CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and entered into this day _______________, in City
of Ilagan, Isabela by and between:

MARY GRACE SALACUP DONATO, of legal age, Filipino, married and with
residence/Office address at Minante II, Cauayan City, Isabela hereinafter referred to as
the “LESSOR”

-and-

PROVINCIAL GOVERNMENT OF ISABELA, a Local Government Unit duly

organized and existing under Philippine laws represented by the Provincial Governor
RODOLFO T. ALBANO III with Office address at Provincial Capitol Building, Alibagu,
City of Ilagan, Isabela hereinafter referred to as the “LESSEE”

WITHNESSETH:

WHEREAS, the LESSOR is the absolute and registered owner of a property

described as ORIENT PEARL DRIVE-INN HOTEL located at Soyung, Municipality of
Echague, Isabela, hereinafter referred to as the “LEASED PREMISES”;

WHEREAS, the Hon. Governor, RODOLFO T. ALBANO III issued a

Memorandum No. 2020-02 which mandates all Overseas Filipino Workers (OFWs) to
undergo RT PCR Swab Testing;

WHEREAS, the LESSEE is in need of a venue/ place to be used as a quarantine

site for the returning OFWs to the Province of Isabela pending the result of their
mandatory RT PCR Swab Testing;

WHEREAS, the LESSOR offered for lease the above-mentioned LEASED

PREMISES including all its rooms, dormitories and other facilities, and the LESSOR is
willing to lease the same unto the LESSEE, subject to the terms and conditions
hereinafter specified:

NOW, THEREFORE, for and in consideration of the foregoing and mutual

covenants herein contained, the LESSOR has let and by these present does hereby let
and lease unto the LESSEE the aforesaid property, and the LESSEE hereby accepts
the same by way of lease, subject to the following terms and conditions:

1. PERIOD OF LEASE - The term of this lease shall be from July 20, 2020 to
August 2, 2020. The Parties hereby agree that the period of lease may be
extended until such time needed by the LESSEE.

2. RENTAL – The LESSEE shall pay to the LESSOR the monthly rental of
NINE HUNDRED FIFTY THOUSAND PESOS (Php 950,000.00) Philippine
currency, net of all applicable taxes/charges. The rental fee shall be inclusive
of all charges for water, electricity, and other utilities used within the leased
premises.
3. MEALS – The LESSOR shall also provide for the daily meals (breakfast,
lunch and dinner) of the person admitted for Quarantine including those
employees of the Provincial Government of Isabela (PGI) who are on duty to
monitor the health and safety of those admitted.

4. PAYMENT TERMS – Upon completion of this Contract, the LESSEE shall

pay the LESSOR the above stated amount in CASH/CHECK, upon
submission of receipts and other pertinent documents needed for accounting
purposes.

5. PURPOSE- The LEASED PREMISES shall be used as

QUARANTINE/ISOLATION AREA for RETURNING OVERSEAS FILIPINO
WORKERS (ROFWs) and LOCALLY STRANDED INDIVIDUALS (LSIs) for
pending result of their RT PCR Swab Testing, in accordance with the
Memorandum No. 2020-02 issued by Governor Rodolfo T. Albano III.

6. IMPROVEMENT, ALTERATIONS – The LESSEE shall be allowed to make

any structural changes, alterations in the LEASED PREMISES in order to
attain the purpose as stated above without the written consent of the
LESSOR. However, any major alterations or improvements made or
introduced by the LESSEE on the LEASED PREMISES shall upon
termination of this Contract of Lease, automatically inure to the benefit of the
LESSOR

7. SANITATION, MAINTENANCE & REPAIRS – The LESSOR shall at all times

keep the LEASED PREMISES in clean, sanitary and good tenantable
condition for the LESSEE.

The LESSEE has inspected the LEASED PREMISES and found the same to
be in good tenantable condition. The LESSOR shall be responsible for all
major repairs on the Leased Premises caused by ordinary wear and tear.
Minor repairs, including but not limited to the replacement of bulbs and fuses,
faucet handles, cabinet pulls and catches, locks, toilet seats and water tank
cover, electrical switches and outlets, doorknobs, screens, window
mechanism and other similar breakages in the LEASED PREMISES shall be
for the account of the LESSEE, However, repairs due to the fault or
negligence of the LESSEE, members of its household, guest, or visitors, shall
be for the sole account of the LESSEE.

8. RETURN OF LEASE PREMISES- Upon the termination of this lease

contract, the LESSEE shall immediately vacate the LEASED PREMISES and
peacefully return possession thereof to the LESSOR. The premises shall be
returned by the LESSEE to the LESSOR in the same good, clean and
tenantable condition as it was turned over to the LESSEE at the beginning of
this lease, ordinary wear and tear expected.

9. WAIVER OF RIGHTS; AMENDMENTS OF CONTRACT- Failure or delay of

either party to insist once or in several instance on the strict performance by
the other party of any stipulation or condition in this contract and/or exercise
of any right or option herein shall not be construed as abandonment,
withdrawal, waiver nor cancellation of such conditions, stipulation, right or
option. Any amendment to this LEASE OF CONTRACT shall be made in
 writing and shall be signed by both parties for such amendment to be
effective.
