Infra-19-05 BAC Resolution Recommending Use of Negotiated Procurement ~ Adjacent or Contiguous and Award of Contract to ‘Molina’s General Builders forthe Additional Improvement Works atthe BPK Building WHEREAS, the Philippine Council for Agicuiture, Aquatic and Natural Resources Research and Development (PCARRD) through ts Bids and Awards Commitee conducted the competitive bidding forthe project ‘Rehabilitation and improvement. of Bulwagang Panday Karunungan (BPK) Building” on October 2, 2018 and recommended the award of contract to Malina’s General Buiders as the bidder wth the single calculated responsive bid which was approved by the Head of the Procuring Entiy; WHEREAS, the contract implementation started on December 13, 2018 and will end on April 16, 2019; WHEREAS, on March 18, 209, the Instiution Development Division (IDD) requested forthe procurement ofthe Additional Improvement Works at the BPK Building through Section 53.4 Adjacent or Contiguous) ofthe 2016 Revised IRR of RA {9184 in view ofthe folowing: 1. changes in room layout, 2. provison and relocation of cable TV unit, electrical equipment, emergency lights and shelf for cable unit, 3. Replace existing lighing system of the hallway, and 4, Replacement of shower heads and adjustment of shower area: WHEREAS, Section 53 of the 2016 Revised IRR of RA 9184 states that Negotiated Procurement is a method of procurement of Goods, Infrastructure Projects and Consulting services, whereby the Procuring Entity directly negotiates a ‘contract with a technically, legally and financially capable supplier, contractor or consultant; WHEREAS, the request met all the conditions under Section 63.4, to wit “Where the subject contract is adjacent or contiguous to an ongoing infrastructure Projector Consulting Service where the consultants have unique experience and expertise to delver the required service: Provided, however, That (a) the ‘orginal contract is the result of @ Competitive Bidding; (b) the subject contrac fo be negotiated has simile or related ‘scopes of work: () its within the contracting capacity ofthe cntractorconsultant;(d) the contractorconsultant uses the same prices or lower unit prices asin the original contract less mobilization cost; () the amount ofthe contiguous cor adjacent work involved does not exceed the amount of the ongoing project; and () the conractorcnsutant has no negative sippage/delay: Provided, further, That negotiations forthe procurement ofthe contiguous or adjacent work are commenced before the expiry of the original contract.” WHEREAS, use ofthis alteratve method of procurement in negotiating wit the contractor ofthe ongoing project wil be ‘more economical and efficient WHEREAS, the project will be completed within twenty one calerdar days starting from the receipt ofthe Notice to Proceed; NOW, THEREFORE, We, the members of the Bids and Awards Committee, hereby RESOLVE as itis hereby RESOLVED to recommend the use of Section 53.4 - Adjacent or Contiguous as the method of procurement fr ths infrastructure project, ‘and recommend tothe Executive Director of PCARRD the awaid of contract to Malina’s General Builders in the amount of (ONE HUNDRED SEVENTY EIGHT THOUSAND THREE HUNDRED THIRTY TWO PESOS & 56/100 (PhP178,332.56.
