Reporting OFFICER ANDREW RIPPY - NPD, ID # 7876
On 11/13/2013 at around 2340 hour I, Officer Rippy, was working patrol in fully marked squad car (Unit 88). I was near the intersection of
College and Veterans, when I overheard via scanner Bloomington Police Officers being dispatched the area of Veterans Parkway and
Clearwater for a report of a possible DUI traveling NIB on Veterans. I also heard via scanner, BPD Dispatch describing the vehicle as a black
Acura bearing license plate . BPD Dispatch also advised the caller, later identified , witnessed the vehicle all over the
roadway. Officer Konovsky and FTO Underwood were also in the area.

I was checking the area of 309 Landmark (Circle K) for the suspect vehicle, when I heard Officer Konovsky advised via radio that he was
behind the suspect vehicle which was turning EIB on Ft. Jesse from Veterans. Officer Konovsky advised they were unable to gather probable
cause for a stop, as it turned SIB on Greenbriar. Officer Konovsky continued EIB on Ft. Jesse. As this was happening, I turned SIB on
Veterans from Ft Jesse in an attempt to get south of the suspect vehicle, but I noticed that the suspect vehicle turned into Walmart (300
Greenbriar). '

I watched as the vehicle parked near the most west part of the parking lot, not around the entrance door. I never noticed anyone exit the
vehicle. I took up a position at in my patrol vehicle in the CVS parking lot (1701 Ft Jesse) where I could observe the suspect vehicle. I
watched as the suspect vehicle as sat in the parking lot for around 20 minutes, without any one exiting the vehicle.

I activated my in car video recording system, and drove SIB on Greenbriar, to make consensual contact with the driver. As I neared the
Acura, I did not activate any emergency lights and provided the Acura with several avenues of escape. I exited my patrol vehicle and began
approaching the Acura on foot. As I was approaching, Officer Wiggs arrived to assist, also not activating any emergency lights and providing
the suspect vehicle with several avenues of escape. As I neared the rear of the Acura, I noticed the registration sticker to be expired (09/12).
As I approached the driver?s door, I noticed a white male (later identified as PAUL SANTUCCI) in the driver?s seat sleeping.

I shined my flash light on Paul, but he didn?t wake. I knocked on the driver?s window, and Paul awoke and sat up. I asked Paul what was
going on and he stated
. I asked Paul ifhe had driven anywhere else and
he responded I confronted him with the fact that he was observed by Officer's traveling NIB on Veterans instead oflnterstate 55, and
Paul appeared confused.

While speaking with Paul I could smell the odor of an alcoholic beverage coming from his breath. His speech, movements, and response to
my questions were slow and lethargic. Paul's eyes were bloodshot and glassy. I asked Paul how many alcoholic beverages he consumed this
evening. I asked Paul for
his driver?s license and proof of insurance. Paul provided his driver's license and expired proof of insurance. I also advised him of the license
plate registration violation. Based on my observations, I asked Paul to exit for SFST's and he complied.

I administered HGN and VGN while Paul was standing. My observations are listed below.

I returned to my squad and confirmed Paul's driving status as valid. I administered SFST with Paul at approximately 12:26 AM. Paul
completed SFST on the asphalt parking lot which was flat, level, and free from debris. Paul agreed that the testing surface was flat, level, and
free from debris. I also confirmed with Paul that he had no problems walking, standing, or balancing. Paul confirmed he was healthy. In
addition to explaining the tests, I also demonstrated them and asked Paul ifhe understood the tests completely. Paul began each test when he
stated he understood it. The following tests were administered and my observations are listed below.

Horizontal Gaze Nystagmus and Vertical Gaze Nystagmus


Paul stated that he had no problems with his eyes.
Paul displayed equal tracking and pupil size in both eyes.
I) Paul displayed lack of smooth pursuit in both eyes.
2) Paul displayed Distinct and Sustained Nystagmus in both eyes at maximum deviation.
3) Paul displayed Nystagmus in both eyes at onset before 45 degrees.
4) Paul displayed Vertical Nystagmus in both eyes a maximum elevation.
It should be noted that Paul had to be redirected not to move his head. I also know through my training and experience the presence of VGN
to be an indicator of a high B.A.C. for that individual.

Walk and Tum Test:


I) Paul could not keep balance during the instructional phase. While in the instructional phase position, he was having trouble standing and
almost fell over. To protect Paul from falling and possibly injuring himself, I advised him to just stand comfortably while I provided
instructions.

2) Paul did not turn correctly as he pivoted on both feet.


3) Paul stepped offline on the fourth step of the second ninth step sequence.
4) Paul took ten steps on the second nine step·sequence.

It should be noted that while I was explaining the walk and tum, and Paul was having trouble keeping his balance in the starting position, he
began
After Paul later waived his Miranda Rights, I again asked him ifhe had any physical defects and he responded "no." ·

One Leg Stand Test:


I) Paul swayed while balancing.
2) Paul used his arms to balance.
3) Paul put his foot down twice.

I asked Paul two follow up questions once SFST's were completed. I asked Paul to rate himself on a scale of I to 10. One being "that he had
been drinking tonight and probably shouldn't be driving and ten being that there was no way he should be driving."
I also asked Paul ifhe had "ever been more drunk than he was right now."

Based on Paul's SFST, he was placed ~der arrest for DUI. I handcuffed Paul, double locking and checking for fit. Paul was searched incident
to arrest. Paul was placed in the front seat of my squad and seat belted in for transport. The Acura was later inventoried prior to tow per
Department Policy. The vehicle was towed by Joe's towing, with a 12 hour DUI and Town of Normal reclaim fee hold. I transported Paul to
NPD for DUI processing.

Upon arriving at NPD, Paul was issued the following citations: 3-707 No Valid Insurance, 3-413 Improper Display of License Plate/
Registration, and l l-50l(a)(2)-DUI. I read Paul the Warning to Motorist at 00:45 AM. Paul stated that he understood. I explained to that I
was going to observe him for 20 minutes. After the 20 minute observation period, Paul refused to provide a breath sample. The refusal
occurred at 1:20 AM. I completed the Law Enforcement Sworn Report and read the Summary Suspension. Paul was provided with a copy of
all appropriate paperwork.

Prior to transporting Paul to McLean County Jail, I again sat him in the front seat of my patrol vehicle and secured him in a seatbelt. I
activated my in car camera and read Paul the Miranda Warning from a pre printed card. Paul waived his Miranda Rights, and we completed
the NPD AIR interview.

I transported Paul to the McLean County Jail. He was booked into custody for DUI and released to correction officers.

I attached all video recordings of this incident. Officer Wiggs advised he spoke with the witness, , via telephone. told
Ofc Wiggs that she will complete a written statement in the near future. Reference Ofc Wiggs supplemental report.

This case is closed by adult arrest.

Supplemental Reporting OFFICER WILLIAM KONOVSKY - NPD, ID # 7932
On 11/ 13/13 Ofc. Underwood and I were assigned to a two-man FTO unit. During routine patrol on College Ave I was listening to my in-car
radio scanning Bloomington Police Traffic. BPD Dispatch advised their officers of a reckless vehicle, described as a black sedan, traveling
northbound on Veterans Parkway.

Upon arrival to College and Veterans I observed a black sedan traveling northbound on Veterans. I then proceeded onto Veterans from
College. Once I was behind the vehicle, the driver immediately began to slow down and signaled to turn eastbound onto Fort Jesse. The
vehicle proceeded eastbound onto Fort Jesse and then turned back southbound onto Greenbriar. This concludes my observations of the
vehicle.

Supplemental Reporting INACTIVE OFFICER TYLER WIGGS - NPD, ID # 7863
On 11/12/13 around 2340 hours, I (Officer Wiggs) was listening to the radio scanner and overheard a BPD dispatch for a possible DUI on
Veterans Parkway just north of Clearwater. The vehicle was described as a black Acura, which was swerving between multiple lanes. With
the vehicle traveling northbound, I began traveling towards Veterans Parkway, anticipating the vehicle driving into Normal. Officer
Konovsky, Officer Underwood, and Officer Rippy located the vehicle before it parked quickly in the Wal-Mart parking lot.

Officer Rippy and I discussed making contact with the driver based on the witness' description of the driving as well as the driver's quick
decision to pull into the parking lot to avoid being on the roadway. I contacted BPD and gathered contact information for the witness,
. I later contacted the incident, and she has agreed to come into the Normal Police Department on
11/18/ 13 to complete a written statement about her observations.

Officer Rippy and I approached the Acura in the Wal-Mart parking lot and initiated a consensual contact with the driver. I then assisted
Officer Rippy during his investigation. Please see Officer Rippy's report for specific details. I spoke to PAUL SANTUCCI briefly, and he
stated
Paul's Acura was first reported in Bloomington approximately 1 hour and 40 minutes after he reported leaving Springfield.

While speaking to Paul, I detected the odor of an alcoholic beverage on his breath. Paul's eyes were glassy and watery, and he appeared as
though his eyelids were heavy. Paul appeared slow and lethargic. After completing SFST's, Officer Rippy placed Paul under arrest based on
the totality of the circumstances, including his reported driving behavior, the admission to consuming alcohol, his performance on SFST's,
and other observations.

I have attached the video from my patrol vehicle (Unit 85) to this report. This concludes my involvement in this case.
