Philippines en toto, the Commission has slowed down its procurement
proceedings and as a result thereof essential supplies to be utilized in the
forthcoming SK Elections were put on hold to minimize expenses and.

avoid unnecessary wastage of resources should the law postponing the
SK clections be finally passed;
WHEREAS, Section 5, Batas Pambansa Bilang 881 (The Omnibus
Election Code), provides:
“Sec. 5. Postponement of election. - When for any serious
cause such as violence, terrorism, loss or destruction of election
paraphernalia or records, force majeure, and other analogous
causes of such a nature that the holding of a free, orderly and
honest election should become impossible in any political
subdivision, the Commission, motu proprio or upon a verified
petition by any interested party, and after due notice and
hearing, whereby all interested parties are afforded _equal
opportunity to be heard, shall postpone the election therein to a
date which should be reasonably close to the date of the
election not held, suspended or which resulted in @ failure to
elect but not later than thirty days after the cessation of the
cause for such postponement or suspension of the election or
failure to elect."(Underscoring ours)
WHEREAS, the non-procurement of essential election supplies is
an analogous cause of such nature that the holding of a free, orderly and
honest election is now impossible;
WHEREAS, the same Section 5, BP. Blg. 881 provides that the
Commission shall postpone the election to a date which should be
reasonably close to the date of the election not held or suspended but not
later than thirty (30) days after the cessation of the cause for such
postponement or suspension of the election;
WHEREAS, taking into consideration the period of time needed to
procure the supplies and conclude some preparatory activities, the
‘Commission hereby sets the SK Elections on April 25, 2015;
NOW, THEREFORE, the Commission pursuant to the powers
vested in it by the Constitution, the Omnibus Election Code, and other
related election laws, RESOLVED, as it hereby RESOLVES, to
POSTPONE the February 21, 2015 SK Elections to April 25, 2015, and
ADJUST accordingly the CALENDAR OF ACTIVITIES AND PERIODS
OF CERTAIN PROHIBITED ACTS, as fully detailed in Resolution No.

Education and Information Department shall cause the publication of
this Resolution in two (2) daily newspapers of general circulation in the
Philippines.
This Resolution is effective immediately after publication.
