An Act t o c e n t r a l i s e and vest i n the C e n t r a l Government the c o n t r o l over c e r t a i n


o p e r a t i o n s r e l a t i n g t o dangerous drugs and t o increase and render u n i f o r m the
p e n a l t i e s f o r offences r e l a t i n g t o such o p e r a t i o n s .

WHEREAS I n d i a p a r t i c i p a t e d i n the Second I n t e r n a t i o n a l Opium Conference, which was


convoked i n accordance w i t h the r e s o l u t i o n o f the Assembly o f the League o f Nations
dated the 27th day o f September, 1923, met a t Geneva on the 17th day o f November, 1924
and on the 19th day o f February, 1925, adopted the Convention r e l a t i n g t o Dangerous
Drugs ( h e r e i n a f t e r r e f e r r e d t o as the Geneva Conventions);
AND WHEREAS I n d i a was a State s i g n a t o r y t o the s a i d Geneva Convention;
AND WHEREAS the C o n t r a c t i n g P a r t i e s t o the s a i d Geneva Convention resolved t o take
f u r t h e r measures t o suppress the contraband t r a f f i c i n and abuse o f Dangerous Drugs,
e s p e c i a l l y those d e r i v e d from opium, I n d i a n hemp and coca l e a f , such measures being more
p a r t i c u l a r l y set f o r t h i n the A r t i c l e s o f the s a i d Geneva Convention;
AND WHEREAS f o r the e f f e c t i v e c a r r y i n g out o f the s a i d measures i t i s expedient
t h a t the c o n t r o l o f c e r t a i n o p e r a t i o n s r e l a t i n g t o Dangerous Drugs should be c e n t r a l i s e d
and vested i n the C e n t r a l Government;
AND WHEREAS i t i s a l s o expedient t h a t the p e n a l t i e s f o r c e r t a i n offences r e l a t i n g
t o Dangerous Drugs should be increased, and t h a t a l l p e n a l t i e s r e l a t i n g t o c e r t a i n
operations should be rendered uniform;
I t i s hereby enacted as f o l l o w s :

CHAPTER I
PRELIMINARY

1. Short t i t l e , e x t e n t and commencement. ( 1 ) This A c t may be c a l l e d t h e


Dangerous Drugs A c t , 1930.
(2) I t extends t o t h e whole o f I n d i a .
(3) I t s h a l l come i n t o f o r c e on such date as t h e C e n t r a l Government may by
n o t i f i c a t i o n i n t h e o f f i c i a l Gazette a p p o i n t .
2. Definitions. I n t h i s A c t , unless t h e r e i s a n y t h i n g repugnant i n t h e s u b j e c t
or c o n t e x t :
(a) "coca l e a f " means
(i) t h e l e a f and young t w i g s o f any coca p l a n t , t h a t i s , o f t h e E r y t h r o x y l o n coca
(Lamk.) and t h e E r y t h r o x y l o n novograntense ( H i e r n . ) and t h e i r v a r i e t i e s ,
and o f any o t h e r species o f t h i s genus which t h e C e n t r a l Government may, by
n o t i f i c a t i o n i n t h e o f f i c i a l Gazette, d e c l a r e t o be coca p l a n t s f o r t h e
purposes o f t h i s A c t ; and
(ii) any m i x t u r e t h e r e o f , w i t h o r w i t h o u t n e u t r a l m a t e r i a l s ; b u t does not
i n c l u d e any p r e p a r a t i o n c o n t a i n i n g n o t more than 1.1 per cent o f cocaine;
(b) "coca d e r i v a t i v e " means
(i) crude cocaine, t h a t i s , any e x t r a c t o f coca l e a f which can be used,
d i r e c t l y o r i n d i r e c t l y , f o r t h e manufacture o f cocaine;
(ii) ecgonine, t h a t i s , laevo-ecgonine having t h e chemical f o r m u l a

d e r i v a t i v e s o f laevo-ecgonine from which
i t can be recovered;
(iii) cocaine, t h a t i s methyl-benzoyl-laevo-ecgonine having t h e chemical
formula C ^ NO^ and i t s s a l t s ; and
(iv) a l l p r e p a r a t i o n s , o f f i c i a l and n o n - o f f i c i a l , c o n t a i n i n g more than
0.1 per cent o f cocaine;
(c) "hemp" means
(i) t h e leaves, s m a l l s t a l k s and f l o w e r i n g o r f r u i t i n g tops o f t h e I n d i a n
hemp p l a n t (Cannabis s a t i v a L . ) , i n c l u d i n g a l l forms known as bhang, s i d h i ,
or g a n j a ;
(ii) charas, t h a t i s , t h e r e s i n o b t a i n e d from t h e I n d i a n hemp p l a n t , which has
not been submitted t o any m a n i p u l a t i o n s o t h e r than those necessary f o r
packing and t r a n s p o r t ; and
(iii) any m i x t u r e , w i t h o r w i t h o u t n e u t r a l m a t e r i a l s , o f any o f t h e above forms
of hemp o r any d r i n k prepared t h e r e f r o m ;
(d) " M e d i c i n a l hemp" means any e x t r a c t s o r t i n c t u r e o f hemp;
(e) "opium" means
(i) t h e capsules o f t h e poppy (Papaver somniferum L . ) ;
(ii) t h e spontaneously coagulated j u i c e o f such capsules which has n o t been
submitted t o any m a n i p u l a t i o n s o t h e r than those necessary f o r packing and
transport; and

(iii) any m i x t u r e , w i t h or w i t h o u t n e u t r a l m a t e r i a l s , of any o f the above forms


o f opium; but does not i n c l u d e any p r e p a r a t i o n c o n t a i n i n g not more than
0.2 per cent o f morphine;
(f) "opium d e r i v a t i v e " means
(i) m e d i c i n a l opium, t h a t i s , opium which has undergone the processes
necessary t o adapt i t f o r m e d i c i n a l use i n accordance w i t h the requirements
of the B r i t i s h Pharmacopoeia, whether i n powder form or g r a n u l a t e d or
otherwise or mixed w i t h n e u t r a l m a t e r i a l s ;
(ii) prepared opium, t h a t i s , any product of opium obtained by any s e r i e s o f
o p e r a t i o n s designed t o t r a n s f o r m opium i n t o an e x t r a c t s u i t a b l e f o r
smoking, and the dross or o t h e r residue remaining a f t e r opium i s smoked;
(iii) morphine, t h a t i s , the p r i n c i p a l a l k a l o i d of opium having the chemical
formula N0 ,
3 and i t s s a l t s ;
(iv) d i a c e t y l m o r p h i n e , t h a t i s , the a l k a l o i d , a l s o known as diamorphine or
h e r o i n , having the chemical formula C^h^NO^, a n d
i t s
salts; and
(v) a l l p r e p a r a t i o n s , o f f i c i n a l and n o n - o f f i c i n a l , c o n t a i n i n g more than
0.2 per cent o f morphine, or c o n t a i n i n g any diacetylmorphine;
(g) "manufactured drug" includes
(i) a l l coca d e r i v a t i v e s , m e d i c i n a l hemp and opium d e r i v a t i v e s ; and
(ii) any o t h e r n a r c o t i c substance which the C e n t r a l Government may, by
n o t i f i c a t i o n i n the O f f i c i a l Gazette made i n pursuance o f a recommendation
under A r t i c l e 10 o f the Geneva Convention or i n pursuance of any
i n t e r n a t i o n a l convention supplementing the Geneva Convention, declare t o be
a manufactured drug;
but does not i n c l u d e any p r e p a r a t i o n which the C e n t r a l Government may, by
n o t i f i c a t i o n i n the o f f i c i a l Gazette made i n pursuance o f a f i n d i n g under
A r t i c l e 8 o f the Geneva Convention, d e c l a r e not t o be a manufactured drug;
(h) "dangerous drug" i n c l u d e s coca l e a f , hemp and opium, and a l l manufactured
drugs;
(i) " t o import i n t o I n d i a " means t o b r i n g i n t o I n d i a by l a n d , sea or a i r
across any of the customs f r o n t i e r s d e f i n e d by the C e n t r a l Government, and
i n c l u d e s the b r i n g i n g i n t o any p o r t or place i n I n d i a o f a dangerous drug
intended t o be taken out of I n d i a w i t h o u t being removed from the ship or
conveyance i n which i t i s being c a r r i e d ;
(j) " t o import i n t e r - p r o v i n c i a l l y " means t o b r i n g i n t o a State otherwise than
across any o f the s a i d customs f r o n t i e r s ;
(k) " t o e x p o r t from I n d i a " means t o take out of I n d i a by l a n d , sea or a i r
across any of the s a i d customs f r o n t i e r s ;
(1) " t o export i n t e r - p r o v i n c i a l l y " means t o take out of a S t a t e otherwise
than across any o f the s a i d customs f r o n t i e r s ; and
(m) " t o t r a n s p o r t " means t o take from one place t o another i n the same S t a t e ;

P r o v i d e d ; t h a t , unless and u n t i l such r u l e s are made such percentages s h a l l be


c a l c u l a t e d on t h e b a s i s t h a t a p r e p a r a t i o n c o n t a i n i n g one ^per- cent o f a substance means
a p r e p a r a t i o n i n which one gramme o f t h e substance, i f a s o l i d , o r one m i l l i l i t r e o f t h e
substance, i f a l i q u i d , i s c o n t a i n e d i n every one h u n d r e d ' m i l l l l i t r e s o f 'the
p r e p a r a t i o n , and so i n p r o p o r t i o n f o r any g r e a t e r o r l e s s percentage. 1 '

CHAPTER I I '
PROHIBITION AND CONTROL

4. P r o h i b i t i o n of certain operations. ( 1 ) No one s h a l l :


(a) c u l t i v a t e any coca p l a n t , o r g a t h e r any p o r t i o n o f a coca p l a n t ,
(b) manufacture o r possess prepared opium, unless i t i s prepared from opium
l a w f u l l y possessed f o r t h e consumption o f t h e person so possessing i t , o r
(c) i m p o r t i n t o I n d i a e x p o r t from I n d i a t r a n s h i p o r s e l l prepared opium;
Provided t h a t t h i s s e c t i o n s h a l l n o t apply t o t h e c u l t i v a t i o n o f any coca p l a n t o r
t o t h e g a t h e r i n g o f any p o r t i o n t h e r e o f on b e h a l f o f t h e Government.
(2) The S t a t e Government may make r u l e s r e s t r i c t i n g and r e g u l a t i n g t h e manufacture
and possession o f prepared opium from opium which i s l a w f u l l y possessed under clause ( b )
of sub-section ( i ) .
5. C o n t r o l o f C e n t r a l Government over p r o d u c t i o n and supply o f opium. ( 1 ) No
one shall:
(a) c u l t i v a t e t h e poppy (Papaver somniferum L . ) , o r
(b) manufacture opium,
save i n accordance w i t h r u l e s made under s u b - s e c t i o n ( 2 ) and w i t h t h e c o n d i t i o n s o f any
l i c e n c e f o r t h a t purpose which he may be r e q u i r e d t o o b t a i n under those r u l e s .
(2) The C e n t r a l Government may make r u l e s p e r m i t t i n g and r e g u l a t i n g t h e
c u l t i v a t i o n o f t h e poppy (Papaver somniferum L.) and the manufacture o f opium, and such
r u l e s may p r e s c r i b e t h e form and c o n d i t i o n s o f l i c e n c e s f o r such c u l t i v a t i o n and
manufacture, t h e a u t h o r i t i e s by which such l i c e n c e s may be g r a n t e d , t h e fees t h a t may be
charged t h e r e f o r , and any o t h e r m a t t e r r e q u i s i t e t o render e f f e c t i v e t h e c o n t r o l o f t h e
C e n t r a l Government over such c u l t i v a t i o n and manufacture.
(3) The C e n t r a l Government may a l s o make r u l e s p e r m i t t i n g and r e g u l a t i n g t h e sale
of opium from Government f a c t o r i e s f o r e x p o r t o r t o S t a t e Governments o r t o
manufacturing chemists. ,
6. C o n t r o l o f C e n t r a l Government over m a n u f a c t u r e o f ^anHfactured drugs. ( 1 ) No
one s h a l l manufacture any manufactured d r u g , o t h e r than prepared opium, save i n
accordance w i t h r u l e s made under s u b - s e c t i o n ( 2 ) and w i t h t h e c o n d i t i o n s o f any l i c e n c e
f o r t h a t purpose which he may be r e q u i r e d t o o b t a i n under those r u l e s .

the maker i s l a w f u l l y e n t i t l e d t o possess.

(1) No one s h a l l ;
(a) import i n t o I n d i a ,
(b) export from I n d i a , o r

any dangerous drug, o t h e r than prepared opium, saving i n accordance w i t h r u l e s made
under s u b - s e c t i o n ( 2 ) and w i t h t h e c o n d i t i o n s o f any l i c e n c e f o r t h a t purpose which he
may be r e q u i r e d t o o b t a i n under those rules.
(2) The C e n t r a l Government may make r u l e s p e r m i t t i n g and r e g u l a t i n g t h e import
i n t o and e x p o r t from I n d i a and t h e transhipment o f dangerous drugs, o t h e r than prepared
opium, and such r u l e s may p r e s c r i b e t h e p o r t s o r places a t which any k i n d o f dangerous
drug may be imported, exported o r t r a n s h i p e d , t h e form and c o n d i t i o n s o f l i c e n c e s f o r
such i m p o r t , e x p o r t o r transhipment, t h e a u t h o r i t i e s by which such l i c e n c e s may be
g r a n t e d , t h e fees t h a t may be charged t h e r e f o r , and any o t h e r m a t t e r r e q u i s i t e t o render
e f f e c t i v e t h e c o n t r o l o f t h e C e n t r a l Government over such i m p o r t , e x p o r t and
transhipment.
8. C o n t r o l o f S t a t e Government over i n t e r n a l t r a f f i c i n manufactured drugs and
coca l e a f . ( 1 ) No one s h a l l ;
(a) Import o r e x p o r t i n t e r - p r o v i n c i a l l y , t r a n s p o r t , possess o r s e l l any
manufactured drug, o t h e r than prepared opium, o r coca l e a f , o r
(b) manufacture m e d i c i n a l opium o r any p r e p a r a t i o n c o n t a i n i n g morphine,
d i a c e t y l m o r p h i n e o r cocaine,
save i n accordance w i t h r u l e s made under sub-section ( 2 ) and w i t h t h e c o n d i t i o n s o f any
l i c e n c e f o r t h a t purpose which he may be r e q u i r e d t o o b t a i n under those rules.
(2) The S t a t e Government may make r u l e s p e r m i t t i n g and r e g u l a t i n g ;
(a) t h e i n t e r - p r o v i n c i a l import and export i n t o and from t h e t e r r i t o r i e s under i t s
a d m i n i s t r a t i o n , t h e t r a n s p o r t , possession and sale o f manufactured drugs, o t h e r than
prepared opium, and o f coca l e a f ; and
(b) t h e manufacture o f m e d i c i n a l opium o r o f any p r e p a r a t i o n c o n t a i n i n g morphine,
d i a c e t y l m o r p h i n e o r cocaine from m a t e r i a l s which t h e maker i s l a w f u l l y e n t i t l e d t o
possess.
Such r u l e s may p r e s c r i b e t h e form and c o n d i t i o n s o f l i c e n c e s f o r such i m p o r t ,
e x p o r t , t r a n s p o r t , possession, s a l e and manufacture, t h e a u t h o r i t i e s by which such

l i c e n c e s may be granted and t h e fees t h a t may be charged t h e r e f o r , and any other m a t t e r s


r e q u i s i t e t o render e f f e c t i v e the c o n t r o l o f t h e State Government over such i m p o r t ,
e x p o r t , t r a n s p o r t , possession, sale and manufacture.
(3) Save i n so f a r as may be expressly provided i n r u l e s made under
sub-section ( 2 ) , nothing i n t h i s s e c t i o n s h a l l apply t o manufactured drugs which are t h e
p r o p e r t y and i n the possession o f Government;
Provided t h a t such drugs s h a l l n o t be s o l d o r o t h e r w i s e d e l i v e r e d t o any person
who, under t h e r u l e s made by t h e State Government under t h i s s e c t i o n , i s n o t e n t i t l e d t o
t h e i r possession.
9. C o n t r o l o f State Government over e x t e r n a l d e a l i n g s i n dangerous drugs. No one

CHAPTER I I I
OFFENCES AND PENALTIES

10. Punishment f o r c o n t r a v e n t i o n o f s e c t i o n 4. Whoever:


(a) c u l t i v a t e s any coca p l a n t o r gathers any p o r t i o n o f a coca p l a n t ;
(b) manufactures o r possesses prepared opium otherwise than as p e r m i t t e d under
s e c t i o n 4; o r
(c) imports i n t o I n d i a , exports from I n d i a , t r a n s h i p s o r s e l l s prepared opium,
s h a l l be punished w i t h imprisonment which may extend t o two y e a r s , o r w i t h f i n e , o r w i t h
both;
Provided t h a t t h i s s e c t i o n s h a l l n o t apply t o the c u l t i v a t i o n o f any coca p l a n t o r
t o the g a t h e r i n g o f any p o r t i o n t h e r e o f on b e h a l f o f the Government.

15. Punishment f o r a l l o w i n g premises t o be used f o r the commission o f an o f f e n c e .
Whoever, being the owner o r occupier o r having the use o f any house, room, e n c l o s u r e ,
space, v e s s e l , v e h i c l e , o r p l a c e , knowingly p e r m i t s i t t o be used f o r the commission by
any o t h e r person o f an o f f e n c e punishable under s e c t i o n 10, s e c t i o n 12, s e c t i o n 13, o r
s e c t i o n 14, s h a l l be punished w i t h imprisonment which may extend t o two y e a r s , o r w i t h
f i n e , o r with both.
16. Enhanced punishment f o r c e r t a i n offences a f t e r p r e v i o u s c o n v i c t i o n . Whoever,
having been c o n v i c t e d o f an o f f e n c e punishable under s e c t i o n 10, s e c t i o n 12, s e c t i o n 13,
or s e c t i o n 14, i s g u i l t y o f any o f f e n c e punishable under any o f those s e c t i o n s , s h a l l be
s u b j e c t f o r every such subsequent o f f e n c e t o imprisonment which may extend t o f o u r
years, o r t o f i n e , o r t o b o t h .
17. Enhanced punishment f o r o f f e n c e under s e c t i o n 15 a f t e r previous c o n v i c t i o n .
Whoever, having been c o n v i c t e d o f an o f f e n c e punishable under s e c t i o n 15, i s again
g u i l t y o f an o f f e n c e punishable under t h a t s e c t i o n , s h a l l be s u b j e c t f o r every such
subsequent o f f e n c e t o imprisonment which may extend t o f o u r y e a r s , o r t o f i n e , o r t o
both.
18. S e c u r i t y f o r a b s t a i n i n g from commission o f c e r t a i n o f f e n c e s . ( 1 ) Whenever
any person i s c o n v i c t e d o f an o f f e n c e punishable under s e c t i o n 10, s e c t i o n 12,
s e c t i o n 13, s e c t i o n 14, and the Court c o n v i c t i n g him i s o f o p i n i o n t h a t i t i s necessary
t o r e q u i r e such person t o execute a bond f o r a b s t a i n i n g from the commission o f offences
punishable under those s e c t i o n s , the Court may, a t t h e time o f passing sentence on such
person, order him t o execute a bond f o r a sum p r o p o r t i o n a t e t o h i s means, w i t h o r
w i t h o u t s u r e t i e s , f o r a b s t a i n i n g from the commission o f such o f f e n c e s d u r i n g such
p e r i o d , n o t exceeding t h r e e years, as i t t h i n k s f i t t o f i x .
(2) The bond s h a l l be i n the form contained i n Schedule I , and t h e p r o v i s i o n s o f
the Code o f C r i m i n a l Procedure, 1898 (V o f 1898), s h a l l , i n so f a r as they a r e
a p p l i c a b l e , apply t o a l l matters connected w i t h such bond as i f i t were a bond t o keep
the peace ordered t o be executed under s e c t i o n 106 o f t h a t Code.
(3) I f t h e c o n v i c t i o n i s s e t aside on appeal o r o t h e r w i s e , t h e bond so executed
s h a l l become v o i d .
(4) An o r d e r under t h i s s e c t i o n may a l s o be made by an a p p e l l a t e Court, o r by t h e
High Court when e x e r c i s i n g i t s powers o f r e v i s i o n .

under s e c t i o n 9, s h a l l be punished w i t h f i n e which may extend t o one thousand rupees.
20. Attempts. Whoever attempts t o commit an o f f e n c e punishable under t h i s
Chapter, o r t o cause such an o f f e n c e t o be committed, and i n such attempt does any a c t
towards the commission o f the o f f e n c e , s h a l l be punished w i t h the punishment provided
f o r the o f f e n c e .
21. Abetments. ( 1 ) Whoever abets an o f f e n c e punishable under t h i s Chapter s h a l l ,
whether such o f f e n c e be o r be not committed i n consequence o f such abetment, and
n o t w i t h s t a n d i n g a n y t h i n g contained i n s e c t i o n 116 o f the I n d i a n Penal Code (XLV o f
1860), be punished w i t h the punishment provided f o r the o f f e n c e .
(2) A person abets an o f f e n c e w i t h i n the meaning o f t h i s s e c t i o n who, i n India,
abets the commission o f any act i n a place w i t h o u t and beyond I n d i a which:
(a) would c o n s t i t u t e an o f f e n c e i f committed w i t h i n I n d i a ; or
(b) under the laws o f such p l a c e , i s an o f f e n c e r e l a t i n g t o dangerous drugs having
a l l the l e g a l c o n d i t i o n s r e q u i r e d t o c o n s t i t u t e i t such an o f f e n c e the same as o r
analogous t o the l e g a l c o n d i t i o n s r e q u i r e d t o c o n s t i t u t e i t an o f f e n c e punishable under
t h i s Chapter, i f committed w i t h i n I n d i a .

CHAPTER I V
PROCEDURE

22. Power t o issue w a r r a n t s . ( 1 ) The C o l l e c t o r o r o t h e r o f f i c e r a u t h o r i z e d by


the State Government i n t h i s b e h a l f , o r a Presidency M a g i s t r a t e o r a M a g i s t r a t e o f t h e
f i r s t c l a s s , o r a M a g i s t r a t e o f the second c l a s s s p e c i a l l y empowered by the State
Government i n t h i s b e h a l f , may issue a warrant f o r the a r r e s t o f any person whom he has
reason t o b e l i e v e t o have committed an o f f e n c e punishable under Chapter I I I , or for the
search, whether by day o r by n i g h t , o f any b u i l d i n g , v e s s e l o r place i n which he has
reason t o b e l i e v e any dangerous drug i n respect o f which an o f f e n c e punishable under
Chapter I I I has been committed i s kept o r concealed.
(2) The o f f i c e r t o whom a search warrant under s u b - s e c t i o n ( 1 ) i s addressed s h a l l
have a l l the powers o f an o f f i c e r a c t i n g under s e c t i o n 23.
23. Power o f e n t r y , search, s e i z u r e and a r r e s t w i t h o u t w a r r a n t . ( 1 ) Any o f f i c e r
o f the department o f Excise, P o l i c e , Customs, S a l t , Opium, o r Revenue, s u p e r i o r i n rank
t o a peon o r c o n s t a b l e , a u t h o r i s e d i n t h i s b e h a l f by the S t a t e Government, who has
reason t o b e l i e v e , from personal knowledge o r from i n f o r m a t i o n g i v e n by any person and
taken down i n w r i t i n g , t h a t any dangerous drug i n respect o f which an o f f e n c e punishable
under Chapter I I I has been committed i s kept o r concealed i n any b u i l d i n g , v e s s e l o r
enclosed p l a c e , may, between s u n r i s e and sunset;
(a) e n t e r i n t o any such b u i l d i n g , v e s s e l o r p l a c e ;
(b) i n case o f r e s i s t a n c e , break open any door and remove any o t h e r o b s t a c l e t o
such e n t r y ;

(c) seize such drug and a l l m a t e r i a l s used i n the manufacture t h e r e o f and any
o t h e r a r t i c l e which he has reason t o b e l i e v e t o be l i a b l e t o c o n f i s c a t i o n under
s e c t i o n 33 and any document or o t h e r a r t i c l e which he has reason t o b e l i e v e may furnish
evidence o f t h e commission o f an o f f e n c e p u n i s h a b l e under Chapter I I I r e l a t i n g t o such
drug; and
(d) d e t a i n and search, and, i f he t h i n k s proper, a r r e s t any person whom he has
reason t o b e l i e v e t o have committed an o f f e n c e p u n i s h a b l e under Chapter I I I r e l a t i n g t o
such drug;
Provided t h a t i f such o f f i c e r has reason t o b e l i e v e t h a t a search warrant cannot be
obtained w i t h o u t a f f o r d i n g o p p o r t u n i t y f o r the concealment o f evidence o r f a c i l i t y f o r
the escape o f an o f f e n d e r , he may e n t e r and search such b u i l d i n g , v e s s e l or enclosed
place at any time between sunset and s u n r i s e , a f t e r r e c o r d i n g the grounds o f h i s b e l i e f .
(2) Where an o f f i c e r takes down any i n f o r m a t i o n i n w r i t i n g under s u b - s e c t i o n ( 1 ) ,
or records grounds f o r h i s b e l i e f under the p r o v i s o t h e r e t o , he s h a l l f o r t h w i t h send a
copy t h e r e o f t o h i s immediate o f f i c i a l superior.
24. Power o f s e i z u r e and a r r e s t i n p u b l i c p l a c e s . Any o f f i c e r o f any o f t h e
departments mentioned i n s e c t i o n 23 may;
(a) s e i z e , i n any p u b l i c place o r i n t r a n s i t , any dangerous drug i n respect o f
which he has reason t o b e l i e v e an o f f e n c e punishable under Chapter I I I has been
committed, and, along w i t h such d r u g , any o t h e r a r t i c l e l i a b l e t o c o n f i s c a t i o n under
s e c t i o n 33, and any document or other a r t i c l e which he has reason t o b e l i e v e may furnish
evidence o f the commission o f an o f f e n c e punishable under Chapter I I I r e l a t i n g t o such
drug;
(b) d e t a i n and search any person whom he has reason t o b e l i e v e t o have committed
an o f f e n c e p u n i s h a b l e under Chapter I I I , and, i f such person has any dangerous drug i n
his possession and such possession appears t o him t o be u n l a w f u l , a r r e s t him and any
o t h e r persons i n h i s company.
25. Mode o f making searches and a r r e s t s . The p r o v i s i o n s o f t h e Code o f C r i m i n a l
Procedure, 1898 (V o f 1898), s h a l l a p p l y , i n so f a r as they are not i n c o n s i s t e n t w i t h
the p r o v i s i o n s o f s e c t i o n s 22, 23 and 24, t o a l l w a r r a n t s issued and a r r e s t s and
searches made under those s e c t i o n s .
26. O b l i g a t i o n s on o f f i c e r s t o a s s i s t each o t h e r . A l l o f f i c e r s of the several
departments mentioned i n s e c t i o n 23 s h a l l , upon n o t i c e g i v e n or request made, be l e g a l l y
bound t o a s s i s t each o t h e r i n c a r r y i n g out t h e p r o v i s i o n s o f t h i s A c t .
27. Report o f a r r e s t and s e i z u r e s . Whenever any person makes any a r r e s t or
s e i z u r e under t h i s A c t , he s h a l l , w i t h i n f o r t y - e i g h t hours next a f t e r such a r r e s t o r
s e i z u r e , make a f u l l r e p o r t o f a l l the p a r t i c u l a r s o f such a r r e s t or s e i z u r e t o h i s
immediate o f f i c i a l superior.
28. Punishment f o r vexatious e n t r y , search, s e i z u r e or a r r e s t . Any person
empowered under s e c t i o n 23 o r s e c t i o n 24 who:
(a) w i t h o u t reasonable grounds o f s u s p i c i o n , enters or searches, or causes t o be
entered or searched, any b u i l d i n g , v e s s e l or p l a c e ;

(b) v e x a t i o u s l y and u n n e c e s s a r i l y seizes the p r o p e r t y o f any person on t h e


pretence o f s e i z i n g o r searching f o r any dangerous drug o r o t h e r a r t i c l e l i a b l e t o be
c o n f i s c a t e d under s e c t i o n 33, o r o f s e i z i n g any document o r o t h e r a r t i c l e l i a b l e t o
s e i z u r e under s e c t i o n 23 o r s e c t i o n 24; o r
(c) v e x a t i o u s l y and u n n e c e s s a r i l y d e t a i n s , searches o r a r r e s t s any person;
s h a l l be punished w i t h f i n e which may extend t o f i v e hundred rupees.
29. Disposal o f persons a r r e s t e d and o f a r t i c l e s s e i z e d . ( 1 ) Every person
a r r e s t e d and a r t i c l e seized under a w a r r a n t issued under s e c t i o n 22 s h a l l be forwarded
w i t h o u t delay t o the a u t h o r i t y by whom the warrant was issued; and every person
a r r e s t e d and a r t i c l e seized under s e c t i o n 23 o r s e c t i o n 24 s h a l l be forwarded w i t h o u t
delay t o the o f f i c e r i n charge o f the nearest p o l i c e s t a t i o n o r t o the nearest o f f i c e r
of the Excise Department empowered under s e c t i o n 30.
(2) The a u t h o r i t y o r o f f i c e r t o whom any person o r a r t i c l e i s forwarded under t h i s
s e c t i o n s h a l l , w i t h a l l convenient despatch, take such measures as may be necessary f o r
the d i s p o s a l according t o law o f such person o r a r t i c l e .
30. Power t o i n v e s t Excise o f f i c e r s w i t h t h e powers o f an o f f i c e r i n charge o f a
police station. The S t a t e Government may i n v e s t any o f f i c e r o f the Excise Department o r
any c l a s s o f such o f f i c e r s , w i t h the powers o f an o f f i c e r i n charge o f a p o l i c e s t a t i o n
f o r the i n v e s t i g a t i o n o f offences under t h i s A c t .
31. J u r i s d i c t i o n t o t r y offences. No M a g i s t r a t e s h a l l t r y an o f f e n c e under t h i s
Act unless he i s a Presidency M a g i s t r a t e o r a M a g i s t r a t e o f t h e f i r s t c l a s s , o r a
M a g i s t r a t e o f t h e second c l a s s s p e c i a l l y empowered by the a p p r o p r i a t e Government i n t h i s
behalf.
I n t h i s s e c t i o n "the a p p r o p r i a t e Government' means as r e s p e c t s any c o n t r a v e n t i o n o f
any r u l e s which under t h i s Act f a l l t o be made by the State Government, t h a t Government,
and i n o t h e r cases, t h e C e n t r a l Government.
32. Presumption from possession o f i l l i c i t articles. I n t r i a l s under t h i s A c t i t
may be presumed, unless and u n t i l the c o n t r a r y i s proved, t h a t the accused has committed
an o f f e n c e under Chapter I I I i n respect o f :
(a) any dangerous d r u g ;
(b) any poppy o r coca p l a n t growing on any land which he has c u l t i v a t e d ;
(c) any apparatus s p e c i a l l y designed o r any group o f u t e n s i l s s p e c i a l l y adapted
f o r t h e manufacture o f any dangerous drug; o r
(d) any m a t e r i a l s which have undergone any process towards the manufacture o f a
dangerous drug, o r any r e s i d u e l e f t o f t h e m a t e r i a l s from which a dangerous drug has
been manufactured, f o r the possession o f which he f a i l s t o account s a t i s f a c t o r i l y .
33. L i a b i l i t y of i l l i c i t articles t o confiscation. ( 1 ) Whenever any o f f e n c e has
been committed which i s punishable under Chapter I I I , the dangerous d r u g , m a t e r i a l s ,
apparatus and u t e n s i l s i n respect o f which o r by means o f which such o f f e n c e has been
committed, s h a l l be l i a b l e t o c o n f i s c a t i o n .
(2) Any dangerous drug l a w f u l l y imported, t r a n s p o r t e d , manufactured, possessed, o r
s o l d along w i t h , o r i n a d d i t i o n t o , any dangerous drug which i s l i a b l e t o c o n f i s c a t i o n

under sub-section ( 1 ) , and t h e r e c e p t a c l e s , packages and coverings i n which any


dangerous drug, m a t e r i a l s , apparatus o r u t e n s i l s l i a b l e t o c o n f i s c a t i o n under
sub-section ( 1 ) i s found, and t h e o t h e r contents i f any, o f such r e c e p t a c l e s o r
packages, and t h e animals, v e h i c l e s , vessels and o t h e r conveyances used i n c a r r y i n g t h e
same, s h a l l l i k e w i s e be l i a b l e t o c o n f i s c a t i o n ;
Provided t h a t no animal, v e h i c l e , v e s s e l o r o t h e r conveyance s h a l l be l i a b l e t o
c o n f i s c a t i o n unless i t i s proved t h a t t h e owner t h e r e o f knew t h a t t h e o f f e n c e was b e i n g ,
or was t o be o r was l i k e l y t o be, committed.
34. Procedure i n making c o n f i s c a t i o n s . ( 1 ) I n the t r i a l o f offences under t h i s
A c t , whether t h e accused i s c o n v i c t e d o r a c q u i t t e d , t h e Court s h a l l decide whether any
a r t i c l e seized under t h i s Chapter i s l i a b l e t o c o n f i s c a t i o n under s e c t i o n 33; and, i f
i t decides t h a t t h e a r t i c l e i s so l i a b l e , i t may order c o n f i s c a t i o n a c c o r d i n g l y .
(2) Where any a r t i c l e seized under t h i s Chapter appears t o be l i a b l e t o
c o n f i s c a t i o n under s e c t i o n 33, b u t t h e person who committed t h e o f f e n c e i n connection
t h e r e w i t h i s n o t known or cannot be found, t h e C o l l e c t o r o r o t h e r o f f i c e r a u t h o r i z e d by
the State Government i n t h i s b e h a l f , may i n q u i r e i n t o and decide such l i a b i l i t y , and may
order c o n f i s c a t i o n a c c o r d i n g l y ;
Provided t h a t no order o f c o n f i s c a t i o n o f an a r t i c l e s h a l l be made u n t i l t h e e x p i r y
of one month from the date o f s e i z u r e , o r w i t h o u t h e a r i n g any person who may c l a i m any
r i g h t t h e r e t o and t h e evidence, i f any, which he produces i n respect o f h i s c l a i m ;
Provided, f u r t h e r , that, i f any such a r t i c l e , o t h e r than a dangerous drug, i s
l i a b l e t o speedy and n a t u r a l decay, o r i f t h e C o l l e c t o r o r o t h e r o f f i c e r i s o f o p i n i o n
t h a t i t s sale would be f o r the b e n e f i t o f i t s owner, he may a t any time d i r e c t i t t o be
sold and t h e p r o v i s i o n s o f t h i s s u b - s e c t i o n s h a l l , as n e a r l y as may be p r a c t i c a b l e apply
t o the n e t proceeds o f t h e s a l e .
(3) Any person n o t c o n v i c t e d who claims any r i g h t t o p r o p e r t y which has been
c o n f i s c a t e d under t h i s s e c t i o n may appeal t o t h e Court o f Session a g a i n s t t h e order o f
confiscation.
35. Power t o make r u l e s r e g u l a t i n g d i s p o s a l o f c o n f i s c a t e d a r t i c l e s and rewards.
I n connection w i t h offences a g a i n s t r u l e s which under t h i s A c t f a l l t o be made by t h e
S t a t e Government, and i n connection w i t h o t h e r o f f e n c e s , t h e C e n t r a l Government may make
rules t o regulate:
(a) t h e d i s p o s a l o f a l l a r t i c l e s c o n f i s c a t e d under t h i s A c t ; and
(b) the rewards t o be p a i d t o o f f i c e r s , i n f o r m e r s , and o t h e r persons o u t o f t h e
proceeds o f f i n e s and c o n f i s c a t i o n s under t h i s A c t .

CHAPTER V
MISCELLANEOUS

36. Provisions regarding r u l e s . ( 1 ) A l l r u l e s made under t h i s A c t s h a l l be


s u b j e c t t o the c o n d i t i o n o f previous p u b l i c a t i o n .
(2) Rules made under t h i s A c t s h a l l be p u b l i s h e d i n t h e o f f i c i a l Gazette.

37. Recovery o f sums due t o Government. ( 1 ) Any a r r e a r o f any l i c e n c e f e e


chargeable by any r u l e made under t h i s Act may be recovered from t h e person primarily
l i a b l e t o pay t h e same o r from h i s s u r e t y ( i f any) as i f i t were an a r r e a r o f
land-revenue.
(2) When any person, i n compliance w i t h any r u l e made under t h i s A c t , g i v e s a bond
( o t h e r than a bond under s e c t i o n 18) f o r t h e performance o f any a c t , o r f o r h i s
a b s t e n t i o n from any a c t , such performance o r a b s t e n t i o n s h a l l be deemed t o be a p u b l i c
d u t y , w i t h i n t h e meaning o f s e c t i o n 74 o f t h e I n d i a n Contract A c t , 1872 ( I X o f 1872)
and, upon breach o f t h e c o n d i t i o n s o f such bond by him, t h e whole sum named t h e r e i n as
the amount t o be p a i d i n case o f such breach may be recovered from him o r from h i s
s u r e t y ( i f any) as i f i t were an a r r e a r o f land-revenue.
38. A p p l i c a t i o n o f t h e Sea Customs A c t , 1878. A l l p r o h i b i t i o n s and r e s t r i c t i o n s
imposed by o r under t h i s Act on t h e i m p o r t i n t o I n d i a , t h e e x p o r t from I n d i a , and t h e
transhipment o f dangerous drugs, s h a l l be deemed t o be p r o h i b i t i o n s and r e s t r i c t i o n s

1. CENTRAL OPIUM RULES, 1934

I n e x e r c i s e o f t h e powers c o n f e r r e d by sub-sections ( 2 ) and ( 3 ) o f s e c t i o n 5 o f t h e


Dangerous Drugs A c t , 1930 ( I I o f 1930), the C e n t r a l Government i s pleased t o make t h e
f o l l o w i n g r u l e s , the same having been p r e v i o u s l y p u b l i s h e d as r e q u i r e d by
sub-section ( 1 ) o f s e c t i o n 36 o f the s a i d A c t , namely;

PART I . Preliminary

1. Short t i t l e and commencement. ( 1 ) These r u l e s may be c a l l e d t h e C e n t r a l


Opium Rules, 1934.
(1-A) They extend t o t h e whole o f I n d i a .
(2) They s h a l l come i n t o f o r c e on the 1st March 1934, whereupon a l l r u l e s made by
whatever a u t h o r i t y under an enactment s p e c i f i e d i n t h e f i r s t t h r e e columns o f
Schedule I I t o the Dangerous Drugs A c t , 1930 ( I I o f 1930), and f o r a purpose s p e c i f i e d

2. The poppy s h a l l not be c u l t i v a t e d anywhere i n any s t a t e t o which these r u l e s


apply save:
(a) w i t h i n such t r a c t s i n U t t a r Pradesh, Madhya Pradesh and Rajasthan as t h e
C e n t r a l Government may from time t o time by n o t i f i c a t i o n i n t h e Gazette o f I n d i a d e f i n e
i n t h i s behalf; and
(b) i n t h e Punjab w i t h i n t h e d i s t r i c t o f J u l l u n d u r , w i t h i n t h e Hoshiarpur T a h s i l

granted by an Excise O f f i c e r o f the 1st c l a s s o f the d i s t r i c t i n the annexed form o f
Licence;
Provided t h a t no person s h a l l c u l t i v a t e poppy i n an area l a r g e r than the maximum,
which e i t h e r he, or the person who preceded him i n the c u l t i v a t i o n o f h i s h o l d i n g ,
c u l t i v a t e d w i t h poppy i n any o f t h e t h r e e years 1932-33, 1933-34 and 1934-35.
Provided f u r t h e r t h a t any person who c u l t i v a t e s poppy w i t h o u t p r e v i o u s l y o b t a i n i n g
a l i c e n c e may be granted a l i c e n c e by the l i c e n c e g r a n t i n g a u t h o r i t y w i t h r e t r o s p e c t i v e
e f f e c t , on payment f o r t h w i t h o f composition money a t the r a t e o f n i n e rupees per q u a r t e r
o r f r a c t i o n o f a q u a r t e r o f an a c r e , i n a d d i t i o n t o the duty due. Such composition

PART I I I . Manufacture of Opium

5. Opium s h a l l not be manufactured anywhere i n any S t a t e t o which these r u l e s


apply save i n U t t a r Pradesh and Madhya Pradesh. Provided t h a t w i t h the s p e c i a l
permission o f the C e n t r a l Government, opium purchased from the Government F a c t o r i e s a t
Ghazipur and Neemuch may be remanufactured by or on b e h a l f o f a S t a t e Government i n the
form o f t a b l e t s or p i l l s f o r s a l e as Excise Opium;
Provided f u r t h e r t h a t opium, m i x t u r e s may be manufactured from raw opium l a w f u l l y
possessed by persons a u t h o r i z e d by the S t a t e Government under t h e i r r u l e s made f o r the
purpose;
Provided f u r t h e r t h a t c o n f i s c a t e d and damaged opium may be remodelled by or on
b e h a l f o f a S t a t e Government w i t h a view t o making i t f i t f o r e x c i s e purposes, s u b j e c t
t o the c o n d i t i o n t h a t the remodelled opium s h a l l be i n a form e n a b l i n g i t t o be
d i s t i n g u i s h e d from the excise opium issued from the Government F a c t o r i e s a t Ghazipur and
Neemuch.
6. Opium s h a l l not be manufactured i n :
(i) U t t a r Pradesh save by o f f i c e r s o f the Opium Department a t the Government
F a c t o r y a t Ghazipur; and
(ii) Madhya Pradesh save by o f f i c e r s o f the Opium Department a t the Government
Factory a t Neemuch;
Provided t h a t opium m i x t u r e s may be manufactured from raw opium l a w f u l l y possessed
by persons a u t h o r i z e d by the S t a t e Government concerned.

7. Sale f o r e x p o r t . The s a l e o f opium from t h e Government F a c t o r i e s a t Ghazipur


and Neerauch f o r export i s p r o h i b i t e d save when t h e export i s on b e h a l f o f t h e C e n t r a l
Government.
8. Sale t o t h e State Governments. The s a l e o f opium from t h e Government
F a c t o r i e s a t Ghazipur and Neemuch t o a State Government i s p r o h i b i t e d save under t h e
orders o f t h e C e n t r a l Government.
9. Sale t o manufacturing chemists. ( 1 ) The sale o f opium from t h e Government
Factory a t Ghazipur t o manufacturing chemists i n t h e State i s p r o h i b i t e d save under a
permit granted by o r under t h e orders o f t h e State Government w i t h i n whose j u r i s d i c t i o n
t h e chemist r e s i d e s o r has h i s place o f business. The form o f t h e p e r m i t s h a l l be
p r e s c r i b e d by t h e S t a t e Government.
(2) The p e r m i t r e f e r r e d t o i n s u b - r u l e ( 1 ) s h a l l be issued i n q u a d r u p l i c a t e , one
copy being r e t a i n e d f o r r e c o r d and t h r e e copies being forwarded t o the Factory
Superintendent, Government Factory a t Ghazipur, along w i t h t h e a p p l i c a t i o n o f t h e
chemist f o r the supply o f opium. The Factory Superintendent s h a l l r e t a i n one copy f o r
r e c o r d , enclose one w i t h t h e consignment and r e t u r n t h e t h i r d t o t h e i s s u i n g a u t h o r i t y
a f t e r endorsing thereon the q u a n t i t y a c t u a l l y s u p p l i e d and t h e date o f despatch.
(3) The chemist s h a l l s t a t e i n h i s a p p l i c a t i o n t o t h e State Government f o r t h e
supply o f opium ( i ) t h e purpose f o r which the opium i s r e q u i r e d , ( i i ) t h e stock i n hand
on the date o f t h e a p p l i c a t i o n , ( i i i ) t h e q u a n t i t y a p p l i e d f o r , and ( i v ) h i s
requirements f o r s i x months manufacture.
(4) The t o t a l q u a n t i t y o f opium s u p p l i e d t o a chemist i n any one f i n a n c i a l year
s h a l l n o t exceed 600 l b s . and t h e t o t a l q u a n t i t y s u p p l i e d a t any one t i m e :
(a) s h a l l n o t exceed t h e q u a n t i t y determined by t h e S t a t e Government as s u f f i c i e n t
f o r s i x months manufacture, and
( b ) s h a l l n o t , save i n cases o f s p e c i a l urgency exceed 100 l b s .
10. The p r i c e t o be charged f o r opium s o l d i n accordance w i t h t h i s P a r t s h a l l be
f i x e d from time t o time by t h e C e n t r a l Government.

PART V. Sale o f opium m i x t u r e s

11. The s a l e o f opium m i x t u r e s i s p r o h i b i t e d save under such c o n d i t i o n s and


r e s t r i c t i o n s as are p r e s c r i b e d by t h e State Government w i t h i n whose j u r i s d i c t i o n t h e

employed by him i n c a r r y i n g on h i s business and o f a l l h i s s e r v a n t s , as i f t h e
s a i d a c t s and omissions were h i s own.

(4) The l i c e n s e e s h a l l n o t manufacture t h e drug save from m a t e r i a l s which he i s


l a w f u l l y e n t i t l e d t o possess.

(5) The l i c e n s e e s h a l l n o t manufacture o r keep t h e drug o r keep t h e m a t e r i a l s used


f o r t h e manufacture o f t h e drug a t any place except h i s place o f business.

(6) The l i c e n s e e s h a l l n o t possess o r s e l l t h e drug o t h e r w i s e than i n accordance


w i t h t h e r u l e s made by the State Government under t h e Dangerous Drugs A c t ,
1930.

(7) The l i c e n s e e s h a l l n o t consume o r p e r m i t any person under h i s c o n t r o l or


a u t h o r i t y t o consume the drug a t h i s place o f business.

(8) The l i c e n s e e s h a l l m a i n t a i n t r u e accounts o f a l l t r a n s a c t i o n s i n t h e annexed


forms, bound i n books, paged and sealed w i t h t h e s e a l o f t h e Chief Excise
A u t h o r i t y . E n t r i e s i n t h e account s h a l l be made on t h e day on which
t r a n s a c t i o n s take p l a c e . The Accounts s h a l l be preserved f o r n o t l e s s than
two years from t h e date o f t h e l a s t e n t r y i n t h e accounts. The l i c e n s e e s h a l l

(10) Stocks o f t h e drug o r t h e m a t e r i a l s used f o r i t s manufacture and a l l accounts


and records o f t r a n s a c t i o n s under t h i s l i c e n c e s h a l l be open t o i n s p e c t i o n by
an o f f i c e r s p e c i a l l y o r g e n e r a l l y a u t h o r i z e d by t h e c h i e f e x c i s e a u t h o r i t y o f
the S t a t e .

(11) An i n s p e c t i o n note book, w i t h pages sealed and numbered c o n s e c u t i v e l y , s h a l l


be maintained f o r t h e use o f t h e I n s p e c t i n g O f f i c e r s and preserved i n good
condition. I t s h a l l be handed over t o an Excise O f f i c e r on demand on a
r e c e i p t being g i v e n t h e r e f o r , o r t o t h e Chief Excise A u t h o r i t y o r a t t h e end
of t h e p e r i o d f o r which t h e l i c e n c e i s i n f o r c e .

(12) I n case o f breach o f any o f t h e c o n d i t i o n s o f t h i s l i c e n c e , t h e Chief Excise


A u t h o r i t y may cancel o r suspend t h e l i c e n c e o r i n l i e u t h e r e o f impose a
p e n a l t y n o t exceeding one hundred rupees.

(13) The i m p o s i t i o n o f a p e n a l t y o r t h e c a n c e l l a t i o n o r suspension o f t h i s l i c e n c e


under t h e f o r e g o i n g c o n d i t i o n s h a l l n o t operate as a bar t o p r o s e c u t i o n f o r
any o f f e n c e which may have been committed under t h e Dangerous Drugs A c t , 1930.

(14) I f t h e l i c e n s e e has i n h i s possession on t h e e x p i r y , c a n c e l l a t i o n , o r


suspension o f t h i s l i c e n c e , any stock o f t h e drug, he s h a l l d e l i v e r i t up t o
the Chief Excise A u t h o r i t y .

(15) Any l i c e n s e e s h a l l be bound t o purchase i n such q u a n t i t y n o t exceeding t h e


q u a n t i t y which he i s l i k e l y t o s e l l i n two months and a t such r a t e s as t h e
Chief Excise A u t h o r i t y may d i r e c t , any stock o f t h e drug t h a t may be d e l i v e r e d
up t o t h e Chief Excise A u t h o r i t y under t h e p r o v i s i o n s o f c o n d i t i o n 14.

(16) The l i c e n s e e s h a l l n o t manufacture drugs i n a q u a n t i t y l a r g e r than h i s


requirements f o r 2 months.

8. A u t h o r i s a t i o n f o r export by sea. ( 1 ) The export a u t h o r i z a t i o n r e f e r r e d t o i n
r u l e 7 s h a l l be granted i n the case o f e x p o r t t o a maritime s t a t e i n I n d i a by o r under
the orders o f the State Government w i t h i n whose j u r i s d i c t i o n t h e p o r t o f e x p o r t i s
s i t u a t e , and i n the case o f exports elsewhere by the C o l l e c t o r o f Customs a t the p o r t o f
export who s h a l l n o t , w i t h o u t the s p e c i a l permission o f t h e C e n t r a l Government t o be

Geneva Convention; and

the o r d i n a r y m i x t u r e s o f which charas forms the base, an import c e r t i f i c a t e from the
country o f d e s t i n a t i o n i n the form annexed and, i n the case o f e x p o r t s o f charas and t h e
o r d i n a r y m i x t u r e s o f which charas forms the base, a s p e c i a l import c e r t i f i c a t e issued by
the Government o f the i m p o r t i n g c o u n t r y s t a t i n g t h a t the i m p o r t a t i o n i s approved f o r t h e
purposes s p e c i f i e d i n the c e r t i f i c a t e and t h a t the charas or m i x t u r e s w i l l not be
re-exported.
(2) I n the case o f exports o f opium from the p o r t o f C a l c u t t a , e x p o r t
a u t h o r i z a t i o n s s h a l l be issued i n t r i p l i c a t e , one copy being r e t a i n e d f o r r e c o r d , one
being handed t o the consignor so t h a t i t may accompany the consignment and one being
despatched t o the Government o f the i m p o r t i n g country i n pursuance o f clause ( 4 ) o f

q u a d r u p l i c a t e , t h r e e copies being disposed o f as h e r e i n b e f o r e p r o v i d e d and the f o u r t h
being forwarded immediately on the g r a n t o f the a u t h o r i z a t i o n t o the l o c a l excise
authorities;
Provided t h a t i f a proposed consignment appears t o the C o l l e c t o r o f Customs t o be
of an unusual c h a r a c t e r he s h a l l c o n s u l t the l o c a l excise a u t h o r i t i e s before g r a n t i n g
the a u t h o r i z a t i o n .
(3) A l l a u t h o r i z a t i o n s issued under t h i s Rule s h a l l , save where export i s t o be
e f f e c t e d by post under r u l e 13, be p r o m i n e n t l y marked "not a v a i l a b l e by p o s t " .
(4) The f o l l o w i n g p a r t i c u l a r s s h a l l be s p e c i f i e d i n the e x p o r t a u t h o r i z a t i o n and
the purpose f o r which each copy o f t h i s document i s intended s h a l l be mentioned
d i a g o n a l l y i n ( r e d i n k ) on i t :
(a) Name, address and business of exporter;
(b) Exact d e s c r i p t i o n and amount o f drug t o be exported
(c) Name and address o f f i r m i n i m p o r t i n g c o u n t r y r e q u i r i n g the drug;
(d) Number and date o f import c e r t i f i c a t e and i n d i c a t i o n o f the a u t h o r i t y i s s u i n g
this certificate;
(e) Any s p e c i a l c o n d i t i o n s t o be observed ( e . g . , not t o be exported through t h e
post);
(f) I f p o s s i b l e , the r o u t e t o be f o l l o w e d by the goods; and
(g) Period w i t h i n which the export i s t o be e f f e c t e d .
The maximum p e r i o d allowed f o r e x p o r t s h a l l not exceed 3 months.
9. Ports from which export t o be made. The dangerous drugs s p e c i f i e d i n t h e
f i r s t column o f t h e annexed t a b l e s h a l l not be exported by sea from I n d i a t o a place

(2) I n the case o f a p i l g r i m s h i p the C o l l e c t o r o f Customs may issue an
a u t h o r i z a t i o n f o r the e x p o r t o f an a d d i t i o n a l q u a n t i t y o f opium, hemp and manufactured
drugs f o r use on board the s h i p by p i l g r i m s . Such a u t h o r i z a t i o n s h a l l not be issued
save on the a u t h o r i t y o f an excise p e r m i t granted by o r under the o r d e r s o f the S t a t e
Government w i t h i n whose j u r i s d i c t i o n the p o r t o f departure i s s i t u a t e on the s t r e n g t h o f
a c e r t i f i c a t e from the P o r t Health O f f i c e r t h a t opium, hemp and manufactured drugs t o
the q u a n t i t y i n v o l v e d are necessary f o r the use o f p i l g r i m s on board the s h i p .
11. Export by l a n d . Dangerous drugs o t h e r than coca l e a f s h a l l not be exported by
land from I n d i a save under an export a u t h o r i z a t i o n granted by a S t a t e Government or by
an o f f i c e r a u t h o r i s e d i n t h a t b e h a l f by a S t a t e Government;
Provided t h a t an export a u t h o r i z a t i o n s h a l l not be r e q u i r e d i n the case o f :
(a) the export o f manufactured drugs which have been imported i n t o I n d i a i n
t r a n s i t t o a place o u t s i d e I n d i a under an import a u t h o r i z a t i o n marked " i n t r a n s i t " by
the a u t h o r i t y i s s u i n g the same;
(b) opium or hemp exported p e r s o n a l l y by a t r a v e l l e r t o a French or Portuguese
Settlement i n I n d i a up t o the l i m i t o f q u a n t i t y w i t h i n which possession i s allowed
w i t h o u t a pass on the I n d i a n s i d e o f the F r o n t i e r ;
(c) manufactured drugs so exported by such t r a v e l l e r which have been l a w f u l l y
obtained f o r the personal use o f the t r a v e l l e r or h i s f a m i l y from a recognized p h y s i c i a n
or a l i c e n s e d pharmacist i n India.
12. P r o v i s i o n s r e g a r d i n g a u t h o r i z a t i o n s f o r export by l a n d . (1) The export
a u t h o r i z a t i o n r e f e r r e d t o i n r u l e 11 s h a l l not be granted f o r e x p o r t t o a country unless
an import c e r t i f i c a t e from the Government o f the i m p o r t i n g c o u n t r y has been produced i n
the form or t o the e f f e c t r e q u i r e d by clause ( i i ) of sub-rule ( 1 ) or r u l e 8; and where
the i m p o r t i n g c o u n t r y has not r a t i f i e d t h e Geneva Convention, such e x p o r t a u t h o r i z a t i o n

s h a l l n o t , i n the case o f an u n u s u a l l y l a r g e consignment, be granted w i t h o u t p r i o r


r e f e r e n c e t o the C e n t r a l Government, unless the export i s being e f f e c t e d i n accordance
w i t h s t a n d i n g orders approved by the C e n t r a l Government.
(2) Every such e x p o r t a u t h o r i z a t i o n s h a l l , save where export i s t o be e f f e c t e d by
post under r u l e 13, be prominently marked "not a v a i l a b l e by p o s t " and s h a l l be issued i n
t r i p l i c a t e , the t h r e e copies being disposed o f i n the manner s p e c i f i e d i n sub-rule ( 2 )
of r u l e 8.
(3) The e x p o r t a u t h o r i z a t i o n s s h a l l s p e c i f y the same d e t a i l s as those mentioned i n
s u b - r u l e ( 4 ) o f r u l e 8.
13. Extent t o which use o f post o f f i c e a l l o w e d . (1) Save as provided i n
sub-rule (2) the medium o f the post o f f i c e s h a l l not be used f o r the e x p o r t s i n
accordance w i t h t h i s P a r t from I n d i a by sea or by land o f any dangerous drugs.
(2) Where dangerous drugs are t o be exported i n accordance w i t h t h i s Part t o any
d e s t i n a t i o n the export a u t h o r i z a t i o n may be marked " a v a i l a b l e by p a r c e l post";
Provided as follows;
(a) The e x p o r t a u t h o r i z a t i o n s h a l l not be so marked unless an import c e r t i f i c a t e
from the Government of the i m p o r t i n g t e r r i t o r y expressly a u t h o r i s i n g import i n t o t h a t
t e r r i t o r y by post and s t a t i n g t h a t the drugs i n q u e s t i o n are r e q u i r e d f o r medical or
s c i e n t i f i c purposes only has been produced;
(b) I f the drugs are t o be exported by sea, the export a u t h o r i z a t i o n r e f e r r e d t o
i n r u l e 8 s h a l l be granted e i t h e r by the C o l l e c t o r o f Customs a t the p o r t o f e x p o r t o r ,
by or under the orders o f the State Government w i t h i n whose j u r i s d i c t i o n the Post O f f i c e
of despatch i s s i t u a t e ;
(c) The number o f copies r e q u i r e d under r u l e 8 or r u l e 12 o f the e x p o r t
a u t h o r i z a t i o n s h a l l be increased by one, the a d d i t i o n a l copy being handed t o the
consignor f o r p r o d u c t i o n a t the Post O f f i c e o f despatch.

PART V. Transhipment

14. Transhipment. (1) No dangerous drug s h a l l be t r a n s h i p p e d a t any p o r t i n


I n d i a save w i t h the permission o f the Customs C o l l e c t o r .
(2) The Customs C o l l e c t o r s h a l l not g r a n t the permission r e f e r r e d t o i n sub-
r u l e (1) save under the s p e c i a l orders o f the C e n t r a l Government i n each case u n l e s s :
(a) the c o u n t r y from which the drugs have been shipped and the c o u n t r y t o which
the drugs are consigned are s i g n a t o r i e s t o and have r a t i f i e d the Geneva Convention; and
(b) the drugs are covered by an export a u t h o r i z a t i o n or a d i v e r s i o n certificate
granted i n accordance w i t h A r t i c l e 13 or A r t i c l e 15, as the case may be, o f the s a i d
Convention by or under the a u t h o r i t y o f the Government o f the c o u n t r y from which they
have been shipped and such a u t h o r i z a t i o n or c e r t i f i c a t e i s produced f o r the inspection
o f the Customs C o l l e c t o r i n accordance w i t h A r t i c l e 15 o f the s a i d Convention.
