Today, the cyberspace hosts several human rights violations with cyber-homophobia, cyber-
racism, cyber-sexism/sexual harassment among the most common.

Pictures of women, some of them minors, often receive lewd comments. Innocuous posts by
members of LGBT regularly attract homophobes and bashers. The experiences of bullied
students also extend from the school grounds to online platforms, offering little escape for the
victims.

THESE ARE NOT RIGHT.

Today, schools and the DepEd have the burden to uphold the rights of students through the strict
enforcement of the Anti-Bullying Act of 2013 or RA 10627. This law mandates schools to adopt
bullying prevention programs and provides procedures in handling bullying incidents. Bullying
refers to any severe, or repeated use by one or more students of a written, verbal or electronic
expression, or a physical act or gesture, or any combination thereof, directed at another student
that has the effect of actually causing or placing the latter in reasonable fear of physical or
emotional harm or damage to his property; creating a hostile environment at school for the other
student; infringing on the rights of another student at school; or materially and substantially
disrupting the education process or the orderly operation of a school. Online, this may take the
form of slanderous statements or accusations that cause the victim undue emotional distress like
directing profanity at the target, name-calling, tormenting and commenting negatively on victim’s
looks, clothes and body.
Gender-based online sexual harassment, which encompass psychological threats and unwanted
sexual misogynistic, transphobic, homophobic and sexist remarks is punished by the Safe
Spaces Act or RA 11313. The penalties are higher when certain circumstances are present,
such as when the offense is done by the driver of a vehicle to a passenger inside a common
carrier or PUV; when the offended party is a minor, senior citizen, PWD or a breastfeeding mother
nursing her child; and when the perpetrator is a member of the uniformed services and the act
was perpetrated while the perpetrator was in uniform.

The Cybercrime Prevention Act of 2012 or RA 10175 has also increased the penalty for libel
when done online. Libel as defined by the RPC is a public and malicious imputation of a crime, or
of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance
tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken
the memory of one who is dead. When such act is committed through a computer system or any
other similar means which may be devised in the future, it shall be punished with prision
correccional in its maximum period to prision mayor in its minimum period or a fine ranging from
Six Thousand Pesos (P6,000.00) up to the maximum amount determined by Court, or both.

Gonzales goes after cyber-critics

Several arrests for cyberlibel were made against netizens in Facebook posting negative news
about the President's staunch defender, Senator Carlito Bong Gonzales on 29 September 2019.

"Wala pong kasinungalingan sa mga sinabi namin online at di po namin intensyong saktan si
Senator (No lies were made in our posts, and we had ni intention to hurt the senator)," said Laine
Tobako, 24 year-old influencer from Quezon City who were among those arrested.

Senator Gonzales insists that his rights were violated by the hurtful online posts. He claims further
that warrants will be forthcoming for the commenters and sharers of the alleged libelous posts.

In the Philippines, we have several laws that punish the act of hacking.
• Republic Act No. 8792 or the Electronic Commerce Act of 2000 defines hacking as the
“unauthorized access into or interference in a computer system/server or information and
communication system; or any access in order to corrupt, alter, steal, or destroy using a computer
or other similar information and communication devices, without the knowledge and consent of
the owner of the computer or information and communications system, including the introduction
of computer viruses and the like, resulting in the corruption, destruction, alteration, theft or loss of
electronic data messages or electronic document.” A person who is found guilty of hacking is
“punished by a minimum fine of P100,000 and a maximum commensurate to the damage incurred
and a mandatory imprisonment of six months to three years.”

• Republic Act No. 10175, or the Cybercrime Prevention Act of 2012, offenses against
confidentiality, integrity and availability of computer data and systems, including, 1.) illegal access

interference, are penalized. Any person found guilty of any of the above acts shall be “punished
with imprisonment of prision mayor or a fine of at least P200,000 up to a maximum amount
commensurate to the damage incurred or both.”

• Republic Act No. 10173, or the Data Privacy Act of 2012, recognizes the role of information
and communications technology in the modern world, and the need to protect and secure the
rights of the data subject, particularly its right to privacy. The law punishes unauthorized
processing of personal and sensitive personal information, as well as unauthorized access or
intentional breach of security data systems where personal and sensitive information is stored. A
person found violating the provisions of the Data Privacy Act will be subject to imprisonment
and/or a fine.

• R.A. 10175, violation of Republic Act 9995 (Anti-Photo and Video Voyeurism Act of 2009).
The law prohibits recording videos or taking photos of a sexual act, the male or female genitalia,
and of the female breast, among others, without consent of the persons featured in the material.
The law ultimately seeks to prevent the reproduction, distribution, and publication of said material
regardless of whether or not the persons featured consented to the recording. The penalties for
any person found guilty of violating any of the prohibitions enumerated under Section 4 of R.A.
9995 range from an imprisonment of 3 to 7 years and a fine of P100,000.00 up to P500,000.00 at
the discretion of the court. Additional penalties are meted for the following violators: juridical
persons, public officers or employees, and aliens

The Philippines has been dubbed by the United Nations Children’s Fund (Unicef) the “global
epicenter of the live-stream sexual abuse trade.” One in 5 Filipino children are vulnerable to online
sexual exploitation.

Article 3 and 5 of The United Nations Convention for the Suppression of the Traffic in Persons
and the Exploitation of the Prostitution of Others (1949) of 2 December 1949 adopted by its
General Assembly states says in its preamble that “Prostitution and the accompanying evil of the
traffic in persons for the purpose of prostitution are incompatible with the dignity and worth of the
human person”.

The United Nations 1979 Convention on the Elimination of All Forms of Discrimination against
Women (CEDAW) asks states to “take all appropriate measures, including legislation, to suppress
all forms of traffic in women and exploitation of prostitution of women”.

Online sexual exploitation or authorizing the purchase of, or selling access to, another person’s
body reaffirms the established imbalances of power in sexual relationships and it is an
unacceptable and direct assault to the inviolable, inherent dignity of every victim which is contrary
to human dignity and universal human rights.

The government is under a binding obligation to respect and to protect the dignity of the citizens,
which is the cornerstone of international human right law. When defining and implementing
policies with regards to cybercrimes such as prostitution and its resultant exploitation, the govt
must ensure that it works towards the elimination of these cybercrimes and the protection of its
victims.

The Cybercrime Prevention Act of 2012, officially recorded as Republic Act No. 10175, is a law in
the Philippines that was approved on September 12, 2012 addresses legal issues concerning
online interactions and the Internet in the Philippines. Among the cybercrime offenses included in
the bill are cybersquatting, cybersex, child pornography, identity theft, illegal access to data and
libel.
The Congress has also enacted Republic Act No. 11313 also known as the Safe Spaces Act or
the “Bawal Bastos Act” to address existing gaps and issues on equality, security, and safety of
both women and men in private and public spaces. The Safe Spaces Act is intended to expand
the scope of the Anti-Sexual Harassment Act of 1995 or Republic Act No. 7877. Safe Space law
provides stronger protection vs sexual harassment acts.
