Enumerate the lawyer’s responsibility to the society. Give specific examples in each of
these responsibilities. Present your answers in a table.
Lawyer’s Responsibility to the Society
A lawyer shall not engage in an immoral
conduct.
A lawyer shall not do or permit to be done
any act designed primarily to solicit legal
business.
A lawyer shall not use or permit the use of
any false, fraudulent, misleading, deceptive,
undignified, self-laudatory or unfair
statement or claim regarding his
qualifications or legal services.
Where a partner accepts public office, he shall
withdrawal from the firm and his name shall
be dropped from the firm name unless the
law allows him to practice law currently.
Example
In the case of AMALIA R. CENIZA vs ATTY.
ELISEO B. CENIZA, JR. A.C. No. 8335 where
the respondent an attorney abandoned his
legitimate family in order to cohabit with a
married woman constitutes gross immorality
that warrants his disbarment.
In the case of ATTY. ISMAEL G. KHAN, JR.
vs. ATTY. RIZALINO T. SIMBILLO, A.C. No.
5299, August 19, 2003 where the respondent
was guilty of improper advertising and
solicitation of legal services. Where the
respondent advertise in some column of
manila bulletin, Philippines star and
Philippine daily Inquirer that the latter was
an expert in annulment cases which is
prohibited in code of ethics.
The example of this is when a lawyer wins a
senatorial election. The law prohibits a
senator to engage in the practice of law in
order to have no conflict of interest on the
cases on which will be handle by his firm.
