The crime committed by A was homicide.

The crime of homicide is committed upon existence of the


following requisites: (1) that the person was killed; (2) that the
accused killed him without any justifying circumstance; (3) that
that accused had the intention to kill, which is presumed; and
(4) that the killing was not attended by any of the qualifying
circumstances of murder, or that of parricide or infanticide.

In the case at bar, A’s intention to kill B is presumed


because of the death of the latter. Also, the crime cannot be
qualified as parricide because the marriage of A and B is void,
given that B is a transgender and marriage in the Philippines
can only be between a man and a woman. Therefore, the crime
of homicide was committed by A.

INFORMATION

The undersigned accuses A of the crime of Homicide, defined


and penalized under Article 24 of the Revised Penal Code, committed
as follows:

That on or about the 12th day of November, in the City of


Manila, and within the jurisdiction of this Honorable Court,
the said accused, with no intent to kill, accidentally pulled
the trigger of his gun and shot B, after a heated argument
between the two upon knowledge of A that B was a
transgender, inflicting upon B fatal wounds in the neck
and head which caused the direct death of B.
