APPLICATION/PETITION FOR GRANT OF GAURDIANSHIP

CERTIFICATE

RESPECTFULLY SHEWTH;
The Applicant/Petitioner very earnestly seeks the solace of this court
and submits as under

1. That the petitioner is the widow of Mr Hamid Shakeel Rohaila

who died on 4-5-2009 due to a long prevailing illness at
Peshawar.

(Death Certificate is annexed as A)

2. That the petitioner’s husband namely Mr Hmaid Shakeel

Rohaila after his death left behind a widow and two minor
children, a boy and a girl.

3. The name and age of the two minors left behind by petitioner’s
deceased husband are
a. Hanzala Hamid (Male) DOB 20-05-2003
b. Hamna Hamid (Female) DOB 25-02-2005

4. That the minors are in custody of applicant who happens to be

their mother; the minors and applicant are residing under one
roof and the applicant herself is bearing all the educational,
medical and living expenses of the minor children by working
as a teacher in a private school.
 5. That the deceased Mr Hamid Shakil left behind share in the
property i.e H No 2595 situated at Ghari Khana Adroon
Lahori Gate ,Peshawar City vide Registered deed No. 967,
Bahi No 01, Volume 1297 dated 03.05.1978.

6. That a letter of administration was issued on 02.01.2018 vide

petition no 08/02 titled as “Tariq Shakeel Rohela vs Public et
Large” in which the petitioner and the said minors were listed
a share holder in the above captioned property

(Copy of the Letter of Administration is annexed as C)

7. That the custody of the minors is with the Applicant who

happens to be their mother and natural guardian for persons
and property after the death of father.

8. That the applicant being the natural guardian of the above

mentioned minors deserves to be declared as the legal
guardian of the person as well as property of her children for
the reason to look after the movable and immovable property
left behind by their late father and to secure the valuable
vested rights as well as to dispose or invest any property in
beneficial manner of minors.

It is thereby very prayed that on acceptance of this

petition the afore-named applicant be magnanimously and
very earnestly be declared/appointed as Guardian of the afore
said minors and a Guardianship certificate may kindly be
granted as per law.
