Maryam Bibi and Ali Khan contracted a marriage contract in 2016 and the marriage was solemnized
under Islamic injunctions. The dower was paid as Rs.500000/- at the time of marriage by Ali Khan.
Out of this wedlock, Muhammad Omar (a minor) was born in 2017. After 3 years, Maryam bibi got to
know that her husband already contracted the second marriage during the subsistence of an existing
marriage without the written permission of the Arbitration Council nor has he taken permission from his
first wife (Maryam bibi). Such conduct of the husband towards the first wife certainly breaks her heart
and she wants to make a complaint for redressal of her grievance. Keeping in view of the above
mentioned facts of this case, interpret and apply relevant laws and legal rulings with logical reasons for
the followings:

1) As a lawyer, what Forum would you suggest Maryam bibi to file a complaint to get relief and
interpret the provisions and the Statue that governs this case?
I would suggest application to arbitration council within the prescribed period and with the payment of
prescribed fee. the provision which governs this issue is subsection 6 of section 6 Islamic Family Law which
clearly states that any person who without the permission of Arbitration council shall return the prompt or
deferred give the dower to wife.
2) Can Maryam bibi along with filing a complaint, initiate proceedings for dissolution of marriage
by Khula on the ground that her husband without her consent/approval contracted second
marriage? Give logical reasoning in support of your answer?
Yes, Maryam Bibi along with filing a complaint initiate proceedings for dissolution of marriage by Khula on
the ground that her hasband married secondly without her consent because it has been described in Islamic
Family law Ordinance.

3) Describe the punishments available for a person who contracts another marriage without the
permission of Arbitration Council? Can such punishments be applicable on Ali Khan if proved
guilty?
The punishment for this case is written in Islamic family law ordinance in subsection 5 of section 6 which
says that simple imprisonmennt which can extend to one year and fine of five hundred thpousand rupees
and yes, it is applicable to Ali Khan.

4) Keeping in view of above mentioned factoids of this case, which court has jurisdiction to try the
offence?
family court has the jurisdiction in this particular case are.

5) If the marriage of Maryam bibi and Ali Khan has dissolved on the ground that Ali Khan had
contracted another marriage without the permission of first wife, can she be compelled to return
the benefits she has received due to her marriage with Ali Khan? Give logical reasoning in
support of your answer?
No, she is not supposed to return the benefits got from Ali khan because it is clearly written in islamic family
law ordinace that the wife is not supposed to return in such cases.
