A deal memo is a document offering an artist work on a production (or multiple productions) in
the U.S.
If I provide a deal memo for a foreign artist, will I be responsible for the artist’s U.S.
immigration process?
No you will not. Providing a deal memo does NOT make you responsible for the artist.
The entity or individual who serves as the petitioner (or sponsor) for the visa petition assumes
that responsibility. By providing a deal memo, you do NOT become the sponsor of the visa.
What if the project doesn’t happen according to the terms in the deal memo? Or what if it
doesn’t happen at all? Will I be in trouble with US Immigration?
No you will not. We always ensure that the terms of the deal memos are “subject to change.”
Furthermore, at this point USCIS does not have any enforcement mechanism to check whether
the projects in the deal memos proceed or not.
In very rare cases, USCIS will call or email you to confirm that you did in fact extend the offer
to the artist.
You are not involved in any way with if the Artist gets in trouble, and it would have absolutely
no bearing on you or your company whatsoever.
It is simple. Artists must have job offers (which are subject to change) to submit with a U.S. visa
application. If you are able to provide such an offer, it will help the Artist open the doors to the
U.S. market.
