‘Amended Summary 07/20/20 ‘.Gillspie Subsidence Complaint investigation Emmons Road Ashford, WV {4/13/20 Complaint was relayed from Chris Haynor- WVDEP AML advising only mining operation he could find was Coal River cenergy’s Fork Creek Operations. 4/13/20 DMR Inspector went to Gillie residence to conduct subsidence Investigation. Inspector contacted nearest known mining company to his residence (Lexington Coal Company, LC). Inspector advised citizen on MIR-35 that obtaining final maps for this area and continuing the investigation, 4/2220 nspector reviewed mapping of nearest underground mine workings to Mr Gillie residence Permit US02298 with DEP Engineer Dave Wagner. it was determined the underground mining operation was completed by Coal River Energy and final released in 2014, Was concluded that this mine was outside of the 30-degree angle of draw and complaint investigation was ‘terminated. 5/8/20 Nir. Glispe contacted WVDEP advising that damages were getting Worse and he was afraid to stay a is home because home Is setting andi afraid of gas leak. 5/8/20 Inspector immediately re-opened the investigation. Was determined thet Permit U502298 is completely overbonded by Lexington Coal Company, LLC Permit 0502198. Notarized statement 07/17/14 in release package of Permit USO2298 stated that Permit 0502188 will assume responsiblity for any mine drainage or subsidence that s caused by Permit US02298. Lexington Coal representative Travis Fisher was notified of Mr. Gilspe's concerns. Company representathve immediately contacted Mr. ilispie to advise was coming out to asess the situation and offered to put citizen ina hotel 5/8/20 Mr. Glsple advised company representative they didn't need to come out on 5/8/20 that he would rather they come out ‘on Monday 5/11/20 due to rainy weather. Advised he had a building he could stayin or he could stay with his daughter. Company was ordered on an MI Inspection Report to correct any material damage resulting from subsidence, 5/14/20 Company representatives and DEP inspector assessed damages at Mr. Gilispie residence. Company representatives advised inspector they didnot fel they could have caused the problem but they were going to gather more mapping information. 5/11/20 WVDEP Assistant Director Dallas Runyon and Inspector Supervisor Tim Justice completed site assessment at Mr. Gilisple residence and Foster residence (Mr. Glspie's daughter) who lves next to Mr. Gillsple. Wate samples were collected from ‘seeps on the hill behind Mr. Gillspie residence and Mrs. Fosters driveway. Water sample was also collected from artesian water well behind Foster residence. Samples were analyzed for conductivity and sulfates. Photographs and GPS coordinates were obtained of slides and cracks along hill side behind Mr. Gilispie residence. Information was forwarded to DEP Engineer and Geologist to assist in the investigation 5/14/20 Inspector called Mr. Gillispie to inforin him that the investigation is on-going. 5/20/20 Inspector called Mr. Gilispie to update him on the investigation. 5/27/20 DEP Engineer submitted investigation report finding no evidence that supports the claim that subsidence has ‘occurred within Coal River Energy's Fork Creek No.1 Mine (US02298) that would have cause damages to Mr. Gillispie's residence. 5/28/20 DEP Geologist submitted investigation findings report indicating based on location of the properties along Coal River being on alluvial material with @ major lineament extending along the properties, that slides, and artesian well are being caused by a change in the hydrologic condition of the property driven by the presence of Lineament 1. 15/29/20 inspector hand delivered results of investigation to Mr. Gllspie and daughter Drema Foster. 6/01/20 Inspector withdrew Order to Lexington Coal Company, LLC based on Investigation findings. 6/24/20 Inspector Supervisor was notified via email Ms. Foster (Mr. Gillispie's daughter) contacted Governor's Office advising conditions are getting worse after investigation was closed. Advised to conduct a follow-up investigation with engineering/geology personnel 6/25/20 A follow-up investigation was conducted with WVDEP inspector Ken Toler, WVDEP Engineers Dave wager and Luke O’Neat and WVDEP Geologist Cheryl Bowen. Additional water samples were collected for further analysis to determine if a hydrologic connection and will be made available when received (07/02/20 investigation report has been amended to include additional information for clarity purposes. He showed to this inspector problems with doors shutting and his porch separating from his house. He states ‘these all have happened within the same time period. Investigation of the area shows that mining was done well behind this property outside the 38-degree subsidence area. The mining was done near his howe in 2804 by Bunn mining under the permit U5€2298. This permit was later fully release without issue in 2014 and no mining in this area since. Lexington Coal is now reclaiming the surface area associated with this permit. For these reasons, there is no way to determine the cause of the settlenent on the complainant property. This investigation is terminated at this tine. The KVDEP geologist report States that there are natural fault lines that run along with these slides. This report also states ground water pressures are changing because of these shifting faults causing these shifts of land. The geologist report 4s attached to this complaint. With the data from these reports it is determined that these darages are not from mine subsidence. Facts and Findings ‘Mr. Thurmond Gillispie and Mr. Roy Graley Citizen complaints from Mr. Thurmond Gillispie and Mr. Roy Graley, both of Emmons Road in Ashford, West Virginia have been submitted to the West Virginia Department of Environmental Protection (WVDEP). The concems regard mass movement of land on their properties and the artesianing of a private well located in the vicinity. ‘The most recently issued permit that is near the Gillispie and Graley properties is a Lexington Coal Company, LLCs permit, 0-5007-11. This permit identifies both properties on ‘the Groundwater Inventory List located in Section J-2. Both properties report using PSD as the source of domestic water use on the properties. The exact location of the artesianing well is not identified in the Groundwater Inventory list. ‘The location of the properties is adjacent to Coal River. Permits show that the properties are located along what is referred to as Lineament 1 Property located along rivers is composed of alluvial material. Alluvial material, or alluvium, is a general term for material, deposited by a stream, river or other body of running water. This material is not compacted like rock and tends to be loose and soil like. This is the type of material on which the Gillispic and Greyly properties lie. Another feature in the area of the properties is Lineament 1. A lineament is a linear feature on the earth's surface, such as a fault or fracture, This lineament is distinct enough that it is identified and discussed in permits issued in this area, such as permit O-5007-11 and on USGS Geologic maps. Such large features are known to redirect water and change flow paths of ‘groundweter, The artesianing ofthe well indicates that there is pressure being applied to the well, forcing the water to the surface. This pressure can come from a rise in the water table in which the well is completed, forcing water to overflow the wel Water samples were collected on May 11, 2020. The slide areas and the artesianing well ‘were sampled. None of these water samples indicate that the water emanating from the slides or the well are mine water, Mine water contains greater sulfate concentrations than are present in the collected samples, Based on the location of the properties along Coal River being on alluvial material with a ‘major lineament extending along these properties, itis determined that the slides and artesianing well are being caused by a change in the hydrologic condition ofthe property. This change is being driven by the presence of Lineament 1. Cheryl hnaton Cher(/ E. Johéton 5/28/2020 Geologist IV, Region V ‘Amended Geologist Findings ‘The slides of concern at the Gillispie property extend to nearly the top of the mountain. Some of these slide areas have uncovered bedrock. The bedrock itself is not cracked or fractures. The soil is sliding off the rock. Lineament 1 does extend over the U-5022-98 mine works. To have artesianing through the lineament to the Gillispie property, the mine pool would have to have enough head to provide enough pressure to extend at least 190 vertical feet. In this mine, the dip isto the North West. The Gillispie property lies on strike with the coal seam. In the location of the Gillispie property, hydrostatic head in the mine would be at 50 feet. This is not enough head to reach the surface, as the coal seam has 190 feet of cover in this area, Additionally, the calculations provided demonstrate that the mine void adjacent to the Gillispie property became fully inundated within 3 years after mining had stopped. The mining in this area ‘ceased in 2004. The mine void would be completely inundated in 2007. The artesianing and slides did not begin until approximately February 2020. There is no water data from the mine release that demonstrates the quality of the mine pool. There is no way of getting a mine pool sample for comparison. The mine is below drainage and sealed with bulkhead seals. The depth of the artesianing well is previously undocumented; in all groundwater inventories the residences reported only PSD. The only information was provided by Mr. Gillispie on June 25, 2020. He reported the artesianing well is 100 feet deep. He also stated a well on his property is 75 feet deep and isnot artesianing. A third well on the property is dry; its depth is undetermined. This is the only information for these wells, as none were identified by the residents on the previously conducted groundwater inventories in the area. Only Sulfates and Conductivity were analyzed when water samples were collected on May 11, 2020. ‘The artesianing well is discharging iron laden, red tinted water. The water of the stream beside the Gillispie property is clear. The water emanating from the seeps also appears to be clear. Additional ‘water samples were collected on June 25, 2020 for further analysis to determine if the waters are hydrologically connected. This information will be made available when received. An inspection was performed by Inspector Ken Toler, Inspector Supervisor Tim Justice and Regional Assistant Director Dallas Runyon. They found cracks in the cinder ‘block underpinning, movement of the front and rear porches and cracks in the surrounding yard. As they proceeded up the hill behind his home they observed sloughing of the alluvial material although no cracking of the bed rock was noticed. Mining in the area of concem was completed approximately August 6, 2004. The ‘mining inthe direction of Mr, Gillespie's residence stopped 267 feet away from his home and approximately 190 feet of cover above the mine workings. The mining in this area was stopped due to water building up in the face that prevented mining to progress to the final ‘projections. The pillar size would indicate a factor of safety of over two (2). There was no second mining performed in this ares. The Geo-Hyéro Map indicated a liniment in the ining area. Projecting the 30° angle of draw, it would extend out one hundred and ten feet (110°) from the furthest extent of mining roughly one hundred and forty-eight feet (148°) from Mr. Gillespie's home. This mine was closed and sealed May 16, 2014. After reviewing the information pertaining to this complaint, I find no evidence that ‘supports the claim that subsidence has occurred within this mine that would cause the damages to Mr. Gillespie’s residence.
