JUDICIAL AFFIDAVIT OF ENGR. RONALD TRAMP IN
LIEU OF HIS DIRECT TESTIMONY

I, ENGR. RONALD TRAMP, of legal age, married, Filipino citizen


and with residence and postal address at 202 Brookspoint, Aurora Hill,
Baguio City under oath state, that:

I am executing this Judicial Affidavit in question and answer form


before Atty. JANEYLYN B. NADIAHAN at his office at Rm. A-30 SM
Building Annex, Session Road, Baguio City fully conscious that I do so
under oath, and that I may face criminal liability for false testimony or
perjury.

OFFER OF TESTIMONY:

ATTY. JANEYLYN B. NADIAHAN: The testimony of the witness which


was given in the Ilocano dialect is being offered to prove the following facts:

1. That he is a duly licensed engineer and in his capacity as such, he


conducted the survey of the lots that Claire Joy Gumaang applied for
titling including the lot subject of the instant case;

2. That during his survey, he was able to see the house of Claire Joy
Gumaang and Alvin Comila which are adjacent to each other and
which were built over the land subject of the instant case; and

3. To identify the land being claimed by Alvin G. Comila as indicated in


the Sketch Plan (Exhibit “E”) he prepared.
1. QUESTION (Q): You are now testifying in Civil Case No. 911-88
titled “Alvin G. Comila, Plaintiff vs. Claire Joy C. Gumaang,” what is
your role in this case?

ANSWER (A): I was the Geodetic Engineer hired by both parties at


different times to conduct a survey on the parcels of land located in
Pico, La Trinidad, Benguet which was submitted to the DENR-CAR
and was approved by the same office.

2. Q: And what parcels of land are you referring to?


A: I am referring to lots 3064 & 3065 CAD-1024 La Trinidad
Cadastre, Ma’am.

3. Q: When did you conduct the survey commissioned by Mrs.


Gumaang?
A: With respect to Mrs. Gumaang, I conducted the survey sometime
in the year 2001, Ma’am.

4. Q: After conducting the survey of the parcels of land, what did you
do?
A: I have submitted the result of the survey I conducted for the
approval of the proper office of the DENR Cordillera Administrative
Region.

5. Q: What did the DENR-CAR do to the survey you submitted?


A: It approved the survey Ma’am which is now referred to as AS-
CAR-000888, Ma’am. This document is identified as Advance Survey
Plan of Lots 3064 & 3065 CAD-1024-D, LA Trinidad Cadastre and
is now referred to as AS-CAR-000888, Ma’am.

6. Q: If you remember, how much is the total land area of all the lots you
surveyed as embraced in AS-CAR-000888?
A: About 2,500 square meters, Ma’am.

7. Q: Do you remember how much land area does each land contained?
A: Yes, Ma’am. Based on my records, lot 3064 has an area of 700
square meters and lot 3065 has an area of 1,800 square meters,
Ma’am.

8. Q: With respect to Mr. Alvin Comila, what lot did you survey for
him?
A: Lot 3065, Ma’am.

9. Q: When did you conduct the survey for Mr. Comila?


A: Sometime in 2003, Ma’am.

10.Q: Why did you conduct that survey for Mr. Comila?
A: Mr. Alvin Comila claimed that he is the owner of a portion of lot
3065 where his house is built, Ma’am and that he will process the
application of such lot in his name and in the name of his sister. He
then asked me to segregate that portion he was claiming to be his land
from the portion of lot 3065.

11.Q: After conducting the survey, what did you do?


A: I subdivided lot 3065 into two lots and reduced the result of the
survey in the sketch plan of lot 3065, AS-000888 (portion) which I
gave to Mr. Comila for him to secure the necessary signature of Mrs.
Claire Joy Gumaang, before it is submitted to the DENR for its
approval, Ma’am.

12.Q: If will see the document where you reduced the result of your
survey into writing, will you be able to recognize the same?
A: Yes, Ma’am.

13.Q: I am showing to you a document that appears to be a Sketch Plan


of Lot 3065, AS-CAR-000888, kindly look at the same and inform the
Honorable Court if this is the document you are referring to?
A: This is the document I am referring to, Ma’am.

MANIFESTATION OF ATTY. JANEYLYN B. NADIAHAN:

The sketch plan was marked during the preliminary conference as


EXHIBIT “E” and attached to the records of the case as found on
page 19 thereof.

14.Q: How much of the total land area of lot 3065 is Mr. Alvin Comila
claiming?
A: 500 square meters, Ma’am.

15.Q: Is that area being claimed by Mr. Alvin Comila indicated in the
sketch plan of lot 3067 AS-CAR-000888?
A: Yes, Ma’am. It is indicated as lot 3065-B, Ma’am.

16.Q: What happened to the sketch plan of Lot 3065 which you gave to
Mr. Comila?
A: He did not return to me so we did not submit it to the DENR,
Ma’am. According to Mr. Comila, his sister refused to sign the survey
plan, Ma’am.

17.Q: During the course of the survey you conducted, what


improvements did you see in the land that you surveyed at the behest
of Mr. Alvin Comila?
A: When I conducted the survey in the year 2002, I saw the two
residential building therein. One was owned by Claire Joy Gumaang
and the other was owned by Alvin Comila, Ma’am. I saw these same
buildings when I conducted the survey in 2003, Ma’am.

18.Q: Where in the lot 3065 in the sketch plan is the building of Mr.
Comila, I you know?
A: It is within the five hundred square meters’ portion which he is
claiming as his own. As indicated in the sketch plan, the land being
claimed by Mr. Comila is lot 3065-B and his house is built within this
area.
