Facts
• On Feb 24, 2006 the nation celebrated the 20th Anniversary of the EDSA People Power
I, Pres. Arroyo issued PP1017 declaring a state of national emergency:
o ... and in my capacity as their Commander-in-Chief, do hereby command the
AFP, to maintain law and order throughout the PH, prevent or suppress all forms
of lawless violence as well as any act of insurrection or rebellion and to enforce
obedience to all the laws and to all decrees, orders and regulations promulgated
by me personally or upon my direction; and as provided in Section 17, Article 12
of the Constitution do hereby declare a State of National Emergency.
o Cited the following facts as bases
Political opposition have conspired with authoritarians of the extreme Left
represented by the NDF-CPP-NPA and the extreme Right, represented by
military adventurists— the historical enemies of the democratic Philippine
State
Conspirators have repeatedly tried to bring down the Pres.
these actions, hinder the growth of the economy and sabotage the people's
confidence in the government and their faith in the future of this country;
actions are adversely affecting the economy
these activities give totalitarian forces of both the extreme Left and Right
the opening to intensify their avowed aims to bring down the democratic
Philippine State
o On the same day, she issued G.O. No. 5 implementing PP 1017, thus:
... I hereby direct the Chief of Staff of the AFP and the Chief of the PNP
as well as the officers and men of the AFP and PNP, to immediately
carry out the necessary and appropriate actions and measures to
suppress and prevent acts of terrorism and lawless violence.
o During the hearing, the Solicitor General argued that the issuance of PP 1017 and
GO 5 have factual basis, and contended that the intent of the Constitution is to
give full discretionary powers to the President in determining the necessity of
calling out the armed forces. The petitioners did not contend the facts stated b the
Solicitor General. Such as:

o Group of protesters (members of Kilusang Mayo Uno [KMU] and National
Federation of Labor Unions-Kilusang Mayo Uno [NAFLU-KMU]), still went to
EDSA Shrine.
o They were interrupted by the police and they were made to disperse by the Police.
However, police arrested (without warrant) Randolf S. David (petitioner) and
Ronald Llamas (president of party list)
o On Feb 25, 2006 operatives of the Criminal Investigation and Detection Group
(CIDG) of the PNP, raided the Daily Tribune offices in MNL, and were able to
confiscate news stories, documents, pictures, and mock-ups of the Saturday issue.
o The Police surrounded the premises of another pro-opposition paper, Malaya, and
the tabloid Abante.
o Preisdential Chief of Staff Michael Defensor stated that the raid is:
"meant to show a 'strong presence,' to tell media outlets not to connive or
do anything that would help the rebels in bringing down this gov't"
PNP warned that it would take over any media organization that would not
follow the standards set by the government.
National Telecommunications' Commissioner Ronald Solis urged TV and
radio networks to "cooperate" with the government for the duration of the
state of national emergency and asked for "balanced reporting."
o Several influential people were arrested as well without warrant.
o This led to 7 petitions challenging the constitutionality of PP 1017 and G.O. No. 5
were filed.
