In the interest of the service, TESDA Order No. 005, Series of


2019, creating an Investigation Committee is hereby amended to
integrate the functions of the Administrative Complaints Committee
(ACC) and the Committee on Decorum and Investigation (CODI) with
the functions of the Investigation Committee which shall not be limited
to the conduct of investigation based on the findings of the NISP on the
implementation of the scholarship programs of TESDA as follows:

1. The Committee shall handle all disciplinary and non-


disciplinary complaints. In cases where reliminary and
formal investigations shall be require , the same shall be
conducted in accordance with the 2017 Rules on
Administrative Cases in the Civil Servile (2017 RACCS) as
promulgated by the Civil Service Commission (CSC). Within
fifteen (15) working days after the termination of the
investigation, the Committee shall submit its report and
recommendation to the Office of the Director General.

2. The • Committee shall also handle all disputes and


controversies subject of arbitration or mediation as defined by
Republic Act No. 9285, otherwise known as the Alternative
Dispute Resolution Act of 2004.

3. In addition, the Committee shall receive and investigate


sexual harassment complaints pursuant to CSC Resolution
No. 01-0940 on the Administrative Disciplinary Rules on
Sexual Harassment Cases, in relation to Section 51 (A), Rule
10 of the 2017 RACCS.

4. The members of the Committee shall meet at least once a


month to deliberate the complaints or cases involving TESDA
personnel except Presidential Appointees.

5. A Secretariat to the Committee shall be created to provide it


with technical and administrative support.

This Circular shall take effect as indicated and shall


amend/revoke all previous issuances inconsistent herewith.
