CASE STUDY
DELAY ANALYSIS INCLUDING ESTABLISHING CAUSE AND EFFECT
SESSION 4

This is an Own Time Work. Participants are expected to come prepared and be
able to discuss/demonstrate their ability to provide reasoned advice as required
and discuss the same during the Online session.

The main project consists of a 36-storey hotel tower and a 36-storey serviced apartment
tower constructed over a 4-storey podium and a 4-level basement car park. But the
superstructure above the formation level was the responsibility of a General contractor
(A). The Employer M/S Bindaas Developers engaged a separate Contractor (B) to
excavate the basement to formation level, install a secant pile shoring system (referred
to on the project as the 'diaphragm wall') and install a dewatering system. The date of
start was 21 Jun 2011 and the work allotted to Contractor B was to be completed and
tested by 25 Oct 2019

The basement construction includes a reinforced raft, reinforced suspended slabs and a
peripheral retaining wall constructed against the diaphragm wall. A sheet membrane
waterproofing system was required to be installed between the diaphragm wall and the
retaining wall by Contractor B.
You have recently been appointed as a sole arbitrator in a dispute between the
Employer to give an Award for Extension of Time due to delay in completion of certain
portions of the project, which had Key dates of completion as under; any delay by the
contractor would entitle the owner to levy Liquidated Damages at a specified rate:
Key Date 1-Completion of Secant Pile of basement: 25 Aug 2019
Key date 2-Completion of Waterproofing: 07 Oct 2019
Key date 3- Final Completion, Testing & Commissioning & Handover:25 Oct 2019

The general conditions of contract are the Conditions of Contract for Construction for
Building and Engineering Works Designed by the Employer, First Edition 1999 (FIDIC).
The diaphragm wall included several whaling beam supports, the removal of which
included in B’s scope of work. The responsibility for the operation and maintenance of
the dewatering system was transferred to B on taking over the Site.

The Baseline programme and sequence of construction for Diaphragm Wall system
activities/duration of the Basement agreed between the Employer and Contractor B is
as under:

Delays
The Basement works being undertaken by Contractor suffered certain delays on
both sides as under:-
(a) The Contractor’s mobilization was delayed by 5 days which could affect
excavation and Secant Pile. .
(b) The Employer’s structural drawings were delayed by 3 days.
(c) The Approval of Waterproofing Agency was delayed by Employer by 3 days.
(d) While undertaking construction work of Secant Pile on 11 Jul 2019 contractor
noticed a leakage and notified on three occasions to the Employer. On 22 Jul
2019, the contractor informed the Employer that the work of waterproofing could
not be started. On 25 Jul 2019 the Owner ordered the Contractor to get it
investigated by an external consultant and submit an Investigation & remedial
action Report.
(e) The Contractor submitted the Report on 16 Sept 2019, which was approved on
21 Sept 2019.
(f) The remedial work commenced 0n 22 Sept and was completed by 05 Oct 2019
and approved by the Employer on 06 Oct.
(g) Thereafter the waterproofing started on 7 Oct 2019 and other subsequent
activities were progressed.
Deliverables
The Contractor has approached you for advice on extension of time claim on the basis
of above information. Prepare the following details:
(A) Identify the delays, duration and their ownerships
(B) Analyse, compute and show the Planned and impacted schedule on a bar
chart. Also show the new Key Dates.
(C) Provide a summary of the number of days the Contractor is entitled to an
extension of time with reasons.
