II. OFFER

The sworn statement of Philip Amilsoc by way of judicial


affidavit is being ofered to prove:

1. That he saw the two (2) accused, shocked and scared


running away from the incident;
2. That aside from the accused, two other persons run
away from the scene of the incident.

The witness’s testimony is also ofered to testify on all


other related matters, facts and circumstances relevant and
material to this case.

III. JUDICIAL AFFIDAVIT PROPER

I, PHILIP AMILSOC, 39 years old, married, Filipino, and


residing at No. 35, DPS Compound, Baguio City, one of the
witnesses in this case, after having been sworn to in
accordance with law, that I am answering the questions
herein fully conscious that I do so under oath and that I may
be criminally liable for false testimony or perjury, do hereby
depose and state:

With the above ofer, transcribed below are the


questions probed from the witness:

Q1: What is your work?


A1: I am a taxi driver.

Q2: Where were you on July 24, 2015, at around 8:00 in


the evening?
A2: I was at Suello Village, Baguio City.

Q3: Why were you there?

A3: I just dropped a customer in that barangay. And I
decided to take a break at store.

Q4: Do you remember the name of the store?


A4: No, sir.

Q5: What happened that day?


A5: There was an incident of mauling.

Q6: What in particular?


A6: It was like this;
After I dropped my passenger, on the side of the road of
Suello Village in front of a store, I saw a person being hit in
the head by two persons.

Q7: What happened next?


A7: I saw two (2) persons running away from the incident.
But they looked shocked and scared.

Q8: What did you do?


A8: Fearing for what might happen to me, I locked the
doors of my taxi and turned of the lights.

Q9: What happened next?


A9: When the person (Pedro Pascual) fell, I saw two (2)
other persons ran away.

Q10: So on the night of the incident, aside from the


accused (Adriano and Samuel), you saw two (2) other
persons?
A10: Yes,sir.

Q11: How were you able to diferentiate the accused from


the other two (2) who ran away later?
A11: Because when the accused ran away, they ran
towards the Barangay Hall of Suello Village. But when the
latter two ran away, they were a mess.

Q12: What do you mean by that?


A12: They just ran away from the scene like without
nowhere to go sir.

A14: just that as much as possible I was hoping not to be
involved in a case sir. I am just a lowly driver like the
accused.
