Declaratory Relief

- No damage
- No breach
- Determine rights of the parties when there is no breach or damage of rights

Parties in declaratory relief

1. All person who have claim which will be affected by the declaration
2. In any action that involves the validity of statute, SOLGEN shall be notified by the party assailing
the same
3. In any action involving the validity of the local government ordinance, the prosecutor or
attorney of the local government unit shall be similarly notified.

Effect if a person adversely affected is not included as defendant

- Generally, courts cannot take judicial notice in cases pending in another court, even if pending in
the same court or sala
- Unless the other party does not object to the same

Judicial Construction?

- Process of interpreting and applying the correct meaning of legal documents, as engaged in a
judge in a court of law

How will it be converted

- From special civil to an ordinary civil action
