ART. 163 [157].

EMERGENCY MEDICAL AND DENTAL SERVICES

It shall be the duty of every employer to furnish his employees in any locality with free medical and
dental attendance and facilities

Size of Employees Requirement[s]


10-50 The services of a graduate first-aider shall be
provided who may be one of the workers in the
workplace and who has immediate access to the
first-aid medicines [According to IRR]
51-200 [Non-hazardous workplaces] a graduate first-aider shall be provided for the
protection of the workers, where no registered
nurse is available
51-200 [hazardous workplaces] Services of a full-time registered nurse shall be
provided.
201-300 The services of a full-time registered nurse, a
part-time physician and dentist, and an
emergency clinic

The physician and dentist engaged for such


workplace shall stay in the premises for at least
two (2) hours a day.

Where the establishment has more than one (1)


work shift a day, the required two-hour stay shall
be devoted to the work shift which has the
biggest number of workers and they shall be
subject to call at any time during the other work
shifts to attend to emergency cases.
301+ [Non-hazardous workplaces] 1. The services of a full-time physician, dentist
and a full-time registered nurse as well as a
dental clinic
2. An infirmary or emergency hospital with one
bed capacity for every one hundred (100)
employees.

The physician and dentist shall stay in the


premises of the workplace for at least eight (8)
hours a day.

Where the workplace has more than one (1) work


shift a day, they shall be at the workplace during
the work shift which has the biggest number of
workers and they shall be subject to call at any
time during the other work shifts to attend to
emergency cases.
1. the services of a full-time nurse, a full-time
physician, a full-time dentist, a dental clinic and
2. An infirmary or emergency hospital with one
bed capacity for every 100 workers shall be
provided.

The employer may engage the services of a part-


time physician and a part-time dentist.

The physician and dentist shall be subject to call


at any time during the other work shifts to attend
to emergency cases.

 The following are considered Hazardous Workplaces:


1. Where the nature of the work exposes the workers to dangerous environmental elements,
contaminants or work conditions including ionizing radiations, chemicals, fire, flammable
substances, noxious components and the like.
2. Where the workers are engaged in construction work, logging, firefighting, mining, quarrying,
blasting, stevedoring, dock work, deep-sea fishing and mechanized farming.
3. Where the workers are engaged in the manufacture or handling of explosives and other
pyrotechnic products.
4. Where the workers use or are exposed to heavy or power-driven machinery or equipment.
5. Where workers use or are exposed to power-driven tools.

ART. 164 [158]. WHEN EMERGENCY HOSPITAL NOT REQUIRED

 The requirement for an emergency hospital or dental clinic not applicable when:
1. there is a hospital or dental clinic which is accessible from the employers establishment; and
2. the employer makes arrangement for the reservation therein of the necessary beds and dental
facilities for the use of his employees.

 To be accessible, the hospital should be:


1. Within five kilometers from the workplace; or
2. Accessible within 25-minute travel.

 The employer must provide the transport in emergency cases.


 The employer shall enter into a written contract with the hospital or dental clinic for the use thereof
in the treatment of workers in case of emergency.
