Pike cy fives) g\ : a iesPAS Aan ae 5 lala cl gall (1) In the enquired situation, if the government eremates the bodies such that all or most of the body is turned to ash, then in such an instance, the relatives of the deceased will not offer the Janazah prayers. The validity of the Janazah prayers are preconditioned on at least half the body of the deceased remaining. Therefore, in this situation, whatever parts of the body are left are to be wrapped in a cloth and buried, However, if most of the body, with or without the head, was not burned or half the body with the head was not burned or the whole body was bumned, but only to such an extent that the flesh and meat of the body is still intact, then this body is to be bathed. The Janazah prayers are to be offered and the body is to be buried. (2) It should be noted that it is obligatory to bathe the deceased and failure to fulfill this obligation without a valid excuse is not permissible. Therefore, in the enquired situation, if the government returns the body of the deceased to its kin wrapped in plastic or polythene the opening of which is deemed illegal by the government and disobeying will certainly or presumably lead to prosecution, then yor may resort to the following alternatives, respectively: a. If the hospital staff has the necessary equipment for wrapping the body in plastic or polythene, then they should be requested to shower the body before handing it over to the deceased’s kin. If they refuse to do so, then: b. The body should be washed with a shower or hose with the clothes on. And if there is fear of the illness spreading even in this method, then: ¢. The body should be washed from on top of the plastic polythene wrapping. It is an obligation to bathe the deceased and is the right of the deceased on the living Such a right and obligation is not absolved from fear of the illness spreading.
